Usando da faculdade conferida pelo artigo 3.º, n.º 1, alínea 3), da Lei Constitucional 6/75, de 26 de Março, o Governo decreta o seguinte:Artigo único. É aprovado o Acordo entre o Governo da República Portuguesa e o Governo da República Popular da Polónia sobre Cooperação na Indústria de Construção Naval, assinado em Varsóvia a 12 de Junho de 1975, cujo texto em inglês e respectiva tradução para português vão anexos ao presente decreto.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF
PORTUGAL AND THE GOVERNMENT OF THE POLISH PEOPLE'S REPUBLIC
ON COOPERATION IN SHIPBUILDING INDUSTRIES.
The Government of the Republic of Portugal and the Government of the Polish People's Republic:
Acting in spirit of the Long Term Agreement on the development of trade, navigation and economic, industrial and technical cooperation concluded between the Government of the Republic of Portugal and the Government of the Polish People's Republic on 14th of May, 1975;
Refering to Process-Verbal between Minister of Foreign Trade and Shipping of the Polish People's Republic and Minister of Trade and Tourism of the Republic of Portugal signed on 14th of May, 1975;
Desiring to take fuller and more efficient advantage of production capabilities of shipbuilding industries of both countries;
Considering as useful the conclusion of a separate agreement in this respect;
have agreed as follows:
ARTICLE 1
Both Parties will undertake necessary steps and means to establish and develop wide cooperation between shipbuilding industries of both countries covering the following fields:Construction of cargo, fishing and technical vessels in Polish and Portuguese shipyards for needs of both countries as well as for the third markets;
Ship repairs in shipyards of both countries;
Joint designing of vessels;
Training of personnel.
The foregoing fields are not limitating both Parties, if agreed so, to extend the cooperation on other fields of shipbuilding.
ARTICLE 2
The cooperation will, in first stage, cover construction of bulk carriers for general dry cargo transports, general cargo vessels adapted for container transports, fishing vessels and merchant ship repairs.Detailed scope of this cooperation is given in Appendix 1 to this Agreement.
ARTICLE 3
The object, scope and terms of carrying out individual ventures undertaken within this Agreement will be determined through direct contacts of competent organizations of both countries.
ARTICLE 4
The Polish Party will provide an assistance, if required by the Portuguese Party, in creating projecting and designing capabilities in Portuguese shipbuilding industry, taking advantage of achievements and experience of Polish shipbuilding in this field.For that purpose contacts and cooperation between respective organizations as well as scientific and design centres of Contracting Parties will be established.
ARTICLE 5
The mutual services and supplies resulting from implementation of this Agreement will be accomplished on the basis of contracts concluded by the competent organizations of both countries on normal commercial terms.
ARTICLE 6
Both Parties have agreed that in order to supervise an appropriate implementation of this Agreement a mixed working group will be set up. The Polish section of this group will be presided by the representative of the Ministry of Heavy Industry and the Portuguese section will be presided by the representative of the Ministry of Industry and Technology. The meetings of the working groups will be held twice a year alternatively in either country in time agreed upon by both Parties.
ARTICLE 7
The Mixed Commission established under the article XVIII of the Long Term Agreement on the development of trade, navigation and economic, industrial and technical cooperation concluded between the Government of the Polish People's Republic and the Government of the Republic of Portugal on 14th of May, 1975 will be informed each time by the chairmen of working groups of its work and sessions.
ARTICLE 8
This Agreement will be valid for an unlimited period of time and will enter into force on the day of signature.This Agreement will expire after one year since either of the Parties gives to the other one written notice of termination.
A termination will have no effect on the validity and fulfilment of contracts concluded on the provisions of the present Agreement.
Done in Warsaw on 12th of June, 1975 in two original copies, in English and Polish languages, both texts being equally authentic.

APPENDIX I
Proposals notified by the Polish Party
1 - Construction of ships for the Polish Party:9 bulk carriers 32000 DWT each;
4 general cargo vessels adapted for transport of containers 16000 DWT each;
50 fishing vessels up to 110 feet length;
5 white fish trawlers 500 DWT each;
3 hulls for semi-containers ships 16-17000 DWT each.
The Polish Party may provide a documentation for the foregoing types of vessels as well as ship equipment to the extend and on the terms agreed upon case by case.
2 - Ship repairs:
The Polish Party takes into consideration possibility of directing tankers and bulk carriers from 70000 to 150000 DWT to Portuguese shipyards for repairs.
Approximate labour consuming amounts to 160000 man hours for 1976 approximately.
This number could be gradually increased in the coming years.
3 - The quantity of ships to be built in Portuguese shipyards as well as the number and scope of repairs will be subject to additional arrangements between competent organizations according to the stipulations of this Agreement.
