O Acordo entre o Governo da República Portuguesa e o Governo da República da Turquia relativo à Proteção Mútua de Informação Classificada foi assinado a 3 de março de 2015, em Lisboa, por ocasião da I Cimeira Intergovernamental Portugal/Turquia.

O presente Acordo tem por objeto estabelecer os procedimentos e os princípios para garantir e regular a segurança da informação e materiais classificados trocados ou originados em atividades de cooperação entre as Partes.

O referido Acordo representa um contributo importante para o reforço das relações bilaterais entre ambos os Estados.

Assim:

Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre o Governo da República Portuguesa e o Governo da República da Turquia relativo à Proteção Mútua de Informação Classificada, assinado em Lisboa, em 3 de março de 2015, cujo texto, nas versões autenticadas, nas línguas portuguesa, inglesa e turca, se publica em anexo.

ACORDO ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E O GOVERNO DA REPÚBLICA DA TURQUIA RELATIVO À PROTEÇÃO MÚTUA DE INFORMAÇÃO CLASSIFICADA

O Governo da República Portuguesa e o Governo da República da Turquia (doravante designados individualmente por «Parte» e coletivamente por «Partes»),

Reconhecendo a necessidade de garantir a proteção da informação classificada trocada entre si e entre as suas pessoas singulares ou coletivas, no âmbito de convenções, entendimentos ou contratos de cooperação concluídos ou a concluir;

Desejando estabelecer um conjunto de regras relativas à proteção mútua de informação classificada trocada entre as Partes;

Confirmando que o presente Acordo não afeta os compromissos assumidos no âmbito de outros Acordos Internacionais que ambos os seus Estados sejam Parte e que não será utilizado contra os interesses, a segurança e a integridade territorial de outros Estados,

Acordam no seguinte:

Artigo I

Objeto e âmbito de aplicação

O presente Acordo tem por objeto e âmbito de aplicação estabelecer os procedimentos e os princípios para garantir a segurança da Informação e materiais Classificados trocados ou originados em atividades de cooperação entre as Partes.

Artigo II

Definições

Para os efeitos do presente Acordo:

a) «Informação Classificada» designa a informação de qualquer forma, natureza e meios de transmissão que, de acordo com o direito no Estado de cada Parte, necessita proteção contra a divulgação não autorizada, acesso indevido ou perda, e que tenha sido designada como tal;

b) «Contrato classificado» designa um entendimento que contém ou envolve acesso a Informação Classificada, estabelecendo e definindo direitos e obrigações;

c) «Parte transmissora» designa a Parte, incluindo as suas pessoas singulares ou coletivas, que transmite informação classificada à outra Parte;

d) «Parte destinatária» designa a Parte, incluindo as suas pessoas singulares ou coletivas, que recebe a informação classificada da Parte transmissora;

e) «Terceira Parte» designa qualquer organização internacional ou Estado que não é Parte no presente Acordo;

f) «Projeto classificado» designa todos os tipos de atividades no âmbito dos Contratos classificados;

g) «Certificado de Segurança das Instalações» designa o documento oficial que comprove que as medidas de proteção previstas estão em conformidade com a classificação de segurança necessária, considerando a instalação, a localização da instalação, condições ambientais e possíveis ameaças externas e internas de modo a assegurar os requisitos de segurança física para a proteção da Informação Classificada;

h) «Certificado de Segurança Pessoal» designa o documento oficial que comprove que a pessoa pode ter acesso a Informação Classificada ou a Projetos classificados com sujeição ao princípio da necessidade de conhecer ou para dar acesso a áreas classificadas onde sejam mantidas ou realizados;

i) «Princípio da necessidade de conhecer» designa o princípio segundo o qual existe uma determinação de que o possível recetor tem necessidade de aceder, conhecer ou possuir a informação a fim de executar as suas tarefas oficiais.

j) «Organização» designa as entidades governamentais ou empresas privadas independentemente da respetiva propriedade, onde a Informação Classificada tenha existido ou onde os Projetos classificados foram realizados ou que envolvam a execução de Contratos classificados.

Artigo III

Autoridade de segurança competente

O presente Acordo será aplicado pelas seguintes Autoridades de Segurança competentes:

Pelo Governo da República Portuguesa: Autoridade Nacional de Segurança, Presidência do Conselho de Ministros, Rua da Junqueira, 69, 1300-342 Lisboa, Portugal

Artigo IV

Graus de classificação de segurança

1 - No âmbito das medidas de segurança prescritas pela respetiva legislação nacional, a Autoridade de Segurança Competente das Partes e as Organizações no seu Estado comprometem-se a garantir a proteção da Informação Classificada e do Projeto classificado, trocados entre si ou originados por cooperação mútua, e adotar a equivalência dos graus de classificação, como mostra a tabela abaixo, em Turco, Português e Inglês:

2 - A Autoridade de Segurança Competente de cada Parte e as Organizações no seu Estado comprometem-se a marcar a Informação Classificada que recebam da Autoridade de Segurança Competente da outra Parte ou das Organizações no seu Estado com os seu grau de classificação de segurança nacional e o equivalente em Inglês, em conformidade com os graus de classificação de segurança apresentados na tabela acima.

3 - As Autoridades de Segurança Competentes das Partes comprometem-se a informar-se mutuamente sobre as alterações feitas nos graus de classificação de segurança.

Artigo V

Alterações ou cancelamento de graus de classificação de segurança

1 - O grau de classificação de segurança atribuído à Informação Classificada ou ao Projeto classificado pode ser elevado, diminuído ou cancelado pela Parte transmissora que os classificou. Essa decisão de alteração ou cancelamento será imediatamente notificada pela Parte transmissora à Parte destinatária que executará a decisão de alteração ou cancelamento.

2 - O grau de classificação de segurança a ser dado à informação ou ao projeto gerados no âmbito da cooperação entre a Autoridade de Segurança Competente das Partes e/ou Organizações no seu Estado será determinado por mútuo consentimento da Autoridade de Segurança Competente das Partes e/ou Organizações no seu Estado. Em caso de desacordo sobre o grau de classificação de segurança a ser dado a tal informação ou projeto, será adotado o grau mais elevado proposto por uma das Autoridades de Segurança competentes das Partes e/ou Organizações no seu Estado.

3 - O grau de classificação de segurança dado à informação classificada ou ao projeto classificado, gerados no âmbito da cooperação será alterado ou cancelado por mútuo consentimento da Autoridade de Segurança Competente das Partes e/ou Organizações no seu Estado.

Artigo VI

Transmissão da informação classificada

1 - A Informação Classificada será transmitida entre as Partes, de acordo com o Direito em vigor da Parte transmissora, normalmente através da via diplomática, ou por qualquer outra via acordada entre as Autoridades de Segurança Competentes.

2 - A Autoridade de Segurança Competente da Parte destinatária confirmará por escrito a receção da Informação Classificada.

Artigo VII

Tradução, reprodução e destruição da informação classificada

1 - A informação marcada com o grau de classificação de segurança de «(ver documento original)«/«MUITO SECRETO»/«SECRETO»/«TOP SECRET»/«SECRET» pode ser objeto de tradução ou reprodução apenas com o consentimento prévio por escrito da Autoridade de Segurança Competente da Parte transmissora.

2 - A tradução de qualquer informação classificada será feita por pessoas que possuam o Certificado de Segurança Pessoal no grau adequado. Todas as traduções incluirão uma apropriada marcação e anotação de classificação de segurança indicando que o documento classificado foi recebido da Parte transmissora. Os documentos traduzidos em conformidade estão sujeitos ao mesmo controle e proteção que o texto original.

3 - Na reprodução de Informação Classificada, todas as marcas de segurança originais apostas serão também colocadas nas respetivas cópias. Tal reprodução de informação está sujeita ao mesmo controle e proteção dado à informação original. O número de cópias deve ser limitado ao necessário para fins oficiais.

4 - A Informação Classificada será destruída ou alterada de forma a evitar a reconstituição total ou parcial da informação. Contudo, a quando o seu prazo ou finalidade do seu uso termina a informação marcada com o grau de classificação de segurança «(ver documento original)»/«MUITO SECRETO»/«TOP SECRET» não pode ser destruída, mas será devolvida pela Parte destinatária à Parte transmissora, a não ser que as Autoridades de Segurança Competentes das Partes decidam de outra forma, por mútuo acordo.

Artigo VIII

Uso da informação classificada

1 - A Informação Classificada trocada e/ou gerada pela cooperação mútua entre a Autoridade de Segurança Competente das Partes e/ou Organizações no seu Estado só deve ser utilizada para os fins para os quais foi transmitida.

2 - O «Know-how» e outros direitos de propriedade intelectual relativos à Informação Classificada ou ao Projeto classificado serão respeitados reciprocamente. Outros aspetos neste âmbito serão especificados em pormenor nos Contratos classificados ou nas instruções de segurança dos Projetos/anexo de segurança a serem efetuados separadamente para cada Projeto classificado no âmbito do presente Acordo.

3 - A Informação Classificada ou o Projeto classificado não serão divulgados a uma Terceira Parte sem o consentimento prévio por escrito da Autoridade de Segurança Competente da Parte transmissora.

4 - A Informação Classificada ou o Projeto classificado apenas pode ser divulgado a pessoas que estejam devidamente autorizadas e que sejam detentoras do Certificado de Segurança Pessoal da sua Autoridade de Segurança Competente, identificada no artigo III do presente Acordo, em conformidade com o Princípio da necessidade de conhecer.

Artigo IX

Proteção da Informação Classificada ou do Projeto classificado

1 - A Autoridade de Segurança Competente das Partes e as Organizações no seu Estado tomarão todas as medidas necessárias para a proteção da Informação Classificada e do Projeto classificado gerados ou transferidos no âmbito da cooperação mutua e assegurarão, pelo menos, com igual grau de classificação de segurança, a mesma proteção para tal informação que a estipulada para a sua própria Informação Classificada ou Projeto classificado

2 - A proteção da informação e do projeto marcados com o grau de classificação de segurança de «(ver documento original)»/«MUITO SECRETO»/«TOP SECRET» será assegurada através da adoção de medidas de segurança adicionais a serem definidas em instruções de segurança do projeto/anexo de segurança que será elaborada para cada projeto, separadamente.

3 - Caso a Informação Classificada ou o Projeto classificado trocados ou gerados no âmbito da cooperação sejam entreguem a empresas privadas ou mantidos nas instalações destas empresas deverá ser exigido um Certificado de Segurança das Instalações com o grau apropriado, emitido pela Autoridade de Segurança Competente do Estado destas empresas, e tal informação será dada em conformidade com o Princípio da necessidade de conhecer.

4 - As empresas privadas devem cumprir as demais obrigações previstas no presente Acordo.

5 - As obrigações da Autoridade de Segurança Competente das Partes e das Organizações no seu Estado para proteção da Informação Classificada e do Projeto classificado e para a prevenção da sua divulgação continuarão a aplicar-se, mesmo após a cessação da vigência do presente Acordo.

Artigo X

Instrução de segurança do Projeto/anexo de segurança ao Contrato classificado

1 - Para cada um dos projetos, definidos com um grau de classificação de segurança maior do que «(ver documento original)»/«RESERVADO»/«RESTRICTED», a ser realizado no âmbito da cooperação entre a Autoridade de Segurança Competente das Partes e/ou as Organizações no seu Estado, será preparado como um anexo ao Contrato classificado a ser assinado, uma instrução de segurança de Projeto/anexo de segurança que estabeleça as medidas a serem adotadas para garantir a segurança no âmbito do Projeto.

2 - As Instruções de Segurança do Projeto/anexo de segurança contêm, pelo menos, os seguintes aspetos:

a) Identificação das Organizações envolvidas no projeto e as respetivas obrigações no âmbito do mesmo;

b) As definições de classificação de segurança, se aplicável;

c) As medidas de segurança a serem adotadas para a proteção da Informação Classificada e do Projeto classificado;

d) Os procedimentos para a transmissão e uso da Informação Classificada;

e) As obrigações a que estão adstritos os intervenientes do Contrato classificado relativas à proteção de Informação Classificada, dando acesso apenas a uma pessoa que já esteja credenciada com sujeição ao Princípio da necessidade de conhecer no âmbito das atividades do contrato.

Artigo XI

Quebra de segurança

1 - Em caso de quebra de segurança a Autoridade de Segurança Competente em cujo Estado uma quebra de segurança tenha ocorrido informará a Autoridade de Segurança Competente da outra Parte com a maior brevidade possível, adotará todas as medidas necessárias e realizará a investigação apropriada. A outra Parte, se necessário, cooperará na investigação.

2 - No caso de violação das regras estabelecidas para garantir a segurança da Informação Classificada ou do Projeto classificado devido a atos dolosos ou negligentes da Autoridade de Segurança Competente de qualquer Parte e/ou das Organizações no seu Estado, será estabelecido um Grupo de Discussão Bilateral para determinar os danos e perdas ocorridos devido a negligência, tendo em atenção o princípio da reciprocidade entre as Partes.

3 - Qualquer perda ou dano ocorrido devido à violação das regras de segurança será determinado pelo Grupo Bilateral de Discussão tendo em atenção a legislação nacional dos Estados de ambas Partes.

4 - Assegurar-se-á que tal perda ou dano será compensado mediante decisão das autoridades competentes das Partes.

Artigo XII

Visitas

1 - As visitas a instalações das Organizações no Estado de cada Parte no âmbito das atividades de cooperação entre a Autoridade de Segurança Competente das Partes e/ou das Organizações no seu Estado decorrerão mediante receção da autorização escrita, conferida pela Autoridade de Segurança Competente do Estado anfitrião.

2 - As visitas que não envolvam acesso a Informação Classificada ou a Projeto classificado ou a áreas onde estes sejam mantidos ou manuseados ou realizados decorrerão em cumprimento com a legislação nacional do Estado anfitrião.

3 - As visitas que envolvam acesso a Informação Classificada ou a Projeto classificado ou a áreas onde estes sejam mantidos ou manuseados ou realizados apenas decorrerão mediante autorização prévia, por escrito, conferida pela Autoridade de Segurança Competente da Parte do Estado anfitrião para pessoas que tenham o Certificado de Segurança Pessoal no grau de classificação de segurança adequado.

4 - As visitas que envolvam acesso a Informação Classificada ou a Projeto classificado por indivíduos de uma Terceira Parte apenas decorrerão mediante consentimento mútuo, por escrito, da Autoridade de Segurança Competente das Partes.

5 - Os pedidos de visita serão notificados, por escrito, à Autoridade de Segurança Competente da Parte do Estado anfitrião, com pelo menos uma antecedência mínima de 21 (vinte e um) dias relativamente à data proposta para a visita.

6 - O documento relativo a cada pedido de visita incluirá a seguinte informação:

a) O nome e o apelido dos visitantes, o local e a data de nascimento, a nacionalidade, o número do passaporte e a função;

b) A data proposta para a visita e a duração prevista para a mesma;

c) O grau do Certificado de Segurança Pessoal e o tipo de informação, documento, material ou projeto a ser acedido, bem como o grau de classificação de segurança se os visitantes tiverem acesso a informação classificada ou ao projeto classificado;

d) O nome das instalações e locais a serem visitados, bem como o propósito da visita;

e) Os nomes, apelidos e títulos oficiais das pessoas que receberão os visitantes;

f) A data do pedido, a assinatura e a aposição do selo oficial da Autoridade de Segurança Competente da Parte que envia os visitantes.

7 - As Autoridades de Segurança Competentes das Partes podem acordar em estabelecer listas de pessoas autorizadas a efetuar visitas recorrentes. Estas listas são válidas por um período inicial de doze meses. Após a aprovação das listas pelas Autoridades de Segurança Competentes das Partes, os termos para cada visita específica serão tratados diretamente com as autoridades adequadas das organizações a serem visitadas por aquelas pessoas, de acordo com os termos e condições acordados. A Autoridade de Segurança Competente deverá ser informada após a realização das visitas.

8 - Em caso de morte, doença ou lesão dos visitantes durante as visitas realizadas às instalações das Organizações de qualquer Parte no seu Estado, a Organização visitada informa imediatamente a Organização que envia os visitantes sobre o sucedido e assegura o transporte do corpo do visitante para o aeroporto internacional mais próximo no território do seu Estado e aplicará todas as medidas adequadas para o transporte, incluindo, as relativas à proteção sanitária.

Artigo XIII

Assuntos financeiros

Cada Parte assumirá os encargos que para si advenham da aplicação do presente Acordo.

Artigo XIV

Solução de controvérsias

Qualquer controvérsia sobre a interpretação ou aplicação do presente Acordo será solucionada através de negociação entre as Partes, por via diplomática.

Artigo XV

Entrada em vigor

O presente Acordo entrará em vigor no 30.º (trigésimo) dia após a receção da última das notificações escritas, por via diplomática, informando que foram cumpridos todos os procedimentos internos necessários para esse efeito.

Artigo XVI

Revisão

1 - As Partes podem rever o presente Acordo com base no consentimento mútuo, por escrito.

2 - As emendas entrarão em vigor nos termos previstos no artigo XV do presente Acordo.

Artigo XVII

Vigência e denúncia

1 - O presente Acordo permanecerá em vigor por um período de 5 (cinco) anos, renovável automaticamente por períodos sucessivos de um ano.

2 - Qualquer uma das Partes pode, em qualquer momento, denunciar o presente Acordo, mediante notificação prévia, por escrito, por via diplomática.

3 - O presente Acordo cessa a sua vigência 90 (noventa) dias após a data de receção dessa notificação.

4 - Não obstante a denúncia, toda a Informação Classificada transmitida ao abrigo do presente Acordo continuará a ser protegida em conformidade com as disposições do mesmo, até que a Parte transmissora dispense a Parte destinatária dessa obrigação.

Artigo XVIII

Registo

A Parte em cujo território o presente Acordo for assinado submetê-lo-á para registo junto do Secretariado das Nações Unidas, nos termos do artigo 102.º da Carta das Nações Unidas, devendo, igualmente, notificar a outra Parte da conclusão deste procedimento e indicar-lhe o número de registo atribuído.

Em fé do que, os signatários, devidamente autorizados para o efeito, assinam o presente Acordo.

Feito em Lisboa aos 3 de março de 2015 dois originais, cada um nas línguas portuguesa, turca e inglesa, fazendo todos os textos igualmente fé. Em caso de divergência de interpretação, o texto na língua inglesa prevalecerá.

AGREEMENT BETWEEN THE GOVERNMENT OF THE PORTUGUESE REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF TURKEY ON MUTUAL PROTECTION OF CLASSIFIED INFORMATION.

The Government of the Portuguese Republic and the Government of the Republic of Turkey (hereinafter referred to individually as «Party» and collectively as «Parties»),

Recognising the need to guarantee the protection of Classified Information exchanged between them, their individuals or legal entities, under co-operation conventions, arrangements or contracts concluded or to be concluded;

Desiring to create a set of rules on mutual protection of Classified Information exchanged between the Parties;

Confirming that this Agreement shall not affect the commitments arising from other international agreements to which both their States are party and shall not be used against the interests, security and territorial integrity of other States,

Have agreed as follows:

Article I

Purpose and Scope

The purpose and scope of this Agreement is to establish the procedures and principles for ensuring security of Classified Information and Materials exchanged or generated in the co-operation activities carried out between the Parties.

Article II

Definitions

For the purposes of the present Agreement:

a) «Classified Information» means the information of any form, nature and means of transmission, which, in accordance with the Law in force in the State of either Party, requires protection against unauthorised disclosure, misappropriation or loss, and has been designated as such;

b) «Classified Contract» means an arrangement that contains or provides for access to Classified Information, creating and defining enforceable rights and obligations;

c) «Originating Party» means the Party, including its individuals or legal entities, that release Classified Information to the other Party;

d) «Receiving Party» means the Party, including its individuals or legal entities, which receive Classified Information from the Originating Party;

e) «Third Party» means any international organization or State that is not a party to the present Agreement;

f) «Classified Project» means all kinds of works within the scope of the Classified Contract;

g) «Facility Security Certificate» means the official document certifying that the protective measures projected is commensurate with the required security classification by considering the location of the facility, environmental conditions and the possible external and internal threats to be posed so as to ensure the physical security requirements for the Classified Information;

h) «Personnel Security Certificate» means the official document certifying that the person can be able to have access to the Classified Information or the Classified Project within the framework of Need-to-Know Principle or making it possible to give entrance permission to classified area where they are maintained or conducted;

i) «Need-to-Know Principle» means the principle according to which positive determination is made that a prospective recipient as had requirement for access to, knowledge of, or possession of information in order to perform official tasks or services;

j) «Organisation» means the government entities or private companies, irrespective of the type of proprietorship, where the Classified Information has been existing or where the Classified Project is carried out or which involve the implementation of the Classified Contracts.

Article III

Competent Security Authority

This Agreement shall be implemented by the following Competent Security Authorities:

For the Government of the Republic of Turkey:(ver documento original).

For the Government of the Portuguese Republic: Autoridade Nacional de Segurança, Presidência do Conselho de Ministros, Rua da Junqueira, 69, 1300-342 Lisboa, Portugal.

Article IV

Security Classification Levels

1 - Within the framework of the security measures prescribed by the respective national legislation, the Competent Security Authority of the Parties and the Organisations in its State commit to duly ensure the protection of the Classified Information and the Classified Project, exchanged between themselves or generated by mutual co-operation, and adopt the equivalence of levels of classification as shown in the table below, in Turkish, Portuguese and English:

2 - The Competent Security Authority of each Party and the Organisations in its State commit to mark the Classified Information they receive from the Competent Security Authority of the other Party or the Organisations in its State with its own level of national security classification and English equivalent in the table, in accordance with the security classification levels displayed in the above table.

3 - The Competent Security Authority of the Parties commit to mutually inform each other about the changes made in the security classification levels.

Article V

Changes or Cancellation of Security Classification Levels

1 - The security classification level given to the Classified Information or the Classified Project can be increased, decreased or cancelled by the Originating Party which has classified them. Such a decision of change or cancellation shall immediately be notified by the Originating Party to the Receiving Party which shall enforce the decision of change or cancellation.

2 - The security classification level to be given to the information or project mutually generated in the process of co-operation between the Competent Security Authority of the Parties and/or the Organisations in its State shall be determined by mutual consent of the Competent Security Authority of the Parties and/or the Organisations in its State. In case of disagreement over the security classification level to be given to such information or project, the level proposed by one of the Competent Security Authority of the Parties and/or the Organisations in its State and higher than the other shall be adopted.

3 - The security classification level given to the information or the project mutually generated in the process of co-operation shall be changed or cancelled by mutual consent of the Competent Security Authority of the Parties and/or the Organisations in its State.

Article VI

Transmission of Classified Information

1 - Classified Information shall be transmitted between the Parties, in accordance with the Law in force of the Originating Party, normally through diplomatic channels, or as otherwise arranged between the competent security authorities.

2 - The competent security authority of the Receiving Party shall confirm, in writing, the receipt of the Classified Information.

Article VII

Translation, Reproduction and Destruction of the Classified Information

1 - Information marked with the security classification level of «(ver documento original)»/ «MUITO SECRETO»/«SECRETO»/«TOP SECRET»/«SECRET» shall be able to be translated or duplicated only by prior written consent of the Competent Security Authority of the Originating Party.

2 - Translation of any classified information shall be made by persons who have the Personnel Security Certificate at appropriate level. All translations shall involve an appropriate security classification marking and annotations indicating that the classified document is received from the Originating Party. Documents translated accordingly shall be subject to the same control and protection with the original text.

3 - When the Classified Information is reproduced, all original security markings thereon shall be placed on each copy, as well. Such reproduced information shall be subject to the same control and protection given to original information. The number of copies shall be limited to the extent required for official purposes.

4 - The Classified Information shall be destroyed or changed in a way to prevent re-gathering of the parts either partially or totally. However when its term or the purpose of usage is ended, information marked with the security classification level of «(ver documento original)»/«MUITO SECRETO»/«TOP SECRET» shall be returned by the Receiving Party to the Originating Party instead of being destroyed, unless otherwise decided by the Competent Security Authority of the Parties with mutual understanding.

Article VIII

Usage of the Classified Information or the Classified Project

1 - The Classified Information exchanged and/or generated by mutual co-operation between the Competent Security Authority of the Parties and/or the Organisations in its State, shall be only used in line with the purpose of transfer.

2 - «Know-how» and other intellectual property rights concerning the Classified Information or the Classified Project shall be respected reciprocally. Other aspects thereof shall be specified in detail in the Classified Contracts or project security instructions/security annex to be made separately for each Classified Project within the framework of this Agreement.

3 - The Classified Information or the Classified Project shall not be disclosed to a Third Party without prior written consent of the Competent Security Authority of the Originating Party.

4 - The Classified Information or the Classified Project may be disclosed only to persons who are duly authorised and who have obtained the appropriate Personnel Security Certificate from their Competent Security Authority stated in the Article III of this Agreement in conformity with the Need-to-Know Principle.

Article IX

Protection of the Classified Information or the Classified Project

1 - The Competent Security Authority of the Parties and the Organisations in its State shall take all necessary measures for the protection of the Classified Information and the Classified Project generated or transferred following the mutual co-operation and shall also ensure at least the same protection for such information as stipulated for their own Classified Information or the Classified Project with equal security classification level.

2 - Protection of information and project marked with the security classification level of «(ver documento original)»/«MUITO SECRETO»/«TOP SECRET» shall be ensured by taking additional security measures to be defined in project security instructions/security annex that shall be prepared for each project, separately.

3 - In case the Classified Information or the Classified Project exchanged or generated within the scope of co-operation, is delivered to private companies or kept in the facilities of these companies, the Facility Security Certificate with the appropriate level as issued by the Competent Security Authority in the State of these companies should be required, and such information shall be given in conformity with the Need-to-Know Principle.

4 - Private companies shall fulfil the other obligations in this Agreement.

5 - The obligations of the Competent Security Authority of the Parties and the Organisations in its State for protection of the Classified Information and the Classified Project and the prevention of their disclosure shall continue to apply even after termination of this Agreement.

Article X

Project Security Instruction/Security Annex to Classified Contract

1 - Project security instruction/security annex covering the measures to be taken for ensuring the security within the project shall be prepared as an annex to the Classified Contract to be signed for each project defined with security classification level higher than «(ver documento original)»/«RESERVADO»/«RESTRICTED» to be carried out within the scope of co-operation between the Competent Security Authority of the Parties and/or the Organisations in its State.

2 - The project security instructions/security annex shall contain at least the following aspects:

a) Organisations to be involved in the project and their responsibilities and obligations within the scope of project;

b) Security classification definitions if applicable;

c) The security measures to be taken for protection of the Classified Information and the Classified Project;

d) The procedures for transferring, using and/or delivering the Classified Information;

e) The contractor obligations to disclose the Classified Information to a person who has been previously security cleared for access with regard to the relevant contract activities, who has «need-to-know» and who is employed or engaged in the carrying out of the contract.

Article XI

Security Violation

1 - In case of a security violation, the Competent Security Authority in whose State a security violation occurred shall inform the Competent Security Authority of the other Party as soon as possible, take all necessary measures and shall carry out the appropriate investigation. The other Party shall, if required, co-operate in the investigation.

2 - In the event of violation of the rules laid down for ensuring the security of the Classified Information or the Classified Project, due to intentional or negligent acts of the Competent Security Authority of any Party and/or the Organisations in its State, a Bilateral Discussion Group shall be established for determination of damages and losses to be incurred due to negligence, considering reciprocity principles between the Parties.

3 - Any loss or damage to be incurred due to violation of security rules shall be determined by the Bilateral Discussion Group considering the national legislation of the States of both Parties.

4 - Such loss and damage shall be ensured to be compensated based on a decision of the competent authorities of the Parties.

Article XII

Visits

1 - The visits to the facilities of the Organisations in the State of each Party within the scope of co-operation activities between the Competent Security Authority of the Parties and/or the Organisations in its State shall be made upon receiving the written authorisation of the Competent Security Authority of Party of the Host State.

2 - Visits that are not requiring access to the Classified Information or the Classified Project or to the areas where they are being kept or processed or carried out shall be made in compliance with the national legislation of the Host State.

3 - Visits that are requiring access to the Classified Information or the Classified Project or to the areas where they are being kept or processed or carried out shall only be made upon receiving the prior written authorisation of the Competent Security Authority of the Party of the Host State for the persons who have the Personnel Security Certificate at the appropriate security classification level.

4 - Visits that are requiring access by the individuals of a Third Party to the Classified Information or the Classified Project shall only be made upon mutual consent, in writing, of the Competent Security Authority of the Parties.

5 - The requests for visits shall be notified to the Competent Security Authority of the Party of the Host State, in writing, at least 21 (twenty-one) days prior to the proposed date of visit.

6 - The form of request for visit shall be prepared for each visit to include the following information below:

a) The Guest Personnel's name and surname, date and place of birth, nationality, passport number and position;

b) The proposed date and anticipated length of visit;

c) The level of the Personnel Security Certificate and type of information, document, material or project to be accessed as well as the security classification level if the Guest Personnel shall access to the Classified Information or the Classified Project;

d) The names of the facilities, premises and places to be visited and the purpose of visit;

e) The names, surnames and official titles of the persons who will receive the Guest Personnel;

f) The date of request, signature and official stamp of the Competent Security Authority of the Party sending the Guest Personnel.

7 - The Competent Security Authority of the Parties may agree to establish lists of authorised persons to make recurring visits. Those lists are valid for an initial period of twelve months. Once those lists have been approved by the Competent Security Authority of the Parties, the terms of the specific visits shall be directly arranged with the appropriate authorities of the organizations to be visited by those persons, in accordance with the terms and conditions agreed upon. The Competent Security Authority should be informed after conducting the visits.

8 - In case of death, illness or injury of the Guest Personnel during the visits made to the facilities of the Organisations of any Party in its State the Organisation receiving the Guest Personnel shall immediately inform the Organisation sending the Guest Personnel about the case and transport the body of the Guest Personnel to the nearest international airport within its State territory and apply all appropriate transport measures, including sanitary protection.

Article XIII

Financial Matters

Each Party shall bear its own expenses incurred in connection with the application of the present Agreement.

Article XIV

Settlement of Disputes

Any dispute regarding the interpretation or application of this Agreement shall be settled by negotiation between the Parties, through diplomatic channels.

Article XV

Entry into Force

This Agreement shall enter into force on the 30(th) (thirtieth) day following the receipt of the last of the written notifications through diplomatic channels, stating that all the internal procedures necessary to that effect have been fulfilled.

Article XVI

Amendment

1 - The Parties may amend this Agreement on the basis of mutual written consent.

2 - The amendments shall enter into force according to the terms specified in article XV of the present Agreement.

Article XVII

Duration and Termination

1 - This Agreement shall remain in force for a period of 5 (five) years automatically renewable for successive periods of one year.

2 - Either Party may, at any time, terminate this Agreement upon a prior notification in writing through diplomatic channels.

3 - This Agreement shall terminate 90 (ninety) days after receipt of such notification.

4 - Notwithstanding the termination, all Classified Information released under this Agreement shall continue to be protected according to the provisions set forth herein, until the Originating Party dispenses the Receiving Party from this obligation.

Article XVIII

Registration

Upon the entry into force of the present Agreement, the Party in whose territory it is signed shall transmit it for registration to the Secretariat of the United Nations, according to Article 102 of the Charter of the United Nations, and shall notify the other Party of the conclusion of this proceeding, indicating the respective registration number.

In witness whereof, the undersigned duly authorized, have signed the present Agreement.

Done at Lisbon, on the 3(rd) of March of 2015 in two originals, each one in the Portuguese, Turkish, and English languages, each text being equally authentic. In case of any divergence of interpretation the English text shall prevail.
