TORNA PÚBLICO QUE O CONSELHO DE SEGURANÇA DAS NAÇÕES UNIDAS ADOPTOU NO DIA 21 DE ABRIL DE 1995 A RESOLUÇÃO NUMERO 988 RELATIVA AS SANÇÕES DECRETADAS A EX-JUGOSLAVIA, CUJO TEXTO EM INGLÊS E RESPECTIVA TRADUÇÃO EM PORTUGUÊS SAO PUBLICADAS EM ANEXO.

Por ordem superior se torna público que o Conselho de Segurança das Nações Unidas adoptou, no dia 21 de Abril de 1995, a Resolução 988, cuja versão inglesa e a respectiva tradução seguem em anexo.

Resolution 988 (95)
(Czech Republic, France, Germany, Italy, United Kingdom of Great Britain and Northern Ireland and United States of America)

The Security Council:
Recalling all its earlier relevant resolutions, and in particular Resolution 943 (1994) of 23 September 1994 and Resolution 970 (1995) of 12 January 1995;

Noting the measures taken by the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro), as described in the annex to the Secretary-General's letter of 31 March 1995 (S/1995/255) and in the annex to the closure of the international border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina with respect to all goods except foodstuffs, medical supplies and clothing for essential humanitarian needs, and noting that those measures were a necessary condition for the adoption of the present resolution;

Concerned, however, about reports suggesting that helicopter flights may have crossed the border between the Republic of Bosnia and Herzegovina and the Federal Republic of Yugoslavia (Serbia and Montenegro), and noting that an investigation of those reports is being undertaken by the Mission of the International Conference on the Former Yugoslavia (ICFY);

Noting with satisfaction that the cooperation of the ICFY Mission with the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) continues to be good and stressing the importance of effective closure by the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) of the international border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina, and of further efforts by them to enhance the effectiveness of that closure, including by the prosecution of persons suspected of violating measures to that end and by sealing border crossing points as requested by the ICFY Mission;

Expressing appreciation for the work of the Co-Chairmen of the Steering Committee of the ICFY and of the ICFY Mission to the Federal Republic of Yugoslavia (Serbia and Montenegro);

Noting that paragraph 9 of Resolution 757 (1992) of 30 May 1992 remains in force;

Acting under chapter VII of the Charter of the United Nations:
1 - Decides that the restrictions and other measures referred to in paragraph 1 of Resolution 943 (1994) shall be suspended until 5 July 1995.

2 - Confirms that commodities and products, including fuel beyond immediate needs for a flight or ferry voyage taking into account internationally recognized safety requirements, shall not be carried on flights and ferry services permitted in accordance with paragraph 1 above, except in accordance with the provisions of relevant resolutions and in conformity with the procedures of the Committee established by Resolution 724 (1991) of 15 December 1991, and that if a need is established for the supply of additional fuel for the operation of flights permitted in accordance with paragraph 1 above, the Comittee established by Resolution 724 (1991) shall consider such applications on a case-by-case basis.

3 - Reminds States of the importance of strict enforcement of measures imposed under chapter VII of the Charter and calls upon all States which allow flights or ferry services permitted in accordance with paragraph 1 above from their territories or using their flag vessels or aircraft to report to the Committee established by Resolution 724 (1991) on the controls adopted by them to implement such measures in earlier relevant resolutions.

4 - Calls upon all States and other concerned to respect the sovereignty, territorial integrity and international borders of all States in the region.

5 - Underlines the importance it attaches to the work of the ICFY Mission, express its concern that a shortage of resources hampers the effectiveness of that work, and requests the Secretary-General to report to the Security Council within 30 days of the adoption of the present resolution on measures to increase the effectiveness of the work of the ICFY Mission, including on the question of helicopter flights.

6 - Requests Member States to make available the necessary resources so as to strengthen the ICFY Mission's capacity to carry out its tasks, and encourages the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) to give additional support for the operation of the ICFY Mission.

7 - Calls on the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) to cooperate fully with the ICFY Mission, in particular in investigating alleged breaches of the closure of the border, whether by land or by air, between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina and ensuring the continued closure of that border.

8 - Stresses the importance it attaches to a thorough investigation of reports that helicopter flights may have crossed the border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina, calls upon the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) to comply with their commitment to cooperate fully in that investigation, and requests the Secretary-General to report to the Security Council on the outcome of the investigation.

9 - Reaffirms its decision that import to, export from and transshipment through the United Nations protected areas in the Republic of Croatia and those areas of the Republic of Bosnia and Herzegovina under the control of Bosnian Serb forces, with the exception of essential humanitarian supplies including medical suppllies and foodstuffs distributed by international humanitarian agencies, shall be permitted only with proper authorization from the Government of the Republic of Croatia or the Government of the Republic of Bosnia and Herzegovina respectively.

10 - Encourages the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) to reinstate the severance of international telecommunication links between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the areas of the Republic of Bosnia and Herzegovina under the control of Bosnian Serb forces which they instituted in August 1994.

11 - Requests the Comittee established by Resolution 724 (1991) to conclude urgently its elaboration of appropriate streamlined procedures and invites the Chairman of that Committee to report to the Security Council as soon as possible on the matter.

12 - Also requests the Committee established by Resolution 724 (1991) to continue to give priority to its consideration of applications concerning legitimate humanitarian assistance, in particular applications from the International Committee of the Red Cross and from the United Nations High Commissioner for Refugees and other organizations in the United Nations system.

13 - Requests that every 30 days and no fewer than 10 days before the expiration of the period referred to in paragraph 1 above the Secretary-General submit to the Security Council for its review a report as to whether the Co-Chairmen of the ICFY Steering Committee, on the basis of information made available to them from the ICFY Mission and all other available sources deemed relevant by the ICFY Mission, certify that the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) are implementing their decision to close the international border, on land and in the air, between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina with respect to all goods, except foodstuffs, medical supplies and clothing for essential humanitarian needs, and are complying with the requirements of paragraph 3 of Resolution 970 (1995) in respect of all shipments across the international border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina, and inform the Council in his report if the Co-Chairmen of the ICFY Steering Committee have received substantiated evidence, from sources deemed relevant by the ICFY Mission, of substantial transshipments of goods, except foodstuffs, medical supplies and clothing for essential humanitarian needs, from the Federal Republic of Yugoslavia (Serbia and Montenegro) through the Republic of Croatia to the areas of the Republic of Bosnia and Herzegovina under the control of Bosnian Serb forces in violation of earlier relevant resolutions.

14 - Further requests the Secretary-General to report to the Security Council immediately if he has evidence, including from the Co-Chairmen of the ICFY Steering Committee, that the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) are not implementing their decision to close the border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina.

15 - Decides that if at any time the Secretary-General reports that, from sources deemed relevant by the ICFY Mission, the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) are not implementing their decision to close the border between the Federal Republic of Yugoslavia (Serbia and Montenegro) and the Republic of Bosnia and Herzegovina or that they are permitting substantial diversion of goods, except foodstuffs, medical supplies and clothing for essential humanitarian needs from the Federal Republic of Yugoslavia (Serbia and Montenegro) through the Republic of Croatia to the areas of the Republic of Bosnia and Herzegovina under the control of Bosnia Serb forces in violation of earlier relevant resolutions, the suspension of the measures referred to in paragraph 1 above shall terminate on the fifth working day folowing the report of the Secretary-General, unless the Security Council decides to the contrary.

16 - Encourages the Co-Chairmen of the ICFY Steering Committee to ensure that the ICFY Mission keep the Government of the Republic of Bosnia and Herzegovina, the Government of the Republic of Croatia and the authorities of the Federal Republic of Yugoslavia (Serbia and Montenegro) fully informed about the findings of the ICFY Mission.

17 - Decides to keep the situation closely under review and to consider further steps with regard to measures applicable to the Federal Republic of Yugoslavia (Serbia and Montenegro) in the light of further progess in the situation.

18 - Decides to remain actively seized of the matter.

O Conselho de Segurança:
Relembrando todas as suas anteriores resoluções relevantes, e em particular a Resolução 943 (1994), de 23 de Setembro de 1994, e a Resolução 970 (1995), de 12 de Janeiro de 1995;

Atendendo às medidas tomadas pelas autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro), como descritas no anexo à carta de 31 de Março de 1995 (S/1995/255) do Secretário-Geral e no anexo à carta de 13 de Abril de 1995 (S/1995/302) do Secretário-Geral, com o objectivo de manter a fronteira internacional entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina fechada à entrada de quaisquer bens, exceptuando géneros alimentícios, auxílio médico e vestuário para necessidades humanitárias essenciais, e atendendo a que essas medidas eram uma condição necessária para a adopção da presente resolução;

Preocupado, todavia, com os relatórios sugerindo que helicópteros poderão ter atravessado a fronteira entre a República da Bósnia-Herzegovina e a República Federativa da Jugoslávia (Sérvia e Montenegro) e atendendo a que está a ser levada a cabo uma investigação desses relatórios pela Missão da Conferência Internacional para a ex-Jugoslávia (ICFY);

Observando com satisfação que a cooperação da Missão da ICFY com as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) continua a ser favorável e salientando a importância do eficaz encerramento pelas autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) da fronteira internacional entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina, bem como os continuados esforços das autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) para intensificar a eficácia desse encerramento, incluindo a instauração de processos contra pessoas suspeitas de violar medidas com esse fim e vedando pontos de passagem fronteiriços como solicitado pela Missão da ICFY;

Expressando agrado pelo trabalho dos co-presidentes do Comité Executivo da ICFY e da Missão da ICFY para a República Federativa da Jugoslávia (Sérvia e Montenegro);

Atendendo a que o parágrafo 9 da Resolução 757 (1992), de 30 de Maio de 1992, se mantém em vigor;

Agindo de acordo com o capítulo VII da Carta das Nações Unidas:
1 - Decide que as restrições e outras medidas contidas no parágrafo 1 da Resolução 943 (1994) serão suspensas até 5 de Julho de 1995.

2 - Confirma que as mercadorias e produtos, incluindo combustível que não satisfaça as necessidades imediatas de operações aéreas ou marítimas, tomando em consideração as medidas de segurança internacionalmente reconhecidas, não serão transportados em serviços aéreos ou marítimos autorizados em conformidade com o parágrafo 1 acima, excepto em conformidade com as cláusulas de resoluções relevantes e de acordo com as normas do Comité criado pela Resolução 724 (1991), de 15 de Dezembro de 1991, e que, caso se venha a verificar a necessidade de fornecer combustível adicional para operações aéreas autorizadas em conformidade com o parágrafo 1 acima, o Comité criado pela Resolução 724 (1991) estudará tais aplicações caso a caso.

3 - Relembra os Estados da importância de uma aplicação rigorosa das medidas impostas no capítulo VII da Carta e apela aos Estados que permitem operações aéreas e marítimas autorizadas em conformidade com o parágrafo 1 acima dos seus territórios ou utilizando embarcações ou aeronaves registadas nos respectivos países que informem o Comité criado pela Resolução 724 (1991) sobre a supervisão por eles adoptada a fim de implementar tais medidas estabelecidas em anteriores resoluções relevantes.

4 - Apela a todos os Estados e outros interessados que respeitem a soberania, a integridade territorial e as fronteiras internacionais de todos os Estados na região.

5 - Sublinha a importância que dá ao trabalho da Missão da ICFY, exprime a sua preocupação na falta de recursos que possa vir a dificultar a execução eficaz desse trabalho e solicita ao Secretário-Geral que informe o Conselho de Segurança num prazo de 30 dias após a adopção da presente resolução sobre as medidas tomadas no sentido de aumentar a eficácia do trabalho da Missão da ICFY, incluindo as questões relacionadas com voos de helicópteros.

6 - Solicita aos Estados membros que disponibilizem os recursos necessários de forma a reforçar a capacidade da Missão da ICFY para levar a cabo as suas tarefas e encoraja as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) a dar apoio adicional às operações da Missão da ICFY.

7 - Apela às autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) que cooperem plenamente na Missão da ICFY, particularmente na investigação de supostas violações do encerramento da fronteira, quer por via terrestre quer por via aérea, entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina, e que assegurem o continuado encerramento dessa fronteira.

8 - Sublinha a importância que dá a uma investigação aprofundada sobre informações de voos de helicópteros que possam ter atravessado a fronteira entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina, apela às autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) que respeitem os seus compromissos de total cooperação nessa investigação e solicita ao Secretário-Geral que informe o Conselho de Segurança sobre os resultados dessa investigação.

9 - Reitera a sua decisão que a importação, a exportação e o trânsito, com destino, proveniente ou através das zonas protegidas pelas Nações Unidas na República da Croácia e nas áreas da República da Bósnia-Herzegovina controladas pelas forças sérvias da Bósnia, exceptuando fornecimentos de bens humanitários essenciais, incluindo auxílio médico e géneros alimentícios distribuídos pelos organismos internacionais de assistência humanitária, serão apenas permitidos com a devida autorização do Governo da República da Croácia e do Governo da República da Bósnia-Herzegovina, respectivamente.

10 - Encoraja as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) a restabelecer a interrupção dos meios de telecomunicação internacional entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a área da República da Bósnia-Herzegovina controlada pelas forças sérvias da Bósnia e que por elas foi instituída em Agosto de 1994.

11 - Solicita ao Comité criado pela Resolução 724 (1991) para concluir com a maior urgência a elaboração de normas eficientes e adequadas e convida o presidente desse Comité a informar o mais rapidamente possível o Conselho de Segurança sobre essa matéria.

12 - Solicita igualmente ao Comité criado pela Resolução 724 (1991) para continuar a dar prioridade ao seu estudo de aplicações relacionadas com a assistência humanitária legítima, em particular as aplicações da Comissão Internacional da Cruz Vermelha e do Alto-Comissário para os Refugiados das Nações Unidas e outras organizações do sistema das Nações Unidas.

13 - Solicita que todos os 30 dias e não menos que 10 dias antes da expiração do prazo estabelecido no parágrafo 1 acima o Secretário-Geral submeta ao Conselho de Segurança a revisão do relatório em que os co-presidentes do Comité Executivo da ICFY, com base nas informações postas à sua disposição pela Missão da ICFY e todas as outras fontes disponíveis consideradas importantes pela Missão da ICFY, certificam que as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) estão a implementar a sua decisão de fechar a fronteira internacional, em terra e no ar, entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina relativamente a todas as mercadorias, exceptuando géneros alimentícios, auxílio médico e vestuário para necessidades humanitárias essenciais, e que estão a respeitar os requisitos do parágrafo 3 da Resolução 970 (1995) respeitantes a todos os carregamentos feitos pela fronteira internacional entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina e que informe o Conselho no seu relatório se os co-presidentes do Comité Executivo da ICFY obtiveram provas concretas, de fontes consideradas relevantes pela Missão da ICFY, de importantes carregamentos de mercadorias, exceptuando géneros alimentícios, auxílio médico e vestuário para necessidades humanitárias essenciais, da República Federativa da Jugoslávia (Sérvia e Montenegro), em trânsito na República da Croácia com destino às áreas da República da Bósnia-Herzegovina controladas pelas forças sérvias da Bósnia em violação com as anteriores resoluções relevantes.

14 - Solicita ainda ao Secretário-Geral que informe imediatamente o Conselho de Segurança caso possua provas, incluindo dos co-presidentes do Comité Executivo da ICFY, de que as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) não estão a implementar a sua decisão de fechar a fronteira entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina.

15 - Decide que se, em qualquer momento, o Secretário-Geral informar (de fontes consideradas importantes pela Missão da ICFY), que as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) não estão a implementar a sua decisão de fechar a fronteira entre a República Federativa da Jugoslávia (Sérvia e Montenegro) e a República da Bósnia-Herzegovina ou que estão a permitir o desvio de mercadorias, exceptuando géneros alimentícios, auxílio médico e vestuário para necessidades humanitárias essenciais da República Federativa da Jugoslávia (Sérvia e Montenegro) em trânsito na República da Croácia com destino às áreas da República da Bósnia-Herzegovina controladas pelas forças sérvias da Bósnia em violação com as anteriores resoluções relevantes, a suspensão das medidas estabelecidas no parágrafo 1 acima terminará no 5.º dia útil após entrega do relatório do Secretário-Geral, a menos que o Conselho de Segurança decida em contrário.

16 - Encoraja os co-presidentes do Comité Executivo da ICFY a assegurar que a Missão da ICFY mantém totalmente informados o Governo da República da Bósnia-Herzegovina, o Governo da República da Croácia e as autoridades da República Federativa da Jugoslávia (Sérvia e Montenegro) sobre os resultados da Missão da ICFY.

17 - Decide manter a situação em permanente revisão e ter em consideração novos passos no sentido de tomar medidas aplicáveis à República Federativa da Jugoslávia (Sérvia e Montenegro), tendo em conta novos desenvolvimentos.

18 - Decide manter-se ao corrente da situação.
