Decreto 46/93
de 3 de Dezembro
Nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o Governo decreta o seguinte:

Artigo único. É aprovado o Acordo Administrativo Relativo às Modalidades de Aplicação da Convenção sobre Segurança Social entre o Governo da República Portuguesa e o Governo da Austrália, assinado em Camberra em 10 de Agosto de 1992, cujo texto original nas línguas portuguesa e inglesa segue em anexo ao presente decreto.

ACORDO ADMINISTRATIVO RELATIVO ÀS MODALIDADES DE APLICAÇÃO DA CONVENÇÃO SOBRE SEGURANÇA SOCIAL ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E O GOVERNO DA AUSTRÁLIA.

Em conformidade com o artigo 23.º da Convenção sobre Segurança Social entre o Governo da República Portuguesa e o Governo da Austrália, assinada em 30 de Abril de 1991, as autoridades competentes portuguesas e australianas estabelecem o Acordo Administrativo para aplicação daquela Convenção, com as disposições seguintes:

PARTE I
Disposições gerais
Artigo 1.º
Definições
No presente Acordo:
a) «Convenção» significa a Convenção sobre Segurança Social entre o Governo da República Portuguesa e o Governo da Austrália, assinada em Lisboa em 30 de Abril de 1991;

b) «Acordo» significa o presente Acordo Administrativo; e
outros termos utilizados no presente Acordo têm o mesmo significado que na Convenção, salvo se outro significado resultar do respectivo contexto.

Artigo 2.º
Instituições competentes em relação a Portugal
Em relação a Portugal, por instituição competente, nos termos do artigo 1.º, alínea d), da Convenção, entendem-se as seguintes instituições:

a) Para as pensões de velhice, invalidez e sobrevivência e subsídio por morte dos regimes geral e especiais - Centro Nacional de Pensões, Campo Grande, 6, 1771 Lisboa Codex;

b) Para as prestações de doença e maternidade, abonos de família e prestações do seguro social voluntário:

No continente - o centro regional de segurança social que abrange o interessado;

Na Região Autónoma dos Açores - a Direcção Regional de Segurança Social, Angra do Heroísmo; e

Na Região Autónoma da Madeira - a Direcção Regional de Segurança Social, Funchal;

c) Para as prestações de desemprego:
No continente - o centro regional de segurança social que abrange o interessado;

Na Região Autónoma dos Açores - o centro de prestações pecuniárias de segurança social que abrange o interessado;

Na Região Autónoma da Madeira - a Direcção Regional de Segurança Social, Funchal;

d) Para as pensões do regime não contributivo:
No continente - o centro regional de segurança social da área de residência do interessado;

Na Região Autónoma dos Açores - a Direcção Regional de Segurança Social, Angra do Heroísmo;

Na Região Autónoma da Madeira - a Direcção Regional de Segurança Social, Funchal; e

e) Para as pensões por acidente de trabalho e doenças profissionais - a Caixa Nacional de Seguros de Doenças Profissionais, Avenida da República, 25, 3.º, esquerdo, 1093 Lisboa Codex.

Artigo 3.º
Organismos de ligação
1 - Para efeitos da aplicação da Convenção e do presente Acordo, são organismos de ligação:

Para Portugal, o Departamento de Relações Internacionais e Convenções de Segurança Social, Rua da Junqueira, 112, 1399 Lisboa Codex; e

Para a Austrália, o International Operations Branch, Department of Social Security, PO Box 624F, Hobart, Tasmânia 7001.

2 - Os organismos de ligação garantem a aplicação da Convenção e do Acordo e informam os interessados sobre os seus direitos e obrigações ao abrigo da Convenção.

3 - Os organismos de ligação trocam as informações necessárias para efeitos da aplicação da Convenção e do Acordo.

4 - O Departamento de Relações Internacionais e Convenções de Segurança Social e o International Branch of the Department of Social Security elaboram inicialmente os formulários e demais documentos necessários para a aplicação da Convenção e do Acordo, cabendo aos organismos de ligação proceder à revisão e actualização desses formulários e documentos com vista a assegurar aquela aplicação.

PARTE II
Determinação da legislação aplicável
Artigo 4.º
Certificado relativo à legislação aplicável
Para efeitos da aplicação da legislação portuguesa nos termos do artigo 8.º da Convenção, a instituição competente emite um certificado relativo à legislação aplicável declarando que o interessado continua sujeito à legislação portuguesa e indicando o período de validade do mesmo.

PARTE III
Aplicação das disposições relativas às prestações e instrução dos requerimentos

Artigo 5.º
Apresentação do requerimento
1 - Uma pessoa que esteja no território de uma Parte pode apresentar um requerimento de prestações previstas na legislação da outra Parte, bem como os respectivos documentos, na instituição da Parte em cujo território se encontra fisicamente presente.

2 - A instituição de uma Parte aceita, em nome da instituição competente da outra Parte, o requerimento de prestações apresentado ao abrigo de acordos que esta Parte tenha com terceiros países.

Artigo 6.º
Instrução do requerimento
1 - A instituição de uma Parte ao receber um requerimento:
a) Carimba-o na data da recepção, verifica a identidade do requerente, valida os elementos identificativos contidos no requerimento com base na documentação apresentada e, se necessário, certifica as cópias dos documentos originais de apoio ao requerimento;

b) Preenche um formulário de ligação em que se discriminam os períodos de residência na Austrália ou os períodos de seguro português;

c) Promove a elaboração de um relatório médico, nos termos do disposto no artigo 8.º, se o direito a uma prestação depender de invalidez, incapacidade para o trabalho ou cegueira;

d) Informa o requerente de que é exigido um relatório médico, em formulário próprio, elaborado pelo médico assistente do seu cônjuge, no caso de se tratar de um requerimento de uma pensão australiana por assistência permanente;

e) Se se tratar de Portugal, envia, logo que possível, ao organismo de ligação australiano o formulário de requerimento, o original ou cópias certificadas dos documentos necessários à sua formalização e o formulário de ligação, e se se tratar da Austrália, envia logo que possível à instituição competente portuguesa o formulário de requerimento, o original ou cópias certificadas dos documentos necessários à sua formalização e o formulário de ligação.

2 - O formulário para o relatório médico referido no n.º 1, alínea d), é o estabelecido e actualizado para esse efeito.

Artigo 7.º
Decisão sobre um requerimento de prestações
1 - Quando a instituição competente de uma Parte emitir uma decisão sobre um requerimento de prestações por aplicação da Convenção:

Em relação a Portugal, a referida instituição informará o organismo de ligação australiano daquela decisão por meio do formulário de ligação; e

Em relação à Austrália, o respectivo organismo de ligação informará a instituição competente portuguesa daquela decisão por meio do formulário de ligação.

2 - Quando uma Parte remeter um requerimento à outra Parte informa-a, no formulário de ligação, se tenciona solicitar o pagamento de uma dívida sobre os retroactivos de uma prestação a conceder pela instituição competente da outra Parte, nos termos do artigo 20.º da Convenção. Caso tal pedido tenha sido formulado, a outra Parte, aquando da atribuição da prestação, informa a primeira Parte sobre as condições desta atribuição e não efectuará o pagamento dos retroactivos ao interessado durante um período de três meses a contar da data da informação à primeira Parte, salvo se antes de decorrido tal período esta Parte solicitar o pagamento daquela dívida sobre os retroactivos, nos termos do artigo 20.º da Convenção. Se este pedido for feito, a outra Parte procederá em conformidade com o referido artigo 20.º

Artigo 8.º
Exames médicos
1 - Sem prejuízo do disposto no n.º 4, o exame médico de uma pessoa que resida no território de uma Parte, para efeitos de prestações requeridas à outra Parte, ou por ela pagas, quer por aplicação da Convenção quer a outro título, é providenciado pela instituição competente da Parte onde o interessado reside.

2 - Os relatórios médicos elaborados em formulário próprio, em conformidade com o n.º 1, são enviados, logo que possível, à Parte que pagar a prestação ou à qual a prestação tiver sido requerida.

3 - As despesas com o exame, incluindo despesas de deslocação e alojamento, são suportadas pela Parte em cujo território o interessado reside.

4 - Para efeitos do disposto no n.º 1, quando uma Parte dispuser de um relatório médico apropriado para verificar o direito a uma prestação por aplicação da Convenção ou da legislação das Partes, e que tenha sido elaborado nos 12 meses que antecedem o último requerimento da prestação, esse relatório pode ser posto à disposição da Parte à qual este requerimento foi apresentado. Se aquele relatório for considerado insuficiente por esta Parte, será providenciado outro relatório médico, em conformidade com o disposto no n.º 1, e enviado em conformidade com o disposto no n.º 2.

5 - O formulário para o relatório médico referido no n.º 2 é o estabelecido e actualizado para esse efeito.

PARTE IV
Disposições diversas
Artigo 9.º
Assistência mútua
As instituições competentes ou os organismos de ligação de ambas as Partes podem solicitar a verificação de factos de que possa resultar a modificação, suspensão ou cessação das prestações concedidas ao abrigo da respectiva legislação.

Artigo 10.º
Recursos
1 - As instituições ou os organismos de ligação de ambas as Partes aceitam, em nome uma da outra, e carimbam na data da recepção os recursos interpostos contra decisões da instituição competente da outra Parte, bem como a documentação de apoio.

2 - A instituição ou o organismo de ligação da Parte que recebeu o recurso interposto contra uma decisão da instituição competente da outra Parte enviará esse recurso a esta Parte, em conformidade com o disposto no n.º 1, alínea e), do artigo 6.º

Artigo 11.º
Contactos com os interessados
1 - Sem prejuízo do disposto na Convenção, a instituição competente responsável pelo pagamento de uma prestação nos termos da mesma Convenção pagará essa prestação directamente ao beneficiário.

2 - A instituição competente de uma Parte pode dirigir-se directamente às pessoas residentes no território da outra Parte para solicitar ou comunicar quaisquer informações relativas à instrução ou ao pagamento de prestações.

Artigo 12.º
Informação estatística
Os organismos de ligação das duas Partes comunicam, a pedido, as estatísticas dos pagamentos efectuados em aplicação da Convenção, incluindo elementos sobre o número de titulares de prestações e o montante pago por cada tipo de prestação.

PARTE V
Artigo 13.º
Disposições finais
O presente Acordo Administrativo entra em vigor na mesma data da Convenção e terá a mesma duração.

Assinado em Camberra em 10 de Agosto de 1992, em duplicado, em português e inglês, fazendo qualquer dos textos igualmente fé.

ADMINISTRATIVE ARRANGEMENT IMPLEMENTING THE AGREEMENT ON SOCIAL SECURITY BETWEEN THE GOVERNMENT OF AUSTRALIA AND THE GOVERNMENT OF THE REPUBLIC OF PORTUGAL.

In accordance with article 23 of the Agreement between the Government of Australia and the Government of the Republic of Portugal on Social Security made on 30 April 1991, the competent authorities of Australia and Portugal hereby make the Administrative Arrangement as set out in the following paragraphs to implement the Agreement:

PART I
General provisions
Section 1
Definitions
In this Arrangement:
a) «Agreement» means the Agreement between the Government of Australia and the Government of the Republic of Portugal signed in Lisbon on 30 April 1991;

b) «Arrangement» means this Administrative Arrangement; and
other terms used in this Arrangement have the same meaning as in the Agreement unless their context in this Arrangement otherwise requires.

Section 2
Competent institution for Portugal
In relation to Portugal, competent institution under article 1, d), of the Agreement refers to the following institutions:

a) For old age, invalid and survivors' pensions and death grants under the general and special schemes - Centro Nacional de Pensões, Campo Grande, 6, 1771 Lisboa Codex;

b) For sickness and maternity benefits, family allowances and benefits under the voluntary social insurance scheme:

On the continent - the centro regional de segurança social where the person is insured;

In the Autonomous Region of the Azores - the Direcção Regional de Segurança Social, Angra do Heroísmo; and

In the Autonomous Region of Madeira - the Direcção Regional de Segurança Social, Funchal;

c) For unemployment benefits:
On the continent - the centro regional de segurança social where the person is insured;

In the Autonomous Region of the Azores - the centro de prestações pecuniárias de segurança social where the person is insured; and

In the Autonomous Region of Madeira - the Direcção Regional de Segurança Social, Funchal;

d) For pensions of the non-contributory scheme:
On the continent - the centro regional de segurança social where the person resides;

In the Autonomous Region of the Azores - the Direcção Regional de Segurança Social, Angra do Heroísmo; and

In the Autonomous Region of Madeira - the Direcção Regional de Segurança Social, Funchal; and

e) For pensions for work injury and occupational diseases: Caixa Nacional de Seguros de Doenças Profissionais, Avenida da República, 25, 3.º, esquerdo, 1093 Lisboa Codex.

Section 3
Liaison agencies
1 - For the purpose of applying the Agreement and this Arrangement, the liaison agencies are:

For Australia - the International Operations Branch, Department of Social Security, PO Box 624F, Hobart, Tasmania 7001; and

For Portugal - the Departamento de Relações Internacionais e Convenções de Segurança Social, Rua da Junqueira, 112, 1399 Lisboa Codex.

2 - The liaison agencies will ensure the Agreement and the Arrangement are applied and will advise people of their entitlements and obligations under the Agreement.

3 - The liaison agencies will exchange all information necessary to apply the Agreement and the Arrangement.

4 - The International Branch of the Department of Social Security and the Departamento de Relações Internacionais e Convenções de Segurança Social initially will prepare forms and documents to implement the Agreement and the Arrangement and the liaison agencies will review and revise those forms and documents for their ongoing implementation.

PART II
Application of applicable legislation
Section 4
Certificate of coverage
When Portugal applies its legislation under article 8 of the Agreement, its competent institution will issue a certificate of coverage to the person concerned, affirming that the person continues to be subject to the legislation of Portugal and stating the period for which the certificate is valid.

PART III
Application of benefit provisions and claim processing
Section 5
Claim lodgment
1 - Persons in the territory of one Party may lodge claims and associated documentation for the other Party's benefits with the Institution of the Party in the territory of which they are physically present.

2 - The Institution of one Party will accept on behalf of the Competent Institution of the other, claims for benefits under agreements which tat other Party has with third Parties.

Section 6
Claim processing
1 - The Institution of a Party receiving a claim will:
a) Stamp it with the date of receipt, verify the claimant's identity, validate the personal details contained in the claim on the basis of supporting documentation supplied and, when necessary, make certified copies of original documentation supporting the claim;

b) Complete a liaison form indicating, in particular, appropriate periods of residence in Australia or Portuguese periods of insurance;

c) If entitlement to benefit is dependant on the invalidity, incapacity for work or blindness of the claimant, arrange for a medical report to be provided in accordance with the provisions of section 8;

d) If the claim for an Australian carer's pension, advise the claimant that a medical report, in a set form, is required from the medical practitioner treating the claimant's spouse; and

e) In the case of Portugal, send, as soon as possible, the claim form, original or certified copies of documents necessary to establish the claim and the liaison form to the liaison agency for Australia, and in the case of Australia, send, as soon as possible, the claim form, original or certified copies of documents necessary to establish the claim and the liaison form to the competent institution for Portugal.

2 - The set form of the medical report in paragraph 1, d), will be the form settled for this purpose from time to time.

Section 7
Determination of benefit claims
1 - When a competent institution of one Party makes a determination of a claim for benefits by virtue of the Agreement:

In the case of Portugal, it will inform the liaison agency for Australia of that determination on a liaison form; and

In the case of Australia, its liaison agency will inform the competent institution for Portugal of that determination on a liaison form.

2 - When one Party refers a claim to the other Party the referring Party will indicate on the liaison form whether or not it intends to request payment of a debt under article 20 of the Agreement from arrears of a benefit that may be paid by the competent institution of the other Party. When such a request has been indicated, the other Party will, upon grant of a benefit, advise the referring Party of grant details and will not release arrears to the beneficiary for a period of three months from the date of its advice to the referring Party unless the referring Party requests payment of a debt from those arrears under article 20 of the Agreement before the end of that period. If a request is so made the other Party will deal with it in accordance with that article 20.

Section 8
Medical examination
1 - Subject to paragraph 4, medical examinations of persons residing in the territory of one Party in connection with benefit claimed from or paid by the other Party under the Agreement or otherwise will be arranged by the competent institution of the Party in which the persons reside.

2 - Reports, in a set form, on medical examinations arranged in accordance with paragraph 1 will be forwarded as soon as possible to the Party which pays the benefit or from which the benefit has been claimed.

3 - The costs of examinations, including associated travel and accommodation costs, will be met by the Party in whose territory the persons reside.

4 - When either Party is in possession of a medical report which constitutes an acceptable medical report on benefit eligibility for the purpose of the Agreement or the legislation of the Parties, and that report has been compiled in the twelve months prior to the most recent claim for benefit, that report may be supplied to the Party from which the most recent benefit is being claimed to satisfy the arrangements specified in paragraph 1. Should the existing report be unsuitable for the purposes of the Party from which the benefit is being claimed a further medical examination will be arranged in accordance with paragraph 1 and forwarded in accordance with paragraph 2.

5 - The set form of the medical report in paragraph 2 will be the form settled for this purpose from time to time.

PART IV
Miscellaneous provisions
Section 9
Mutual assistance
The competent institutions or liaison agencies of both Parties may request the verification of facts which may lead to the variation, suspension or termination of benefits awarded under their legislation.

Section 10
Appeals
1 - The institutions or liaison agencies of both Parties will, on behalf of each other, accept and stamp with the date of receipt appeals against determinations by the competent institution of the other Party together with any supporting documentation.

2 - The institution or liaison agency of the Party with which an appeal has been lodged against a determination made by the competent institution of the other Party will send that appeal to the other Party following the procedures for forwarding claims in section 6, 1, e).

Section 11
Client liaison
1 - The competent institution responsible for the payment of a benefit under the Agreement will pay that benefit, subject to the provisions of the Agreement, direct to the beneficiary.

2 - The competent institution of a Party may contact persons residing in the territory of the other Party about any information required for the processing or payment of benefits.

Section 12
Statistical information
The liaison agencies of the Parties will, on request from one to the other provide statistics of the payments made under the Agreement including the number of beneficiaries and the amount of benefits paid in each category of benefit.

PART V
Section 13
Final provisions
This Arrangement will take effect on the same day as the Agreement and will operate for the duration of the Agreement.

Signed in duplicate at Canberra this 10 th day of August 1992 in the English and Portuguese languages, both texts being equally authoritative.
