A República Portuguesa e a República Popular da China celebraram, por troca de Notas, assinadas em Pequim, em 10 e 24 de maio de 2016, o Acordo entre o Governo da República Portuguesa e o Governo da República Popular da China sobre a criação de um ConsuladoGeral da Re-pública Portuguesa em Cantão.
Pretende-se, assim, continuar a promover as relações amigáveis entre os dois países a aprofundar os laços bilaterais existentes entre ambos.
A abertura do novo ConsuladoGeral em Cantão, com jurisdição nas Províncias de Guangdong, Hainan, Hunan, Fujian e na Região Autónoma de Guangxi Zhuang, reveste-se pois de um enorme potencial de desenvolvimento, tanto a nível económico como cultural, para o Estado Português, naquela região asiática.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição o Governo aprova o Acordo entre o Governo da República Portuguesa e o Governo da República Popular da China sobre a criação de um ConsuladoGeral da Repú-blica Portuguesa em Cantão, celebrado por troca de Notas, assinadas em Pequim, em 10 e 24 de maio de 2016, cujo texto, nas versões em língua portuguesa, chinesa e inglesa, se publica em anexo.

A Embaixada de Portugal em Pequim apresenta os seus atenciosos cumprimentos ao Ministério dos Negócios Estrangeiros da República Popular da China e tem a honra de confirmar, em nome do Governo da República Portuguesa, que o Governo da República Portuguesa e o Governo da República Popular da China, no desejo comum de continuar a promover as relações amigáveis entre os dois países, através de consultas amigáveis, chegaram a acordo sobre a criação de um ConsuladoGeral da República Portuguesa em Cantão.
1 - O Governo da República Popular da China concorda com o estabelecimento de um ConsuladoGeral da República Portuguesa em Cantão, com um distrito consular abrangendo as Províncias de Guangdong, Hainan, Hunan, Fujian e a Região Autónoma de Guangxi Zhuang;
2 - O Governo da República Portuguesa concorda que a República Popular da China se reserva o direito de estabelecer um posto consular na República Portuguesa. A sua localização e distrito consular serão decididos através de canais diplomáticos;
3 - O Governo da República Portuguesa e o Governo da República Popular da China facultar-se-ão mutuamente toda a assistência necessária para o estabelecimento dos postos consulares suprareferidos e para o exercício das funções consulares respetivas nos termos da Convenção de Viena sobre relações Consulares de 24 de Abril de 1963, as leis e regulamentos aplicáveis e o princípio da reciprocidade;
4 - Quaisquer questões que se suscitem nas relações consulares entre os dois países serão resolvidas pelas duas partes através de consultas amigáveis de acordo com o princípio da reciprocidade e o Direito e a prática internacionais, incluindo a Convenção de Viena sobre relações Consulares de 24 de Abril de 1963;
Se o teor do texto suprarreferido for confirmado numa nota de resposta do Ministério dos Negócios Estrangeiros da República Popular da China em nome do Governo da República Popular da China, a presente nota e a nota de resposta do Ministério dos Negócios Estrangeiros da República Popular da China em nome do Governo da República Popular da China constituirão um acordo entre o Governo da República Portuguesa e o Governo da Re-pública Popular da China.
Este acordo entrará em vigor trinta dias após da data da receção da segunda das notificações, por escrito e através de canais diplomáticos, comunicando a conclusão do cumprimento dos requisitos de Direito interno de cada uma das partes para este efeito.
A Embaixada de Portugal em Pequim aproveita esta oportunidade para reiterar ao Ministério dos Negócios Estrangeiros da República Popular da China os protestos da sua mais elevada consideração.

The Embassy of the Portuguese Republic in Beijing presents its compliments to the Ministry of Foreign Affairs of the People’s Republic of China and has the honour to confirm on behalf of the Government of the Portuguese Republic that the Government of the Portuguese Republic and the Government of the People’s Republic of China, in the common desire to further promote the friendly relations between the two countries, through friendly consultations, have reached an agreement on the establishment of the Consulate General of the Portuguese Republic in Guangzhou:
1 - The Government of the People’s Republic of China agrees upon the establishment of the Consulate General of the Portuguese Republic in Guangzhou with its consular district covering Guangdong Province, Hainan Province, Hunan Province, Fujian Province and Guangxi Zhuang Autonomous Region.
2 - The Government of the Portuguese Republic agrees that the People’s Republic of China reserves the right to establish a consular post in the Portuguese Republic. Its location and consular district will be decided through diplomatic channels.
3 - The Government of the Portuguese Republic and Government of the People’s Republic of China shall provide each other with all necessary assistance and facilitation for the establishment of the abovementioned consular posts and the exercise of their consular functions in accordance with the Vienna Convention on Consular Relations of 24 April 1963, the relevant laws and regulations of the two countries and the principle of reciprocity.
4 - Any issue that may arise in the consular relations between the two countries shall be resolved by the two sides through friendly consultations in accordance with the principle of reciprocity, the international law and the international practices, including the Vienna Convention on Consular Relations of 24 April 1963.
If the abovementioned content is confirmed in a note of reply by the Ministry of Foreign Affairs on behalf of the Government of the People’s Republic of China, the present note and the note of reply from the Ministry of Foreign Affairs of the People’s Republic of China shall constitute an agreement between the Government of the Portuguese Republic and Government of the People’s Republic of China.
This agreement shall enter into force thirty days after the date of receipt of the later of the notifications, in writing though diplomatic channels, conveying the completion of the internal procedures of each side required for that purpose.
The Embassy of Portugal in Beijing avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the People’s Republic of China the assurances of its highest consideration.
