Por ordem superior se torna público que o Governo dos Estados Unidos da América, através de nota do Departamento de Estado dirigida ao embaixador de Portugal em Washington datada de 20 de Outubro de 1980, denunciou unilateralmente a Convenção sobre Naturalização entre Portugal e os Estados Unidos, assinada em Washington a 7 de Maio de 1908, conhecidos por «Bancroft Convention».

De acordo com o seu artigo IV, o termo da Convenção teve lugar 6 meses após a data da referida notificação.

É do seguinte teor, em língua inglesa, a nota do Departamento de Estado:

Excellency:

I have the Honiara to refer to the naturalization convention between United States of America and Portugal signed at Washington on May 7, 1908 (the Convention), and particularly to Article IV thereof, which provides that the Convention shall terminate six months from the date of either party's notice to the other of its intention to terminate.

In relation between our two countries, this Convention has long ceased to offer any positive benefits. It also creates a presumption that a naturalized citizen intends to abandon that citizenship should he reside in his country of origin for a period of two years; action by the United States to apply this presumption to its naturalized citizens born in Portugal would violate the U. S. Constitution as interpreted by the Supreme Court of the United States in recent years.

For these reasons, I have the honor hereby to notify your Excellency's Government, pursuant to Article IV, of the termination of the Convention by the Government of the United States. The Convention will therefore terminate six months from the date of this note.
