Resolução da Assembleia da República n.º 24/97

Aprova, para ratificação, o Protocolo 1 à Convenção Europeia para a

Prevenção da Tortura e Penas ou Tratamentos Desumanos ou

Degradantes, aberto à assinatura em Estrasburgo, em 4 de Novembro de

1993.

A Assembleia da República resolve, nos termos dos artigos 164.º, alínea j), e 169.º, n.º 5, da Constituição, aprovar, para ratificação, o Protocolo 1 à Convenção Europeia para a Prevenção da Tortura e Penas ou Tratamentos Desumanos ou Degradantes, aberto à assinatura em Estrasburgo, em 4 de Novembro de 1993, cujas versões autênticas em língua inglesa e francesa e tradução em língua portuguesa seguem em anexo.

PROTOCOL N.º 1 TO THE EUROPEAN CONVENTION FOR THE

PREVENTION OF TORTURE AND INHUMAN OR DEGRADING

TREATMENT OR PUNISHMENT.

The member States of the Council of Europe, signatories to the Protocol to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, signed at Strasbourg on 26 November 1987 (hereinafter referred to as «the Convention»):

Considering that non-member States of the Council of Europe should be allowed to accede to the Convention at the invitation of the Committee of Ministers;

have agreed as follows:

Article 1

A subparagraph shall be added to article 5, paragraph 1, of the Convention as follows:

«Where a member is to be elected to the Committee in respect of a non-member State of the Council ofEurope, the Bureau of the Consultative Assembly shall invite the Parliament of that State to put forward three candidates, of whom two at least shall be its nationals. The election by the Committee of Ministers shall take place after consultation with the Party concerned.»

Article 2

Article 12 of the Convention shall read as follows:

«Subject to the rules of confidentiality in article 11, the Committee shall every year submit to the Committee of Ministers a general report on its activities which shall be transmitted to the Consultative Assembly and to any non-member State of the Council of Europe which is a party to the Convention, and made public.»

Article 3

The text of article 18 of the Convention shall become paragraph 1 of that article and shall be supplemented by the following second paragraph:

«2 - The Committee of Ministers of the Council of Europe may invite any non-member State of the Council of Europe to accede to the Convention.»

Article 4

In paragraph 2 of article 19 of the Convention, the word «member» shall be deleted and the words «or approval», shall be replaced by «approval or accession».

Article 5

In paragraph 1 of article 20 of the Convention, the words «or approval» shall be replaced by «approval or accession».

Article 6

1 - The introductory sentence of article 23 of the Convention shall read as follows:

«The Secretary General of the Council of Europe shall notify the member States and any non-member State of the Council of Europe party to the Convention of:» 2 - In article 23, b), of the Convention, the words «or approval;» shall be replaced by «approval or accession;».

Article 7

1 - This Protocol shall be open for signature by member States of the Council of Europe signatories to the Convention, which may express their consent to be bound by:

a) Signature without reservation as to ratification, acceptance or approval; or b) Signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

2 - Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 8

This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of article 7.

Article 9

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe of:

a) Any signature;

b) The deposit of any instrument of ratification, acceptance or approval;

c) The date of entry into force of this Protocol, in accordance with article 8;

d) Any other act, notification or communication relating to this Protocol.

In witness whereof, the undersigned, being duly authorized thereto, have signed this Protocol.

Done at Strasbourg, this 4th day of November 1993, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.

PROTOCOLE Nº 1 À LA CONVENTION EUROPÉENNE POUR LA

PRÉVENTION DE LA TORTURE ET DES PEINES OU TRAITEMENTS

INHUMAINS OU DÉGRADANTS.

Les Etats membres du Conseil de l'Europe, signataires du présent Protocole à la Convention européenne pour la prévention de la torture et des peines ou traitements inhumains ou dégradants, signée à Strasbourg le 26 novembre 1987 (ci-après dénommée «la Convention»):

Considérant qu'il est opportun de permettre aux Etats non membres du Conseil de l'Europe d'adhérer, sur invitation du Comité des Ministres, à la Convention;

sont convenus de ce qui suit:

Article 1

Le paragraphe 1 de l'article 5 de la Convention est complété par un alinéa ainsi rédigé:

«En cas d'élection d'un membre du Comité au titre d'un Etat non membre du Conseil de l'Europe, le Bureau de l'Assemblée Consultative invite le parlement de l'Etat concerné à présenter trois candidats, dont deux au moins seront de sa nationalité. L'élection par le Comité des Ministres aura lieu après consultation de la Partie concernée.»

Article 2

L'article 12 de la Convention se lit comme suit:

«Chaque année, le Comité soumet au Comité des Ministres, en tenant compte des règles de confidentialité prévues à l'article 11, un rapport général sur ces activités, qui est transmis à l'Assemblée Consultative, ainsi qu'à tout Etat non membre du Conseil de l'Europe partie à la Convention, et rendu public.»

Article 3

Le texte de l'article 18 de la Convention devient le paragraphe 1 du même article et est completé par un paragraphe 2 ainsi rédigé:

«2 - Le Comité des Ministres du Conseil de l'Europe peut inviter tout Etat non membre du Conseil de l'Europe à adhérer à la Convention.»

Article 4

Au paragraphe 2 de l'article 19 de la Convention, le mot «membre» est supprimé et les mots «ou d'approbation,» sont remplacés par «d'approbation ou d'adhésion.».

Article 5

Au paragraphe 1 de l'article 20 de la Convention, les mots «ou d'approbation» sont remplacés par «d'approbation ou d'adhésion,».

Article 6

1 - La phrase introductive de l'article 23 de la Convention se lit comme suit:

«Le Secrétaire Général du Conseil de l'Europe notifiera aux Etats membres ainsi qu'à tout Etat non membre du Conseil de l'Europe partie à la Convention:» 2 - A la lettre b) de l'article 23 de la Convention, les mots «ou d'approbation;» sont remplacés par «d'approbation ou d'adhésion;».

Article 7

1 - Le présent Protocole est ouvert à la signature des Etats membres du Conseil de l'Europe signataires de la Convention, qui peuvent exprimer leur consentement à être liés par:

a) Signature sans réserve de ratification, d'acceptation ou d'approbation; ou b) Signature sous réserve de ratification, d'acceptation ou d'approbation, suivie de ratification, d'acceptation ou d'approbation.

2 - Les instruments de ratification, d'acceptation ou d'approbation seront déposés près le Secrétaire Général du Conseil de l'Europe.

Article 8

Le présent Protocole entrera en vigueur le premier jour du mois qui suit l'expiration d'une période de trois mois après la date à laquelle toutes les Parties à la Convention auront exprimé leur consentement à être liées par le Protocole, conformément aux dispositions de l'article 7.

Article 9

Le Secrétaire Général du Conseil de l'Europe notifiera aux Etats membres du Conseil de l'Europe:

a) Toute signature;

b) Le dépôt de tout instrument de ratification, d'acceptation ou d'approbation;

c) La date d'entrée en vigueur du présent Protocole, conformément à l'article 8;

d) Tout autre acte, notification ou communication ayant trait au présent Protocole.

En foi de quoi, les soussignés, dûment autorisés à cet effet, ont signé le présent Protocole.

Fait à Strasbourg, le 4 novembre 1993, en français et en anglais, les deux textes faisant également foi, en un seul exemplaire qui sera déposé dans les archives du Conseil de l'Europe. Le Secrétaire Général du Conseil de l'Europe en communiquera copie certifiée conforme à chacun des Etats membres du Conseil de l'Europe.

PROTOCOLO 1 À CONVENÇÃO EUROPEIA PARA A PREVENÇÃO DA

TORTURA E DAS PENAS OU TRATAMENTOS DESUMANOS OU

DEGRADANTES.

Os Estados membros do Conselho da Europa, signatários do presente Protocolo à Convenção Europeia para a Prevenção da Tortura e das Penas ou Tratamentos Desumanos ou Degradantes, assinada em Estrasburgo a 26 de Novembro de 1987 (a seguir designada «a Convenção»):

Considerando que se deve permitir a adesão à Convenção, a convite do Comité de Ministros, de Estados não membros do Conselho da Europa;

acordaram no seguinte:

Artigo 1.º

Ao n.º 1 do artigo 5.º da Convenção é acrescentada uma alínea, com a seguinte redacção:

«Em caso de eleição de um membro do Comité em representação de um Estado não membro do Conselho da Europa, a mesa da Assembleia Consultiva convida o Parlamento desse Estado a apresentar três candidatos, dos quais pelo menos dois serão da sua nacionalidade. A eleição pelo Comité de Ministros terá lugar após consulta à Parte visada.»

Artigo 2.º

O artigo 12.º tem a seguinte redacção:

«O Comité submete anualmente ao Comité de Ministros, tendo em conta as regras de confidencialidade consagradas no artigo 11.º, um relatório geral sobre as suas actividades, o qual é transmitido à Assembleia Consultiva, bem como a todos os Estados não membros do Conselho da Europa que sejam Parte na Convenção, e tornado público.»

Artigo 3.º

O texto do artigo 18.º da Convenção constituirá o n.º 1 desse artigo e é acrescentado um n.º 2, com a seguinte redacção:

«2 - O Comité de Ministros do Conselho da Europa pode convidar qualquer Estado não membro do Conselho da Europa a aderir à Convenção.»

Artigo 4.º

No n.º 2 do artigo 19.º da Convenção, a palavra «membro» é suprimida e as palavras «ou de aprovação» são substituídas por «de aprovação ou de adesão».

Artigo 5.º

No n.º 1 do artigo 20.º da Convenção, as palavras «ou de aprovação» são substituídas por «de aprovação ou de adesão».

Artigo 6.º

1 - A frase inicial do artigo 23.º tem a seguinte redacção:

«O Secretário-Geral do Conselho da Europa notificará os Estados membros e todos os Estados não membros do Conselho da Europa que sejam Parte na Convenção:» 2 - Na alínea b) do artigo 23.º da Convenção, as palavras «ou de aprovação;» são substituídas por «de aprovação ou de adesão;».

Artigo 7.º

1 - O presente Protocolo encontra-se aberto à assinatura dos Estados membros do Conselho da Europa signatários da Convenção, que podem exprimir o seu consentimento a ficarem vinculados por meio de:

a) Assinatura sem reserva de ratificação, de aceitação ou de aprovação; ou b) Assinatura sob reserva de ratificação, de aceitação ou de aprovação, seguida de ratificação, de aceitação ou de aprovação.

2 - Os instrumentos de ratificação, de aceitação ou de aprovação serão depositados junto do Secretário-Geral do Conselho da Europa.

Artigo 8.º

O presente Protocolo entrará em vigor no primeiro dia do mês seguinte ao termo de um período de três meses após a data em que todas as Partes na Convenção tenham expresso o seu consentimento a ficarem vinculadas pelo Protocolo, em conformidade com as disposições do artigo 7.º

Artigo 9.º

O Secretário-Geral do Conselho da Europa notificará os Estados membros do Conselho da Europa:

a) De qualquer assinatura;

b) Do depósito de qualquer instrumento de ratificação, de aceitação ou de aprovação;

c) Da data de entrada em vigor do presente Protocolo, em conformidade com o artigo 8.º;

d) De qualquer outro acto, notificação ou comunicação relativos ao presente Protocolo.

Em fé do que os abaixo assinados, devidamente autorizados para o efeito, assinaram o presente Protocolo.

Feito em Estrasburgo, a 4 de Novembro de 1993, em francês e em inglês, fazendo os dois textos igualmente fé, num único exemplar, que será depositado nos arquivos do Conselho da Europa. O Secretário-Geral do Conselho da Europa enviará uma cópia autenticada a cada um dos Estados membros do Conselho da Europa.
