S/RES/1029 - EXTENSION OF UN ASSISTANCE MISSION FOR RWANDA

The Security Council:
Recalling all its previous resolutions on the situation in Rwanda, in particular its Resolution 872 (1993) of 5 October 1993 by which it established the United Nations Assistance Mission for Rwanda (UNAMIR), and its Resolutions 912 (1994) of 21 April 1994, 918 (1994) of 17 May 1994, 925 (1994) of 8 June 1994, 965 (1994) of 30 November 1994 and 997 (1995) of 9 June 1995, which set out the mandate of UNAMIR;

Recalling its Resolution 955 (1994) of 8 November 1994, establishing the International Tribunal for Rwanda, and its Resolution 978 (1995) of 27 February 1995, concerning the necessity for the arrest of persons suspected of committing genocide in Rwanda;

Having considered the report of the Secretary-General on UNAMIR dated 1 December 1995 (S/1995/1002);Noting the letters of the Foreign Minister of Rwanda to the Secretary-General of 13 August 1995 and 24 November 1995 (S/1995/1018, annex I, and S/1995/1018, annex II);

Stressing the importance of the voluntary and safe repatriation of Rwandan refugees and of genuine national reconciliation;

Noting with great concern continuing reports of military preparations and incursions into Rwanda by elements of the former regime, underlining the need for effective measures to ensure that Rwandan nationals currently in neighbouring countries, including those in camps, do not undertake military activities aimed at destabilizing Rwanda or receive arms supplies, in view of the great likelihood that such arms are intended for use within Rwanda, and welcoming in this context the establishment of the International Commission of Inquiry pursuant to its Resolution 1013 (1995) of 7 September 1995;

Underlining the need for increased efforts to assist the Government of Rwanda in the promotion of a climate of confidence and trust in order to facilitate the return of Rwandan refugees in neighbouring countries;

Emphasizing the necessity for the accelerated disbursement of international assistance for the rehabilitation and reconstruction of Rwanda;

Welcoming the Summit of Heads of State of the Great Lakes Region held in Cairo on 28-29 November and the Declaration of 29 November 1995 issued by them (S/1995/1001);

Emphasizing the importance of all States acting in accordance with the recommendations adopted by the Regional Conference on Assistance to Refugees, Returnees and Displaced Persons in the Great Lakes Region held in Bujumbura in February 1995 and those contained in the Cairo Declaration;

Commending the Government of Rwanda's continuing efforts to maintain peace and security as well as to reconstruct and rehabilitate the country;

Recognizing the valuable contribution that the human rights officers deployed by the High Commissioner for Human Rights to Rwanda have made towards the improvement of the overall situation;

Acknowledging the responsibility of the Government of Rwanda for the safety and security of all UNAMIR personnel and other international staff serving in the country:

1 - Decides to extend the mandate of UNAMIR for a final period until 8 March 1996.

2 - Decides also, in the light of current efforts to restore peace and stability through the voluntary and safe repatriation of Rwandan refugees, to adjust the mandate of UNAMIR so that UNAMIR will:

a) Exercise its good offices to assist in achieving the voluntary and safe repatriation of Rwandan refugees within the frame of reference of the recommendations of the Bujumbura Conference and the Cairo Summit of the Heads of State of the Great Lakes Region, and in promoting genuine national reconciliation;

b) Assist the Government of Rwanda in facilitating the voluntary and safe return of refugees and, to this end, to support the Government of Rwanda in its ongoing efforts to promote a climate of confidence and trust through the performance of monitoring tasks;

c) Assist the United Nations High Commissioner for Refugees and other international agencies in the provision of logistical support for the repatriation of refugees;

d) Contribute, with the agreement of the Government of Rwanda, to the protection of the International Tribunal for Rwanda as an interim measure until alternative arrangements agreed with the Government of Rwanda can be put in place.

3 - Requests the Secretary-General to reduce the force level of UNAMIR to 1,200 troops to carry out the mandate set out in paragraph 2 above.

4 - Requests the Secretary-General to reduce the number of military observers, headquarters and other military support staff to 200.

5 - Requests the Secretary-General to initiate planning for the complete withdrawal of UNAMIR after the expiry of the present mandate, that withdrawal to take place within a period of six weeks after the expiry of the mandate.

6 - Requests the Secretary-General to withdraw the Civilian Police component of UNAMIR.

7 - Requests the Secretary-General to examine, in the context of existing United Nations regulations, the feasibility of transferring UNAMIR non-lethal equipment, as elements of UNAMIR withdraw, for use in Rwanda.

8 - Takes note of the cooperation existing between the Government of Rwanda and UNAMIR in the implementation of its mandate and urges the Government of Rwanda and UNAMIR to continue to implement the Status of Mission Agreement of 5 November 1993 and any subsequent agreement to replace that Agreement in order to facilitate the implementation of the new mandate.

9 - Calls upon the Government of Rwanda to take all necessary measures to ensure that UNAMIR personnel and equipment that are scheduled to withdraw can do so in an orderly and safe manner.

10 - Commends the efforts of States, United Nations agencies and non-governmental organizations which have provided humanitarian assistance to refugees and displaced persons in need, encourages them to continue such assistance, and calls upon the Government of Rwanda to continue to facilitate their delivery and distribution.

11 - Calls upon States and donor agencies to fulfil their earlier commitments to give assistance for Rwanda's rehabilitation efforts, to increase such assistance, and in particular to support the early and effective functioning of the International Tribunal and the rehabilitation of the Rwandan justice system.

12 - Also calls upon States to cooperate fully with the International Commission of Inquiry established pursuant to Resolution 1013 (1995).

13 - Encourages the Secretary-General an his special representative to continue to coordinate the activities of the United Nations in Rwanda, including those of the organizations and agencies active in the humanitarian and developmental field, and of the human rights officers.

14 - Requests the Secretary-General to report to the Council by 1 February 1996 on the discharge by UNAMIR of its mandate and progress towards repatriation of refugees.

15 - Decides to remain actively seized of the matter.

S/RES/1029 - PROLONGAMENTO DA MISSÃO DE ASSISTÊNCIA DAS NAÇÕES UNIDAS PARA O RUANDA

O Conselho de Segurança:
Tendo presentes as suas resoluções anteriores sobre a situação no Ruanda, nomeadamente a sua Resolução 872 (1993), de 5 de Outubro de 1993, pela qual criou a Missão de Assistência das Nações Unidas para o Ruanda (UNAMIR), e as suas Resoluções n.os 912 (1994), de 21 de Abril de 1994, 918 (1994), de 17 de Maio de 1994, 925 (1994), de 8 de Junho de 1994, 965 (1994), de 30 de Novembro de 1994, e 997 (1995), de 9 de Junho de 1995, que estabeleceram o mandato da UNAMIR;

Tendo igualmente presentes a sua Resolução 955 (1994), de 8 de Novembro de 1994, que criou o Tribunal Internacional para o Ruanda, bem como a sua Resolução 978 (1995), de 27 de Fevereiro de 1995, relativa à necessidade da detenção de pessoas suspeitas de terem cometido genocídio no território do Ruanda;

Tendo analisado o relatório do Secretário-Geral sobre a UNAMIR, datado de 1 de Dezembro de 1995 (S/1995/1002);

Tomando nota das cartas dirigidas pelo Ministro dos Negócios Estrangeiros do Ruanda ao Secretário-Geral, datadas de 13 de Agosto e de 24 de Novembro de 1995, respectivamente (S/1995/- 1018, anexo I, e S/1995/1018, anexo II);

Realçando a importância de uma repatriação voluntária e segura de refugiados ruandeses e de se alcançar uma reconciliação nacional genuína;

Constatando com grande preocupação as constantes informações sobre os preparativos militares e as incursões no território do Ruanda de elementos do anterior regime, sublinhando a necessidade de serem tomadas medidas efectivas que garantam que os nacionais do Ruanda presentemente nos países vizinhos, incluindo os que se encontram nos campos, não se envolvam em actividades militares que visem desestabilizar o Ruanda nem recebam fornecimentos de armamento, face à forte probabilidade de que tal armamento se destine a ser usado no território do Ruanda, e congratulando-se, neste contexto, com a criação da Comissão Internacional de Inquérito, nos termos da sua Resolução 1013 (1995), de 7 de Setembro de 1995;

Sublinhando a necessidade de esforços crescentes para assistir o Governo do Ruanda na obtenção de um clima de estabilidade e confiança que facilite o regresso de refugiados ruandeses dos países vizinhos;

Realçando a necessidade de uma assistência internacional célere para a reabilitação e a reconstrução do Ruanda;

Congratulando-se com a Cimeira de Chefes de Estado da Região dos Grandes Lagos, que ocorreu na cidade do Cairo em 28 e 29 de Novembro, e com a Declaração de 29 de Novembro de 1995 produzida pelos referidos Chefes de Estado (S/1995/1001);

Realçando a importância de todos os Estados agirem em conformidade com as recomendações adoptadas pela Conferência Regional sobre Assistência a Refugiados, Retornados e Desalojados na Região dos Grandes Lagos, que teve lugar em Bujumbura em Fevereiro de 1995, e em conformidade com as recomendações contidas na Declaração do Cairo;

Elogiando os esforços continuados do Governo do Ruanda para manter a paz e a segurança, bem como para reconstruir e reabilitar o país;

Reconhecendo a valiosa contribuição dos funcionários dos direitos humanos destacados para o Ruanda pelo Alto Comissário para os Direitos Humanos para a melhoria da situação em geral;

Reconhecendo a responsabilidade do Governo do Ruanda na segurança do pessoal da UNAMIR e de outro pessoal internacional que cumpra funções no país:

1 - Decide prolongar o mandato da UNAMIR por um período final com termo a 8 de Março de 1996.

2 - Decide igualmente, à luz dos actuais esforços para restaurar a paz e a estabilidade através da repatriação voluntária e segura de refugiados ruandeses, adaptar o mandato da UNAMIR, de modo que esta:

a) Exerça os seus bons ofícios no sentido de cooperar para a repatriação segura e voluntária de refugiados ruandeses no âmbito das recomendações da Conferência de Bujumbura e da Cimeira do Cairo dos Chefes de Estado da Região dos Grandes Lagos, bem como na obtenção de uma reconciliação nacional genuína;

b) Assista o Governo do Ruanda no sentido de facilitar o regresso voluntário e seguro de refugiados e, nesta perspectiva, apoie os esforços em curso do Governo do Ruanda para promover um clima de confiança através da execução de tarefas de supervisionamento;

c) Assista o Alto Comissário das Nações Unidas para os Refugiados e outras agências internacionais na disponibilização de apoio logístico para a repatriação de refugiados;

d) Contribua, com o acordo do Governo do Ruanda, para a protecção do Tribunal Internacional para o Ruanda, como medida provisória até que sejam postos em prática compromissos alternativos alcançados com o Governo do Ruanda.

3 - Solicita ao Secretário-Geral que reduza os efectivos da UNAMIR para 1200 elementos, que cumprirão o mandato estabelecido no n.º 2, supra.

4 - Solicita ao Secretário-Geral que reduza o número de observadores militares, quartéis e outro pessoal militar de apoio para 200 elementos.

5 - Solicita ao Secretário-Geral que inicie o plano de retirada total da UNAMIR após a expiração do presente mandato, devendo tal retirada ocorrer num prazo de seis semanas após a expiração do mandato.

6 - Solicita ao Secretário-Geral que retire a componente policial civil da UNAMIR.

7 - Solicita ao Secretário-Geral que examine, no contexto dos regulamentos em vigor das Nações Unidas, a viabilidade de transferir equipamento não letal das Nações Unidas, como elementos da retirada da UNAMIR, para uso no Ruanda.

8 - Constata a cooperação existente entre o Governo do Ruanda e a UNAMIR na execução do seu mandato e insta o Governo do Ruanda e a UNAMIR a continuarem a executar o Acordo do Estatuto da Missão, de 5 de Novembro de 1993, bem como qualquer acordo subsequente que o substitua, por forma a facilitar a execução do novo mandato.

9 - Apela ao Governo do Ruanda para que tome todas as medidas necessárias para garantir que o pessoal e o equipamento da UNAMIR destinados a serem retirados o possam fazer de forma ordenada e segura.

10 - Elogia os esforços dos Estados, das agências das Nações Unidas e de organizações não governamentais que tenham prestado assistência humanitária a refugiados e desalojados necessitados, encoraja-os a prosseguirem tal assistência e apela ao Governo do Ruanda para que continue a facilitar a sua entrega e distribuição.

11 - Apela aos Estados e agências doadores para que observem os seus compromissos anteriores de assistência aos esforços de reabilitação do Ruanda, para que aumentem tal assistência e que, em particular, apoiem o rápido e efectivo funcionamento do Tribunal Internacional e a reabilitação do sistema judicial do Ruanda.

12 - Apela igualmente aos Estados para que cooperem integralmente com a Comissão Internacional de Inquérito criada nos termos da Resolução 1013 (1995).

13 - Encoraja o Secretário-Geral e o seu representante especial a continuarem a coordenar as actividades das Nações Unidas no Ruanda, incluindo as de organizações e agências envolvidas no campo humanitário e de desenvolvimento, e as dos funcionários dos direitos humanos.

14 - Solicita ao Secretário-Geral que, a 1 de Fevereiro de 1996, informe o Conselho sobre o termo do mandato da UNAMIR, da situação humanitária e dos avanços relativos à repatriação de refugiados.

15 - Decide manter-se activamente informado sobre a questão.
