Decreto 50/91

Nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o Governo decreta o seguinte:

Artigo único. São aprovadas, para adesão, as emendas que alteram a Convenção Internacional para a Prevenção da Poluição por Navios, 1973, modificada pelo Protocolo de 1978 (MARPOL 73-78), cujo original em inglês e a respectiva tradução para português seguem em anexo ao presente decreto.

1987 amendments to the annex of the Protocol of 1978 Relating to the International Convention for the Prevention of Pollution from Ships, 1973

ANNEX I
Regulations for the prevention of pollution by oil
Regulation 10
Methods for the prevention of oil pollution from ships while operating in special areas

The existing text of paragraph 1 is replaced by the following:
1 - For the purposes of this annex the special areas are the Mediterranean Sea area, the Baltic Sea area, the Black Sea area, the Red Sea area, the «Gulfs area» and the Gulf of Aden area, which are defined as follows:

a) The Mediterranean Sea area means the Mediterranean Sea proper including the gulfs and sea therein with the boundary between the Mediterranean and the Black Sea constituted by the 41º N parallel and bounded to the west by the Straits of Gibraltar at the meridian of 5º 36' W;

b) The Baltic Sea area means the Baltic Sea proper with the Gulf of Bothnia, the Gulf of Finland and the entrance to the Baltic Sea bounded by the parallel of the Skaw in the Skagerrak at 57º 44.8' N;

c) The Black Sea area means the Black Sea proper with the boundary between the Mediterranean and the Black Sea constituted by the parallel 41º N;

d) The Red Sea area means the Red Sea proper including the Gulfs of Suez and Aqaba bounded at the south by the rhumb line between Ras si Ane (12º 28.5' N, 43º 19.6' E) and Husn Murad (12º 40.4' N, 43º 30.2' E);

e) The «Gulfs area» means the sea area located north west of the rhumb line between Ras al Hadd (22º 30' N, 59º 48' E) and Ras al Fasteh (25º 04' N, 61º 25' E);

f) The Gulf of Aden area means that part of the Gulf of Aden between the Red Sea and Arabian Sea bounded to the west by the rhumb line between Ras si Ane (12º 28.5' N, 43º 19.6' E) and Husn Murad (12º 40.4' N, 43º 30.2' E) and to the east by the rhumb line between Ras Asir (11º 50' N, 51º 16.9' E) and Ras Fartak (15º 35' N, 52º 13.8' E).

The introductory phrase of paragraph 7, b), ins replaced by the following:
b) Red Sea area, «Gulfs» area and Gulf of Aden area.

ANEXO I
Regras para a prevenção da poluição por hidrocarbonetos
Regra 10
Métodos para a prevenção da poluição por hidrocarbonetos provenientes de navios operando em áreas especiais

O texto actual do parágrafo 1 é substituído pelo seguinte:
1 - Para os fins do presente anexo, as áreas especiais são a área do mar Mediterrâneo, a área do mar Báltico, a área do mar Negro, a área do mar Vermelho, a «área dos Golfos» e a área do golfo de Aden, as quais são definidas como segue:

a) A área do mar Mediterrâneo significa o mar Mediterrâneo propriamente dito, incluindo os seus golfos e mares, e é limitada do lado do mar Negro pelo paralelo 41.º N. e a oeste, no estreito de Gibraltar, pelo meridiano 5º 36' W.;

b) A área do mar Báltico significa o mar Báltico propriamente dito, assim como o golfo de Bótnia, o golfo da Finlândia e a entrada do mar Báltico limitada pelo paralelo de Skaw, no Skagerrak, em 57º 44,8' N.;

c) A área do mar Negro significa o mar Negro propriamente dito, limitada do lado do Mediterrâneo pelo paralelo 41º N.;

d) A área do mar Vermelho significa o mar Vermelho propriamente dito, incluindo os golfos do Suez e de Aqaba, limitada a sul pela loxodromia que liga Ras si Ane (12.º 28,5' N., 43º 19,6' E.) a Husn Murad (12.º 40,4' N., 43º 30,2' E.);

e) A «área dos Golfos» significa a área do mar situada a noroeste da loxodromia que liga Ras Al Hadd (22º 30' N., 59º 48' E.) a Ras al Fasteh (25º 04' N., 61º 25' E.);

f) A área do golfo de Aden significa a parte do golfo de Aden compreendida entre o mar Vermelho e o mar Arábico limitada a oeste pela loxodromia que liga Ras si Ane (12º 28,5' N., 43º 19,6' E.) a Husn Murad (12º 40,4' N., 43º 30,2' E.) e a leste pela loxodromia que liga Ras Asir (11º 50' N., 51º 16,9' E.) a Ras Fartak (15º 35' N., 52º 13,8' E.).

A primeira frase do parágrafo 7, b), é substituída pela seguinte:
b) Área do mar Vermelho, «área dos Golfos» e área do golfo de Aden.
