Em 8 de janeiro de 2013, foi celebrado, em Lisboa, o Acordo entre a República Portuguesa e a República de San Marino no domínio do Turismo.
O referido Acordo estabelece a base jurídica para o desenvolvimento da cooperação no domínio do turismo, baseada no princípio da igualdade e de benefícios mútuos e será desenvolvida nos domínios institucional, empresarial, no intercâmbio de informação e experiências, na formação profissional e na cooperação no âmbito das Organizações Internacionais.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre a República Portuguesa e a República de San Marino no domínio do Turismo, assinado em Lisboa, em 8 de janeiro de 2013, cujo texto, nas versões autenticadas nas línguas portuguesa, italiana e inglesa, se publica em anexo.

ACORDO DE COOPERAÇÃO ENTRE A REPÚBLICA PORTUGUESA E A REPÚBLICA DE SAN MARINO NO DOMÍNIO DO TURISMO
A República Portuguesa e a República de San Marino, doravante designadas por "Partes",
Reconhecendo a importância do papel do turismo para o desenvolvimento económico, bem como para o fortalecimento das relações entre ambas as Partes;
Comprometidas com o objetivo de assegurar um desenvolvimento sustentável no domínio do turismo, no sentido de preservar os recursos naturais, ambientais e culturais das Partes;
Desejando intensificar a cooperação no domínio do turismo e estabelecer um enquadramento jurídico adequado para esse efeito;
acordam o seguinte:
Artigo 1.º
Objeto
O presente Acordo estabelece a base jurídica para o desenvolvimento da cooperação entre as Partes no domínio do turismo, baseada no princípio da igualdade e de benefícios mútuos.
Artigo 2.º
Âmbito da Cooperação
A cooperação entre as Partes será desenvolvida nos seguintes domínios:
a) Cooperação institucional;
b) Cooperação empresarial;
c) Intercâmbio de informação e experiências;
d) Formação Profissional;
e) Cooperação no âmbito de Organizações Internacionais.
Artigo 3.º
Cooperação institucional
As Partes promoverão a cooperação entre os respetivos organismos nacionais de turismo e fomentarão a colaboração entre entidades nacionais que atuem no domínio do setor.
Artigo 4.º
Cooperação no âmbito empresarial
As Partes promoverão o intercâmbio de informação sobre oportunidades de investimento na área do turismo, com vista à identificação de projetos de interesse mútuo.
Artigo 5.º
Intercâmbio de informação e de experiências
As Partes promoverão o intercâmbio de informação e de experiências relevantes no domínio do turismo, incluindo:
a) Legislação que regula a atividade turística das Partes;
b) Legislação nacional referente à proteção e à preservação dos recursos naturais e do património cultural de reconhecido interesse turístico;
c) A troca de publicações e de material turístico promocional;
d) Troca de informação e experiências em relação às cidades inscritas na lista do Património Mundial da UNESCO.
Artigo 6.º
Formação profissional
As Partes encorajarão a cooperação no domínio da formação no setor do turismo, estimulando o estabelecimento de programas de formação, a cooperação entre instituições congéneres e o intercâmbio de informação sobre estudos realizados, bem como sobre os resultados da sua implementação.
Artigo 7.º
Cooperação no âmbito de organizações internacionais
As Partes promoverão todos os esforços para aprofundar a cooperação no seio da Organização Mundial do Turismo e das organizações internacionais do setor e trocarão informação sobre os respetivos resultados obtidos nesta área.
Artigo 8.º
Pontos Focais
1. As Partes indicarão Pontos Focais que terão como objetivo promover consultas sobre a matéria objeto do presente Acordo, garantir a sua aplicação e resolver as divergências resultantes da sua aplicação.
2. Os Pontos Focais comunicarão por via eletrónica.
3. A fim de implementar o presente Acordo e estabelecer formas detalhadas de cooperação, os Pontos Focais poderão propor programas de cooperação.
Artigo 9.º
Solução de controvérsias
Qualquer controvérsia relativa à interpretação ou à aplicação do presente Acordo, será solucionada através de negociações entre as Partes.
Artigo 10.º
Revisão
1. O presente Acordo pode ser objeto de revisão a pedido de qualquer das Partes.
2. As emendas entrarão em vigor nos termos previstos no Artigo 12.º do presente Acordo.
Artigo 11.º
Vigência e Denúncia
1. O presente Acordo vigora por um período de cinco anos, renovável automaticamente.
2. Cada uma das Partes poderá, com uma antecedência mínima de seis meses em relação ao termo do período em curso, denunciar o presente Acordo.
3. A denúncia será notificada, por escrito e por via diplomática, produzindo os seus efeitos no termo do período em curso.
4. Em caso de denúncia, qualquer programa ou projeto, iniciado durante a vigência do presente Acordo, permanecerá em execução até à sua conclusão, salvo se as Partes acordarem em contrário.
Artigo 12.º
Entrada em Vigor
O presente Acordo entrará em vigor trinta dias após a data de receção da última notificação, por escrito e por via diplomática, declarando que foram cumpridos os processos internos previstos pelas respetivas legislações nacionais.
Artigo 13.º
Registo
A Parte em cujo território o presente Acordo for assinado, no mais breve prazo possível após a sua entrada em vigor, submetê-lo-á para registo, junto do Secretariado das Nações Unidas, nos termos do artigo 102.º da Carta das Nações Unidas, devendo, igualmente, notificar a outra Parte da conclusão deste procedimento e indicar-lhe o número de registo atribuído.
Feito em Lisboa no dia 8 de janeiro de 2013, nas línguas portuguesa, italiana e inglesa, fazendo todos os textos igualmente fé. Em caso de divergência de interpretação prevalecerá a versão inglesa.

COOPERATION AGREEMENT IN THE FIELD OF TOURISM BETWEEN THE PORTUGUESE REPUBLIC AND THE REPUBLIC OF SAN MARINO
The Portuguese Republic and the Republic of San Marino, hereinafter referred to as "The Parties",
Aware of the importance of tourism for the economic development, and for the reinforcement of the relations between the Parties;
Compromised with the goal of establishing a sustainable tourism development regarding the preservation of the natural environmental and cultural resources of the Parties;
Being desirous of strengthening the cooperation in the field of tourism and to establish a legal framework for this propose;
agree as follows:
Article 1
Object
The present Agreement establishes the legal framework for the development of cooperation between the Parties in the field of tourism, based on the principles of equality and mutual benefits.
Article 2
Scope of the Cooperation
The cooperation between the Parties will be developed, at the following levels:
a) Institutional cooperation;
b) Entrepreneurial cooperation;
c) Information and experience exchange;
d) Professional training;
e) Cooperation in the field of International Organizations.
Article 3
Institutional Cooperation
The Parties shall promote the cooperation between their National Tourism Organizations and will encourage the collaboration between national entities acting in the field of tourism.
Article 4
Entrepreneurial cooperation
The Parties shall promote the exchange of information on investment opportunities in the field of tourism in order to identify projects of mutual interest.
Article 5
Information and experience exchange
The Parties shall strive to stimulate the exchange of relevant information and experience in the field of tourism, including:
a) Legislation regulating the touristic activity of the Parties;
b) Legislation related to the protection and preservation of natural resources and cultural heritage of recognized touristic interest;
c) Exchange of tourism publications and promotional material;
d) Exchange of information and experiences related to places belonging to the list of UNESCO world heritage.
Article 6
Professional Training
The Parties shall encourage the cooperation of professional training in the field of tourism, namely through the establishment of manpower training programs, cooperation between equivalent institutions and the exchange of information about studies and the results of its implementation.
Article 7
Cooperation in the field of International Organizations
The Parties shall promote all efforts to develop their cooperation within the framework of the United Nations World Tourism Organization and other international tourism-related organizations through the exchange of information about the results obtained in this area.
Article 8
Focal Points
1. The Parties shall designate Focal Points in order to promote consultations about the subject of the present Agreement and to ensure its application and settle disputes arising from it.
2. The Focal Points shall convene through electronic communication.
3. In order to implement the present Agreement and to establish detailed forms of co-operation the Focal Points can propose cooperation programs.
Article 9
Settlement of disputes
Any dispute concerning the interpretation or application of the present Agreement, shall be settled through negotiation between the Parties.
Article 10
Amendments
1. The present Agreement may be amended upon request of each of the Parties.
2. The amendments shall enter into force in accordance with the terms established in Article 12 of the present Agreement.
Article 11
Duration and termination
1. The present Agreement shall remain in force for successive and automatically renewable periods of five years.
2. Either Party may denounce the present Agreement at least six months prior to its expiry date.
3. The denunciation should be notified, in writing through diplomatic channels, producing its effects at the end of its expiry date.
4. In the case of denunciation, any program or project initiated while the present Agreement was in force, shall remain in execution until its conclusion, unless the Parties agree otherwise.
Article 12
Entry into force
The present Agreement shall enter into force thirty days after the receipt of the later of the notifications, in writing and through diplomatic channels, declaring the completion of the internal law procedures required by the Parties national legislation.
Article 13
Registration
Upon the entry into force of the present Agreement, the Party in whose territory it is signed shall transmit it to the Secretariat of the United Nations for registration, in accordance with Article 102 of the Charter of the United Nations, and shall notify the other Party of the completion of this procedure as well as of its registration number.
Signed in Lisbon on January the 8th 2013, in the Portuguese, Italian and English languages, all texts being equally authentic. In case of divergence of interpretation, the English version shall prevail.
