Decreto do Governo n.º 9/84

de 27 de Fevereiro

O Governo decreta, nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o seguinte:

Artigo único. É aprovado o Acordo Cultural entre o Governo da República Portuguesa e o Governo da República da Finlândia, assinado em Lisboa em 2 de Dezembro de 1983, cujo texto original em inglês e a respectiva tradução em português vão anexos ao presente decreto.

CULTURAL AGREEMENT BETWEEN THE GOVERNMENT OF THE PORTUGUESE REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF FINLAND.

The Government of the Portuguese Republic and the Government of the Republic of Finland,

Desering to maintain and strengthen the friendly relations between the two countries and to promote and develop cultural, mass media, educational and scientific cooperation,

have agreed as follows:

ARTICLE 1

The Contracting Parties shall encourage educational, scientific and cultural cooperation between the two countries.

For this purpose, the Contracting Parties shall, within their possibilities and competence, encourage:

a) Visits by university professors and other persons engaged in scientific research, as guest professors and researchers;

b) The participation of graduates research scholars, teachers and specialists of arts and culture as well as of delegations in seminars, discussions and visits to competent institutions in the other country;

c) The provision of scholarships to enable the nationals of the other Contracting Party to pursue postgraduate studies or undertake research in the other country;

d) The promotion of studies of language and literature of the other Contracting Party at their universities or other educational institutions.

ARTICLE 2

The Contracting Parties may establish in the territory of the other Contracting Party cultural institutes dedicated to the purposes of this Agreement provided that they comply with the laws and regulations of the other country.

ARTICLE 3

For the purposes of this Agreement, the Contracting Parties shall encourage close cooperation between scientific, educational, artistic and cultural institutions and organizations.

The Contracting Parties undertake to ensure scholars, specialists and students of the other Contracting Party access to the museums, collections, archives, libraries and other cultural institutions within the limits of their existing laws and regulations.

ARTICLE 4

The Contracting Parties shall encourage mutual acquaintance of their nations with the culture each other through such measures as will be agreed upon in the periodical programmes mentioned in article 10.

ARTICLE 5

The Contracting Parties shall encourage the exchange of teaching materials - including school textbooks and audio visual materials, having in mind the possibility of promoting mutual knowledge and facilitating the presentation of the other Contracting Party in such books and materials - as well as the exchange of information on technical innovations in the field of education.

ARTICLE 6

The Contracting Parties shall encourage cooperations between sports and youth organizations.

ARTICLE 7

The Contracting Parties shall encourage cooperation in the fields of press, radio and television.

For this purpose, the Contracting Parties shall, within their possibilities and competence, encourage:

a) Visits by journalists for the purpose of improving mutual knowledge of the cultural realities of each country and their peoples;

b) Cooperation between the appropriate bodies concerning information about the existing mass media in both countries.

ARTICLE 8

The Contracting Parties shall, within the terms of their laws and regulations in force, grant to each other every reasonable facility for the entry, residence and departure of persons, and for the import of the material and equipment necessary for carrying out the programmes or exchange which may be established in accordance with this Agreement.

ARTICLE 9

The Contracting Parties shall, in accordance with the terms of their laws and regulations in force and the international agreements to which they are parties cooperate in the control and prevention of illicit export and import of their cultural property.

ARTICLE 10

The representatives of the Contracting Parties shall hold meetings in order to work out periodical programmes and to review the implementation of this Agreement. These meetings shall be held on the proposal of either Contracting Party at a place and at a time they agree upon.

ARTICLE 11

This Agreement shall enter into force thirty days that the Contracting Parties have notified each other that the constitutional requirements for the entry into force of this Agreement have been complied with.

ARTICLE 12

This Agreement shall remain in force for a period of five years. It shall there after be automatically renewed for one year at a time unless denounced in writing through diplomatic channels by either Contracting Party six months before the expiry of any one period.

ACORDO CULTURAL ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E O GOVERNO DA REPÚBLICA DA FINLÂNDIA

O Governo da República Portuguesa e o Governo da República da Finlândia.

Desejando manter e fortalecer os laços de amizade existentes entre os dois países e promover e desenvolver a cooperação cultural, de comunicação social, educacional e científica,

acordaram o seguinte:

ARTIGO 1.º

As Partes Contratantes encorajarão a cooperação nos domínios da educação, ciência e cultura entre os dois países.

Neste sentido, e no âmbito das suas possibilidades e competências, as Partes Contratantes encorajarão:

a) Visitas de professores universitários e outras individualidades que se dediquem à investigação científica, como por exemplo professores convidados e investigadores;

b) A participação de bolseiros-investigadores («research scholars»), professores e especialistas nos domínios da arte e da cultura, bem como de delegações em seminários, colóquios e visitas a instituições adequadas do outro país;

c) A concessão de bolsas de estudo, de modo a permitir que nacionais de cada uma das Partes Contratantes possam seguir estudos de pós-graduação ou dedicar-se à investigação no outro país;

d) A promoção de estudos da língua e da literatura de cada uma das Partes Contratantes nas suas universidades ou outras instituições de educação.

ARTIGO 2.º

Cada uma das Partes Contratantes poderá criar, no território da outra, instituições culturais, tendo por objectivo os propósitos deste Acordo, desde que sejam observadas as leis e regulamentos do outro país.

ARTIGO 3.º

Tendo em vista os objectivos deste Acordo, as Partes Contratantes encorajarão a estreita cooperação entre instituições e organizações científicas, educacionais, artísticas e culturais.

As Partes Contratantes assegurarão a investigadores («scholars»), especialistas e estudantes da outra Parte Contratante o acesso a museus, colecções, arquivos, bibliotecas e outras instituições culturais, dentro dos limites das leis e regulamentos em vigor.

ARTIGO 4.º

As Partes Contratantes estimularão o conhecimento mútuo da cultura de cada uma das nações através das medidas que vierem a ser acordadas nos programas periódicos mencionados no artigo 10.º

ARTIGO 5.º

As Partes Contratantes encorajarão a troca de publicações de carácter didáctico - incluindo livros escolares e material áudio-visual, com o objectivo de promover um conhecimento mútuo e de facilitar a apresentação da outra Parte Contratante nos livros e materiais supra -, assim como a troca de informações sobre inovações técnicas no domínio da educação.

ARTIGO 6.º

As Partes Contratantes encorajarão a cooperação entre organizações desportivas e de juventude.

ARTIGO 7.º

As Partes Contratantes encorajarão a cooperação no domínio da imprensa, rádio e televisão.

Tendo em vista este objectivo, as Partes Contratantes encorajarão, dentro das suas possibilidades e competências:

a) Visitas de jornalistas com o objectivo de aperfeiçoar o conhecimento mútuo das realidades culturais de cada país e seus povos;

b) Cooperação entre as entidades competentes no respeitante à informação sobre os órgãos de comunicação social existentes em ambos os países.

ARTIGO 8.º

As Partes Contratantes, de acordo com os preceitos das leis e regulamentos em vigor, concederão mutuamente as facilidades adequadas à entrada, residência e saída de pessoas, bem como à importação dos materiais e equipamentos necessários à realização dos programas ou intercâmbios que venham a ser estabelecidos através do presente Acordo.

ARTIGO 9.º

As Partes Contratantes, de acordo com as cláusulas das suas leis e regulamentos em vigor, e de acordo com os tratados internacionais de que fazem parte, cooperarão no controle e prevenção de exportações e importações ilegais do seu património cultural.

ARTIGO 10.º

Os representantes das Partes Contratantes manterão encontros para elaborarem programas periódicos e reverem a execução deste Acordo. Estes encontros serão efectuados mediante proposta de qualquer das Partes Contratantes, em local e hora que tenham combinado.

ARTIGO 11.º

O presente Acordo entrará em vigor trinta dias após ambas as Partes Contratantes terem notificado recíprocamente que se cumpriram os requisitos constitucionais para o efeito.

ARTIGO 12.º

O presente Acordo vigorará durante um período de cinco anos. Será automaticamente renovado por períodos sucessivos de um ano, caso nenhuma das Partes Contratantes o denuncie por escrito, por via diplomática, seis meses antes de expirar cada período.
