Desejando desenvolver as relações entre Portugal e Chipre, nomeadamente nas áreas da Educação, Ciência e Ensino Superior, Cultura, Juventude, Desporto e Comunicação Social;

Considerando que o intercâmbio nos referidos domínios contribuirá de forma essencial para o aprofundamento dos laços de amizade existentes entre Portugal e Chipre, para além de promover uma maior aproximação entre os dois povos:

Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo de Cooperação entre a República Portuguesa e a República do Chipre nas Áreas da Educação, Ciência e Ensino Superior, Cultura, Juventude, Desporto e Comunicação Social, assinado em Lisboa em 23 de Junho de 2004, cujo texto, nas versões autenticadas nas línguas portuguesa e inglesa, se publica em anexo.

ACORDO DE COOPERAÇÃO ENTRE A REPÚBLICA PORTUGUESA E A REPÚBLICA DO CHIPRE NAS ÁREAS DA EDUCAÇÃO, CIÊNCIA E ENSINO SUPERIOR, CULTURA, JUVENTUDE, DESPORTO E COMUNICAÇÃO SOCIAL.

A República Portuguesa e a República do Chipre, doravante designadas como Partes:

Desejando consolidar as relações de amizade entre os dois povos;
Com o objectivo de promover a cooperação nas áreas da educação, ciência e ensino superior, cultura, juventude, desporto e comunicação social entre os dois países;

acordam o seguinte:
Artigo 1.º
Domínios de cooperação
As Partes encorajarão e promoverão a cooperação entre si nas áreas da educação, ciência e ensino superior, cultura, juventude, desporto e comunicação social.

Artigo 2.º
Intercâmbio de documentação
As Partes procederão, na medida das suas possibilidades, ao intercâmbio de material informativo, designadamente livros, publicações e documentos, assim como de material áudio-visual sobre educação, ciência e ensino superior, cultura, juventude, desporto e comunicação social.

Artigo 3.º
Cooperação entre instituições
As Partes encorajarão o estabelecimento e desenvolvimento de relações de cooperação entre as autoridades, organizações e instituições competentes nos seus respectivos países, nas áreas da educação, ciência e ensino superior, cultura, juventude, desporto e comunicação social, mediante:

a) O intercâmbio de cientistas, professores, peritos, artistas, escritores e especialistas em todas as áreas previstas neste Acordo;

b) A concessão de bolsas de estudos de licenciatura, pós-graduação e investigação em universidades ou outras instituições de ensino superior;

c) A concessão de bolsas de curta duração para cursos especializados e de Verão.

Artigo 4.º
Reconhecimento de graus, títulos e outros certificados
1 - As Partes estabelecerão os métodos e condições em que cada uma delas reconhecerá a equivalência de estudos, dos respectivos certificados e dos diplomas dos ensinos básico e secundário.

2 - As Partes incentivarão o intercâmbio de informação sobre o sistema do ensino superior, a fim de facilitar o reconhecimento de diplomas e graus emitidos pela outra Parte, de acordo com a legislação vigente sobre esta matéria.

Artigo 5.º
Participação em manifestações culturais
Cada uma das Partes facilitará a participação de representantes ou delegações da outra Parte em congressos, conferências, seminários e outras manifestações culturais no âmbito deste Acordo organizadas no respectivo país.

Artigo 6.º
Apoio à tradução e edição
1 - As Partes promoverão o estudo das suas respectivas línguas e encorajarão o conhecimento da história, da literatura, da arte e de outras áreas da cultura dos dois países.

2 - Para os fins mencionados no número anterior, as Partes encorajarão a tradução e a edição de livros publicados nos respectivos países.

Artigo 7.º
Cooperação entre arquivos nacionais e bibliotecas nacionais
1 - As Partes facilitarão a cooperação e a troca de informações bem como o intercâmbio de reproduções de documentos e bibliografias, entre os arquivos nacionais e as bibliotecas nacionais dos dois países, de acordo com a respectiva legislação em vigor.

2 - As Partes facilitarão, igualmente, o acesso de investigadores às referidas instituições.

Artigo 8.º
Cooperação na área da arqueologia
As Partes encorajarão a cooperação no domínio da investigação arqueológica e de escavações, bem como a preservação e o restauro do seu património cultural, nomeadamente monumentos históricos, obras de arte e manuscritos.

Artigo 9.º
Cooperação nas áreas de cinema, áudio-visual e multimédia
As Partes promoverão a cooperação nos domínios de cinema, áudio-visual e multimédia, através de intercâmbio e organização de actividades nestas áreas.

Artigo 10.º
Exposições e festivais
As Partes encorajarão o intercâmbio de exposições, grupos de música, teatro, dança e folclore, bem como a participação de artistas em festivais internacionais que se realizem nos respectivos países.

Artigo 11.º
Tráfico ilegal de obras de arte
As Partes assegurarão a adopção de medidas para proibir e punir o tráfico ilegal de obras de arte, documentos e outros objectos de valor histórico ou arqueológico.

Artigo 12.º
Importação de material para fins não comerciais
As Partes deverão, em conformidade com a legislação em vigor no seu território, facilitar a entrada e subsequente reexportação para a outra Parte de material importado para fins não comerciais no âmbito do presente Acordo.

Artigo 13.º
Cooperação na área da juventude
1 - As Partes apoiarão e encorajarão a cooperação entre organizações juvenis dos respectivos países através da troca de informação e documentação com o objectivo de aprofundar o conhecimento da realidade juvenil de cada um dos países.

2 - As Partes encorajarão, ainda, o desenvolvimento de actividades conjuntas, bem como o contacto directo entre jovens.

Artigo 14.º
Cooperação na área do desporto
As Partes encorajarão a cooperação entre as organizações desportivas governamentais e não governamentais, promovendo o intercâmbio ao nível da participação e da formação desportiva.

Artigo 15.º
Cooperação na área da comunicação social
As Partes apoiarão o intercâmbio de programas e gravações de carácter musical, educacional, cultural e científico representativos da história e da cultura de ambos os países entre as suas estações de rádio e de televisão, em particular as que prosseguem missões de serviço público, e encorajarão os contactos directos entre as referidas estações, através do intercâmbio de visitas de jornalistas e especialistas de ambos os países.

Artigo 16.º
Cooperação no âmbito de organizações internacionais
As Partes reforçarão as relações existentes entre as comissões nacionais para a UNESCO, bem como entre as delegações dos seus respectivos países em organizações e organismos internacionais de carácter educacional, científico e cultural.

Artigo 17.º
Outras formas de cooperação
O presente Acordo não exclui outras formas de cooperação nos domínios cultural, educacional e científico que as Partes decidam concretizar.

Artigo 18.º
Comissão mista
1 - As Partes, a fim de implementar o presente Acordo, prepararão programas de cooperação, válidos por um período de três anos, que estabeleçam as formas detalhadas de cooperação e intercâmbio.

2 - Os programas de cooperação serão negociados por uma comissão mista que reunirá alternadamente em cada um dos países.

Artigo 19.º
Entrada em vigor
O presente Acordo entrará em vigor 30 dias após a data da recepção da última notificação por via diplomática de que foram cumpridos todos os requisitos de direito interno das Partes necessários para o efeito.

Artigo 20.º
Vigência e denúncia
1 - O presente Acordo vigorará por um período de cinco anos, sendo automaticamente prorrogado por iguais períodos, salvo se qualquer das Partes o denunciar, por escrito e por via diplomática, com uma antecedência mínima de seis meses relativamente ao termo do respectivo período de vigência.

2 - Em caso de denúncia, qualquer programa de intercâmbio, plano ou projecto, iniciado na vigência do presente Acordo permanecerá em execução até à sua conclusão.

Em fé do que, os abaixo assinados, estando devidamente autorizados, assinam o presente Acordo.

Assinado em Lisboa, em 23 de Junho de 2004, em dois originais, em língua portuguesa e inglesa, fazendo ambos os textos igualmente fé.

COOPERATION AGREEMENT BETWEEN THE PORTUGUESE REPUBLIC AND THE REPUBLIC OF CYPRUS IN THE FIELDS OF EDUCATION, SCIENCE AND HIGHER EDUCATION, CULTURE, YOUTH, SPORTS AND MEDIA.

The Portuguese Republic and the Republic of Cyprus, hereafter referred to as the "Parties»:

Desiring to consolidate the friendly relations between their two peoples;
Wishing to promote cooperation in the fields of education, science and higher education, culture, youth, sports and media between the two countries;

agree as follows:
Article 1
Cooperation scope
The Parties shall encourage and promote the cooperation between them in the fields of education, science and higher education, culture, youth, sports and media.

Article 2
Exchange of informative material
The Parties shall, according to their possibilities, exchange informative material such as books, printed material and documents, as well as audiovisual aids, concerning education, science and higher education, culture, youth, sports and media.

Article 3
Cooperation between institutions
The Parties shall encourage the establishment and development of the cooperation between the competent authorities, organizations and institutions of their respective countries, in the fields of education, science and higher education, culture, youth, sports and media, through:

a) Exchange of scientists, teachers, experts, artists, writers, in all the fields covered by this Agreement;

b) Grant of scholarships for graduate, postgraduate studies and research in universities and other higher education institutions;

c) Grant of short period scholarships for special and summer courses.
Article 4
Recognition of degrees, diplomas and other certificates
1 - The Parties shall determine the methods and conditions whereby each of them may recognise the equivalence of studies of their respective certificates and diplomas of basic and secondary education.

2 - The Parties shall incentive the exchange of information about higher education systems, in order to facilitate the recognition of diplomas and degrees, issued by the other Party, in accordance with their respective legislation in this field.

Article 5
Participation in cultural events
Either Party shall facilitate the participation of representatives or delegations from the other Party in the international congresses, conferences, seminars and other manifestations related to this Agreement, which take place in their respective countries.

Article 6
Translation and edition
1 - The Parties shall promote the study of their respective languages and to encourage the knowledge of their history, literature, arts and other fields of culture of the two countries.

2 - For the purposes of no. 1 of this article, the Parties shall encourage the translation and publication of books published in their countries.

Article 7
Cooperation between national archives and national libraries
1 - The Parties shall facilitate cooperation and exchange of information as well as the exchange of reproductions of documents and bibliographies between the national archives and national libraries of the two countries, in accordance with their respective legislation.

2 - The Parties shall also facilitate the access of researches to the said institutions.

Article 8
Cooperation in the field of archaeology
The Parties shall encourage collaboration in the field of archaeological research and excavations, as well as in the field of preservation and restoration of their cultural heritage, such as historical monuments, works of art and manuscripts.

Article 9
Cooperation in the fields of cinema, audiovisual and multimedia
The Parties shall promote the cooperation in the fields of cinema, audiovisual and multimedia, through the exchange and organization of activities in these areas.

Article 10
Exhibitions and festivals
The Parties shall encourage the exchange of art exhibitions, musical, theatre, dance and folklore groups, as well as the participation of artists in international festivals held in their respective countries.

Article 11
Safeguard of national cultural heritage
The Parties shall ensure that measures to forbid and punish illegal trafficking in works of art, documents and other objects of historic or archaeological value are adopted.

Article 12
Importation and re-exportation of non-commercial material
The Parties shall facilitate, in accordance of their respective legislation, the entry and subsequent re-exportation to the other Party of material for non-commercial purposes, in conformity with the objectives of this Agreement.

Article 13
Cooperation in the field of youth
1 - The Parties shall support and encourage the co-operation in the youth area, namely by the exchange of information and documentation, with the aim of deepening the knowledge of the youth realities in the two countries.

2 - The Parties shall also encourage the development of joint activities and the direct contact between young people.

Article 14
Cooperation in the field of sport
The Parties shall encourage cooperation between sports governmental and non governmental organizations, promoting the exchange in the level of participation and sport training.

Article 15
Cooperation in the field of media
The Parties shall support the interchange of musical, educational, cultural and scientific programs and tapes representative of their history and culture between their radio and television stations, in particular those which follow public service missions, and to encourage the direct contact between them, through the exchange of journalists and experts in this field.

Article 16
Cooperation in international organizations
The Parties shall strengthen the existing relations between their national commissions for the UNESCO, as well as those relations between their delegations in international organizations of cultural, educational and scientific character.

Article 17
Other forms of cooperation
The present Agreement does not exclude other forms of cooperation in the fields of education, science and culture that the parties may agree to pursue.

Article 18
Joint commission
1 - In order to implement the present Agreement, the Parties shall prepare programs of cooperation, valid for a period of three years, setting forth the detailed forms of cooperation and exchange.

2 - The programs of cooperation shall be negotiated by a mixed commission which shall meet alternately in Cyprus and Portugal.

Article 19
Entry into force
This Agreement shall enter into force 30 days after the last notification in writing is received, through the diplomatic channels, informing that all the internal legal procedures required for the purpose have been fulfilled.

Article 20
Duration and denunciation
1 - This Agreement shall remain in force for a period of five years and shall continue automatically in force for subsequent equal periods if none of the Parties denounces it, in writing and through diplomatic channels, at least six months before the date of expiry of each period.

2 - In case of denunciation of the present Agreement, any exchange program, plan or project initiated within its validity shall remain in execution until its conclusion.

In witness whereof, the undersigned, being duly authorised, have signed the present Agreement.

Done at Lisbon, on the 23th of June of 2004, in the Portuguese and English languages, both texts being equally authentic.
