Considerando as boas relações existentes entre a República Portuguesa e a Roménia;

Considerando o interesse de ambas as partes em prevenir o trabalho irregular de estrangeiros;

Considerando primordial desenvolver a cooperação por forma a garantir uma boa aplicação das disposições internacionais sobre trabalho de estrangeiros:

Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre o Governo da República Portuguesa e o Governo da Roménia sobre a Permanência Temporária de Cidadãos Romenos para a Prestação de Trabalho em Portugal, assinado em Lisboa em 19 de Julho de 2001, cujo texto, nas versões autenticadas nas línguas portuguesa, romena e inglesa, se publica em anexo.

ACORDO ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E O GOVERNO DA ROMÉNIA SOBRE A PERMANÊNCIA TEMPORÁRIA DE CIDADÃOS ROMENOS PARA A PRESTAÇÃO DE TRABALHO EM PORTUGAL.

O Governo da República Portuguesa e o Governo da Roménia, adiante designados como Partes, desejosos de ampliar e fortalecer as relações de amizade e cooperação entre ambos os países, interessados em estabelecer regras e princípios que facilitem a permanência temporária de trabalhadores romenos no território da República Portuguesa com vista ao exercício de actividades profissionais, decidem celebrar o presente Acordo:

Artigo 1.º
Âmbito de aplicação
O presente Acordo aplica-se a cidadãos romenos que, mediante contratos preestabelecidos e devidamente depositados nos serviços competentes do Ministério do Trabalho e da Solidariedade da República Portuguesa, se deslocam a Portugal por períodos limitados de tempo para desenvolverem a sua actividade profissional como trabalhadores por conta de outrem.

Artigo 2.º
Cooperação entre autoridades nacionais
O Instituto do Emprego e Formação Profissional (IEFP) da República Portuguesa e o Ministério do Trabalho e Solidariedade Social da Roménia articulam-se directamente, no âmbito do presente Acordo, tendo em vista a troca de informações sobre as oportunidades de trabalho e os sectores de actividade em que as mesmas existem, as disponibilidades de mão-de-obra e a definição de critérios técnicos comuns no que respeita à classificação das actividades profissionais e ao respectivo conteúdo funcional.

Artigo 3.º
Cooperação com outras organizações
As Partes acordam em solicitar a cooperação da Organização Internacional para as Migrações na aplicação do presente Acordo.

Artigo 4.º
Processo de selecção
1 - As entidades empregadoras portuguesas interessadas em contratar trabalhadores romenos, nos termos do presente Acordo, comunicarão o seu interesse ao IEFP mediante a apresentação de uma oferta de emprego e da respectiva proposta de contrato de trabalho.

2 - As ofertas de emprego, além das indicações previstas na legislação laboral portuguesa aplicável, devem conter:

a) O perfil profissional dos postos de trabalho;
b) As qualificações profissionais exigidas aos trabalhadores;
c) A experiência profissional requerida;
d) Termo de responsabilidade da entidade empregadora especificando o tipo e o regime legal do local de alojamento;

e) Os benefícios a que, em matéria de segurança social, tenham direito, em conformidade com a legislação portuguesa;

f) A responsabilidade pelo pagamento da viagem entre a Roménia e a República Portuguesa.

3 - O IEFP, depois de obtido o parecer da Inspecção-Geral do Trabalho (IGT) sobre as propostas de contrato, envia-as à Embaixada de Portugal na Roménia.

4 - A Embaixada de Portugal na Roménia envia as ofertas de emprego e as propostas de contrato à Direcção-Geral de Emprego do Ministério do Trabalho e Solidariedade Social da Roménia.

5 - A Direcção-Geral de Emprego do Ministério do Trabalho e Solidariedade Social da Roménia remete as ofertas de emprego à Agência Nacional de Emprego da Roménia.

6 - A Agência Nacional de Emprego, através das suas agências locais, selecciona os trabalhadores romenos de acordo com os requisitos das ofertas de emprego e certifica-se de que os mencionados trabalhadores reúnem as condições referidas nas alíneas a), b) e d) do n.º 1 do artigo 5.º

7 - Após a selecção, a Agência Nacional de Emprego envia a lista dos trabalhadores seleccionados à Direcção-Geral de Emprego do Ministério do Trabalho e Solidariedade Social da Roménia.

8 - A Direcção-Geral de Emprego do Ministério do Trabalho e Solidariedade Social da Roménia apresenta a lista dos trabalhadores seleccionados à Embaixada de Portugal na Roménia.

Artigo 5.º
Processo de recrutamento
1 - Depois de receber a lista dos trabalhadores seleccionados pelas autoridades romenas, a Embaixada de Portugal na Roménia verifica se os candidatos:

a) Possuem o perfil profissional exigido para o trabalho a desempenhar;
b) Não foram punidos pela prática de um ilícito criminal;
c) Não estão indicados na lista nacional nem na lista comum de pessoas não admissíveis do Sistema de Informações Schengen;

d) Possuem exame médico de robustez física comprovativo da aptidão para exercer a profissão a que se candidatam.

2 - A Embaixada de Portugal na Roménia organiza o processo de recrutamento, competindo-lhe, designadamente:

a) Entrevistar os trabalhadores seleccionados;
b) Solicitar ao IEFP que confirme junto da entidade empregadora o interesse na contratação do trabalhador, bem como a data do início do contrato de trabalho;

c) Enviar ao IEFP um duplicado do contrato de trabalho já assinado pelo trabalhador. O IEFP remeterá cópia à IGT;

d) Enviar a lista nominativa dos trabalhadores romenos recrutados ao IEFP e ao Ministério do Trabalho e Solidariedade Social da Roménia, após a confirmação referida na alínea b) deste número;

e) Emitir um visto de trabalho após parecer favorável do Serviço de Estrangeiros e Fronteiras da República Portuguesa.

Artigo 6.º
Condições de entrada
1 - O Ministério dos Negócios Estrangeiros da República Portuguesa emitirá um visto de trabalho cuja validade corresponde à da duração do contrato, salvo se esta for superior a um ano, caso em que este será o período de validade do visto.

2 - O trabalhador receberá um guia contendo informações gerais sobre as condições de vida e de trabalho no território da República Portuguesa.

Artigo 7.º
Condições da estada
1 - Os trabalhadores romenos têm a obrigação de se apresentar ao Serviço de Estrangeiros e Fronteiras no prazo de três dias úteis após a sua chegada ao local de residência no território da República Portuguesa.

2 - Os trabalhadores romenos que trabalham no território da República Portuguesa ao abrigo do presente Acordo ficam sujeitos à legislação portuguesa sobre entrada, permanência, saída e afastamento de cidadãos estrangeiros do território nacional.

3 - Após a apresentação do trabalhador, a entidade empregadora deve promover o depósito do contrato de trabalho nos termos da lei portuguesa.

4 - Os trabalhadores romenos que desejem permanecer no território da República Portuguesa por um período superior ao permitido pelo visto de que são titulares podem requerer a prorrogação da permanência ou uma autorização de permanência, desde que se verifiquem os pressupostos legais para a respectiva concessão.

Artigo 8.º
Condições gerais de trabalho
1 - Os trabalhadores romenos usufruirão, no território da República Portuguesa, das mesmas condições de remuneração e de trabalho que estão em vigor para os trabalhadores portugueses, por força das disposições legais, dos instrumentos colectivos de trabalho e dos usos profissionais e locais, bem como dos benefícios da segurança social estabelecidos pela legislação portuguesa.

2 - Os trabalhadores romenos gozarão igualmente dos mesmos direitos e da mesma protecção de que gozam os cidadãos portugueses no que concerne à aplicação das leis relativas à higiene e à segurança no trabalho.

3 - As autoridades portuguesas velarão pela aplicação do disposto nos n.os 1 e 2 do presente artigo.

4 - Cabe à entidade empregadora assumir os encargos com a estada no território da República Portuguesa e o regresso à Roménia dos trabalhadores que, por razões imputáveis àquela entidade, não venham a ocupar o posto de trabalho para o qual foram contratados.

Artigo 9.º
Entrada em vigor e modificação do Acordo
1 - O presente Acordo entrará em vigor no 10.º dia após a data da última notificação em que uma das Partes informa a outra do cumprimento das formalidades exigidas pela respectiva ordem jurídica interna.

2 - O presente Acordo poderá ser alterado por mútuo consentimento. As alterações entrarão em vigor de acordo com os procedimentos consignados no n.º 1 deste artigo.

Artigo 10.º
Duração e termo do Acordo
1 - O presente Acordo é celebrado por um período de cinco anos, prorrogável por períodos sucessivos de igual duração, se nenhuma das partes o denunciar.

2 - Cada uma das Partes pode denunciar o presente Acordo mediante notificação escrita à outra Parte no prazo de 90 dias antes do termo do período de validade inicialmente estabelecido. Neste caso, o presente Acordo deixará de vigorar no 90.º dia a contar da data daquela notificação.

3 - No caso de denúncia do presente Acordo, não serão afectados os direitos adquiridos durante a sua vigência.

Assinado em Lisboa no dia 19 de Julho de 2001, em duas cópias originais, nas línguas portuguesa, romena e inglesa, todos os textos fazendo igualmente fé. Em caso de divergência de interpretação, prevalecerá a versão inglesa.

AGREEMENT BETWEEN THE GOVERNMENT OF THE PORTUGUESE REPUBLIC AND THE GOVERNMENT OF ROMANIA ON THE TEMPORARY STAY FOR EMPLOYMENT PURPOSES OF ROMANIAN WORKERS ON THE TERRITORY OF THE PORTUGUESE REPUBLIC.

The Government of the Portuguese Republic and the Government of Romania, hereinafter referred to as the Parties, desirous of increasing and strengthening the friendship and co-operation between both countries, interested in establishing rules and principles that will facilitate the temporary stay for employment purposes of the Romanian workers on the territory of the Portuguese Republic, decided to conclude the present Agreement.

Article 1
Scope of the Agreement
The present Agreement applies to Romanian citizens who, provided with work contracts previously concluded and deposited with the competent services of the Ministry of Labour and Solidarity of the Portuguese Republic, come to the Portuguese Republic for limited periods of time to carry out their professional activity as contracted workers.

Article 2
Co-operation between national authorities
The Employment and Professional Training Institute (IEFP) of the Portuguese Republic and the Ministry of Labour and Social Solidarity of Romania shall cooperate directly, within the scope of the present Agreement, in view of exchanging information on job opportunities and the areas of activity where they exist, the labour force available as well as in view of defining common technical criteria of classifying professional activities and their functional content.

Article 3
Co-operation with other organisations
The Parties agree upon the co-operation with the International Migration Organisation for the application of the present Agreement.

Article 4
Selection process
1 - The Portuguese employers interested in hiring Romanian workers under the terms of the present Agreement shall convey their interest to the IEFP making a job offer and presenting a proposal of work contract.

2 - The job offers, besides complying with the according Portuguese legislation, must include:

a) The professional profile of the job;
b) The professional qualifications required to the workers;
c) The required professional experience;
d) A written statement of the employer defining the type and legal regime of the local housing;

e) The social security benefits to which the workers are entitled, according to the Portuguese legislation;

f) The responsibility for the payment of the journey between Romania and the Portuguese Republic.

3 - The IEFP, after having obtained the approval of the General Labour Inspectorate (IGT) on the work contract proposals, shall send them to the Portuguese Embassy in Romania.

4 - The Portuguese Embassy in Romania shall send the job offers and the work contract proposals to the Directorate General of Employment within the Ministry of Labour and Social Solidarity of Romania.

5 - The Directorate General of Employment within the Ministry of Labour and Social Solidarity of Romania shall send the job offers to the National Employment Agency of Romania.

6 - The National Employment Agency, through its local agencies, shall select the Romanian workers in accordance with the requirements of the job offers and will make sure that they observe the conditions referred to in article 5, paragraph 1, letters a), b) and d).

7 - After selection, the National Employment Agency shall send the list of the selected workers to the Directorate General of Employment within the Ministry of Labour and Social Solidarity of Romania.

8 - The Directorate General of Employment within the Ministry of Labour and Social solidarity of Romania shall submit the list of selected workers to the Portuguese Embassy in Romania.

Article 5
Recruitment process
1 - After receiving the list of workers selected by the Romanian authorities, the Portuguese Embassy in Romania shall verify that they fulfil the following conditions:

a) Possess the professional profile required for the job;
b) Not have been punished for a criminal offence;
c) Not be indicated on the national list or on the common list of non admissible persons of the Schengen Information System;

d) Possess a medical certificate asserting that they have the necessary physical aptitude for the job.

2 - The Portuguese Embassy in Romania shall organise the recruitment process, as follows:

a) Interview the selected workers;
b) Demand the IEFP for confirmation of the employer's interest in contracting the worker, as well as the date of the beginning of the work contract;

c) Send the IEFP a copy of the work contract signed by the worker. The IEFP shall send a copy to the IGT;

d) Send a nominal list of the recruited Romanian workers to the IEFP and to the Ministry of Labour and Social Solidarity of Romania, after having obtained the confirmation mentioned under letter b) of this paragraph;

e) Issue a work visa upon approval by the Service of Foreigners and Borders of the Portuguese Republic.

Article 6
Conditions of entry
1 - The Ministry of Foreign Affairs of the Portuguese Republic shall issue a work visa the period of validity of which corresponds to that of the work contract, unless the duration of the contract is longer than one year, in which case the work visa shall be issued for a period of one year.

2 - The worker shall receive a guide containing general information about the living and working conditions on the territory of the Portuguese Republic.

Article 7
Conditions of stay
1 - The Romanian workers must present themselves to the Service of Foreigners and Borders of the Portuguese Republic within three working days after their arrival at their place of residence on the territory of the Portuguese Republic.

2 - The Romanian workers who work on the territory of the Portuguese Republic under the terms of the present Agreement are subjected to the Portuguese legislation on entry to, stay on, exit and removal from national territory of foreign citizens.

3 - After the Romanian workers have presented themselves to the employer, the latter must deposit the work contract under the terms of the national legislation.

4 - The Romanian workers who wish to remain on the territory of the Portuguese Republic for a period of time longer than the one allowed by the visa they possess, may apply for an extension of their stay or for a stay permit, as long as they fulfil the legal conditions required for that purpose.

Article 8
General working conditions
1 - The Romanian workers on the territory of the Portuguese Republic shall be entitled to the same remuneration and working conditions in force for the Portuguese workers, according to the national legislation, collective labour instruments, local and professional practices, as well as to social security benefits provided for by the Portuguese legislation.

2 - The Romanian workers shall also benefit from the same rights and protection to which Portuguese citizens are entitled to, as regards the application of the legislation on health and safety at work.

3 - The Portuguese authorities shall guarantee the application of the provisions stipulated in paragraphs 1 and 2 of the present article.

4 - The employer shall bear the charges of both the stay on the territory of the Portuguese Republic and the return to Romania of workers who, for reasons attributable to the employer, did not assume the job for which they had been contracted for.

Article 9
Entry into force and modification of the Agreement
1 - The present Agreement shall enter into force on the 10th day following the date of delivery of the last notification by which the Parties inform each other that all the internal requirements necessary for the entry into force of the present Agreement have been met.

2 - The present Agreement can be amended by way of consultations between the Parties. The amendments shall enter into force in accordance with the procedure set forth in paragraph 1 of this article.

Article 10
Duration and termination of the Agreement
1 - The present Agreement is celebrated for a period of five years, renewable for successive equal periods, if none of the Parties denounces it.

2 - Each Party may denounce the present Agreement by a written notification to the other Party within 90 days prior to the end of the period of validity initially established. In this case, the present Agreement shall cease to be valid on the ninetieth day following the date when the written notification has been delivered to the other Party.

3 - In case of denunciation of the present Agreement, all rights acquired under its provisions shall be maintained.

Done at Lisbon on the 19th of July 2001, in two original copies, each in the Portuguese, Romanian and English languages, all texts being equally authentic. In case of differences of interpretation, the English text shall prevail.
