Por ordem superior se torna público o texto das Resoluções n.º 713 e 724 do Conselho de Segurança da Organização das Nações Unidas, e a respectiva tradução para português, sobre o embargo geral de fornecimento de armas e equipamento militar à Jugoslávia, adoptadas, respectivamente, em 5 de Setembro e 14 de Dezembro de 1991.

RESOLUTION 713 (1991)
(Adopted by the Security Council at its 3009th meeting, on 25 September 1991)
The Security Council:
Conscious of the fact that Yugoslavia has welcomed the convening of a Security Council meeting through a letter conveyed by the permanent representative of Yugoslavia to the President of the Security Council (S/23069);

Having heard the statement by the Foreign Minister of Yugoslavia;
Deeply concerned by the fighting in Yugoslavia which is causing a heavy loss of human life and material damage, and by the consequences for the countries of the region, in particular in the border areas o neighbouring countries;

Concerned that the continuation of this situation constitutes a threat to international peace and security;

Recalling its primary responsibility under the Charter of the United Nations for the maintenance of international peace and security;

Recalling also the provisions of chapter VIII of the Charter of the United Nations;

Commending the efforts undertaken by the European Community and its member States, with the support of the States participating in the Conference on Security and Cooperation in Europe, to restore peace and dialogue in Yugoslavia, through, inter alia, the implementation of a cease-fire including the sending of observers, the convening of a Conference on Yugoslavia, including the mechanisms set forth within it, and the suspension of the delivery of all weapons and military equipment to Yugoslavia;

Recalling the relevant principles enshrined in the Charter of the United Nations and, in this context, noting the declaration of 3 September 1991 of the States participating in the Conference on Security and Cooperation in Europe that no territorial gains or changes within Yugoslavia brought about by violence are acceptable;

Noting also the agreement for a cease-fire concluded on 17 September 1991 in Igalo, and also that signed on 22 September 1991;

Alarmed by the violations of the cease-fire and the continuation of the fighting;

Taking note of the letter dated 19 September 1991 to the President of the Security Council from the permanent representative of Austria (S/23052);

Taking note also of the letters dated 19 September 1991 and 20 September 1991 to the President of the Security Council from respectively the permanent representative of Canada (S/23053) and the permanent representative of Hungary (S/23057);

Taking note also of the letters dated 5 July 1991 (S/22775), 12 July 1991 (S/22785), 22 July 1991 (S/22834), 6 August 1991 (S/22898), 7 August 1991 (S/22902), 7 August 1991 (S/22903), 21 August 1991 (S/22975), 29 August 1991 (S/22991), 4 September 1991 (S/23010), 19 September 1991 (S/23047), 20 September 1991 (S/23059) and 20 September 1991 (S/23060), from respectively the permanent representative of the Netherlands, the permanent representative of Czechoslovakia, the permanent representatives of Belgium, France and the United Kingdom of Great Britain and Northern Ireland, the charge d'affaires a. i. of Austria, and the permanent representative of Australia:

1 - Expresses its full support for the collective efforts for peace and dialogue in Yugoslavia undertaken under the auspices of the member States of the European Community with the support of the States participating in the Conference on Security and Cooperation in Europe consistent with the principles of that Conference.

2 - Supports fully all arrangements and measures resulting from such collective efforts as those described above, in particular of assistance and support to the cease-fire observers, to consolidate an effective end to hostilities in Yugoslavia and the smooth functioning of the process instituted within the framework of the Conference on Yugoslavia.

3 - Invites to this end the Secretary-General to offer his assistance without delay, in consultation with the Government of Yugoslavia and all those promoting the efforts referred to above, and to report as soon as possible to the Security Council.

4 - Strongly urges all parties to abide strictly by the cease-fire agreements of 17 September 1991 and 22 September 1991.

5 - Appeals urgently to and encourages all parties to settle their disputes peacefully and through negotiation at the Conference on Yugoslavia, including through the mechanisms set forth within it.

6 - Decides, under chapter VII of the Charter of the United Nations, that all States shall, for the purposes of establishing peace and stability in Yugoslavia, immediately implement a general and complete embargo on all deliveries of weapons and military equipment to Yugoslavia until the Security Council decides otherwise following consultation between the Secretary-General and the Government of Yugoslavia.

7 - Calls on all States to refrain from any action which might contribute to increasing tension and to impeding or delaying a peaceful and negotiated outcome to the conflict in Yugoslavia, which would permit all Yugoslavs to decide upon and to construct their future in peace.

8 - Decides to remain seized of the matter until a peaceful solution is achieved.

RESOLUÇÃO 713, DE 25 DE SETEMBRO DE 1991
O Conselho de Segurança:
Consciente do facto de que a Jugoslávia acolheu favoravelmente a convocação da reunião do Conselho de Segurança através de carta veiculada pelo representante permanente da Jugoslávia ao Presidente do Conselho de Segurança (S/23069);

Tendo ouvido a declaração do Ministro dos Negócios Estrangeiros da Jugoslávia;
Profundamente preocupado com os combates na Jugoslávia, que têm causado graves perdas humanas e danos materiais, e com as consequências para os países da região, em particular nas áreas fronteiriças dos países vizinhos;

Preocupado com que a continuação desta situação constitua uma ameaça para a paz e segurança internacionais;

Recordando a sua responsabilidade fundamental, segundo a Carta das Nações Unidas, pela manutenção da paz e segurança internacionais;

Recordando também os preceitos do capítulo VIII da Carta das Nações Unidas;
Louvando os esforços levados a cabo pelas Comunidades Europeias e seus Estados membros, com o apoio dos Estados participantes na Conferência sobre Segurança e Cooperação na Europa, para restaurar a paz e o diálogo na Jugoslávia, através, inter alia, da aplicação de um cessar-fogo incluindo o envio de observadores, da convocação de uma Conferência sobre a Jugoslávia, incluindo os mecanismos acordados no seio desta, e a suspensão do fornecimento de sotas as armas e equipamento militar para a Jugoslávia;

Recordando os princípios relevantes consagrado na Carta das Nações Unidas e, neste contexto, tomando nota da declaração dos Estados participantes na Conferência sobre Segurança e Cooperação na Europa de 3 de Setembro de 1991 de que os ganhos territoriais ou mudanças na Jugoslávia alcançados com recurso à violência são inaceitáveis;

Tomando também nota do acordo para um cessar-fogo concluído em Igalo em 17 de Setembro de 1991 e ainda do que foi assinado em 22 de Setembro de 1991;

Alarmado pela violação do cessar-fogo e pela continuação dos combates;
Tomando nota da carta endereçada ao Presidente do Conselho de Segurança pelo representante permanente da Áustria, datada de 19 de Setembro de 1991 (S/23052);

Tomando nota das cartas endereçadas ao Presidente do Conselho de Segurança por, respectivamente, o representante permanente do Canadá, de 19 de Setembro de 1991 (S/23053), e do representante permanente da Hungria, de 20 de Setembro de 1991 (S/23057);

Tomando ainda nota das cartas do representante permanente dos Países Baixos, do representante permanente da Checoslováquia, dos representantes permanentes da Bélgica, França e Reino Unido da Grã-Bretanha e Irlanda do Norte, do encarregado de negócios a. i. da Áustria e do representante permanente da Austrália, datadas, respectivamente, de 5 de Julho de 1991 (S/22775), 22 de Julho de 1991 (S/22785), 22 de Julho de 1991 (S/22834), 6 de Agosto de 1991 (S/22898), 7 de Agosto de 1991 (S/22902), 7 de Agosto de 1991 (S/22903), 21 de Agosto de 1991 (S/22975), 29 de Agosto de 1991 (S/22991), 4 de Setembro de 1991 (S/23010), 19 de Setembro de 1991 (S/23047), 20 de Setembro de 1991 (S/23059) e 20 de Setembro de 1991 (S/23060):

1 - Expressa o seu total apoio aos esforços colectivos para a paz e o diálogo na Jugoslávia empreendidos sob os auspícios dos Estados membros das Comunidades Europeias, com o apoio dos Estados participantes na Conferência sobre Cooperação e Segurança na Europa, em conformidade com os princípios desta Conferência.

2 - Apoia inteiramente todas as medidas resultantes de tais esforços colectivos, em particular de assistência e apoio aos observadores do cessar-fogo, para consolidar um termo efectivo para as hostilidades na Jugoslávia e o funcionamento eficaz do processo instituído no quadro da Conferência sobre a Jugoslávia.

3 - Convida, para este fim, o Secretário-Geral a oferecer a sua pronta assistência, em consulta com o Governo da Jugoslávia e com todos os promotores dos esforços atrás referidos, e a apresentar um relatório ao Conselho de Segurança no mais curto espaço de tempo possível.

4 - Exorta todas as partes a que respeitem rigorosamente os acordos de cessar-fogo de 17 de Setembro e de 22 de Setembro de 1991.

5 - Apela com urgência e encoraja todas as partes a que resolvam as suas disputas de forma pacífica e através do dialogo na Conferência sobre a Jugoslávia, inclusivamente por intermédio dos mecanismos por ela estabelecidos.

6 - Decide, nos termos do capítulo VII da Carta das Nações Unidas, que todos os Estados devem, com o propósito de implantar a paz e a estabilidade na Jugoslávia, aplicar de imediato um embargo geral e completo a todos os fornecimentos de armas e equipamento militar para a Jugoslávia, até que o Conselho de Segurança decida de outro modo, de acordo com as consultas entre o Secretário-Geral e o Governo da Jugoslávia.

7 - Solicita a todos os Estados que se abstenham de quaisquer actos que possam contribuir para um aumento da tensão e impedir ou atrasar um resultado pacífico e negociado para o conflito na Jugoslávia que permita aos Jugoslavos decidir e construir o seu futuro em paz.

8 - Decide manter o assunto sob consideração até que uma solução pacífica seja alcançada.

RESOLUTION 724
The Security Council:
Reaffirming its Resolutions 713 (1991), of 25 September 1991, and 721 (1991), of 27 November 1991;

Noting the report of the Secretary-General of 11 December 1991 (S/23280) submitted pursuant to Resolution 721 (1991);

Recalling its primary responsibility under the charter of the United Nations for the maintenance of international peace and security;

Recalling also the provisions of chapter VIII of the Charter of the United Nations;

Determined to ensure that the general and complete embargo on all deliveries of weapons and military equipment to Yugoslavia imposed by Resolution 713 (1991) is effectively applied;

Commending the initiatives taken by the Secretary-General in the humanitarian field:

1 - Approves the report of the Secretary-General of 11 December 1991 (S/23280) and expresses its appreciation to the Secretary-General for it.

2 - Endorses in particular the views expressed in paragraph 21 of the secretary-general's report that the conditions for establishing a peace-keeping operation in Yugoslavia still do not exist and in paragraph 24 that full compliance with the Geneva Agreement of 23 November 1991 would permit accelerated consideration of the question of establishing a United Nations peace-keeping operation in Yugoslavia.

3 - Concurs in particular with the secretary-general's observation that the international community is prepared to assist the Yugoslav peoples, if the conditions described in his report are met and, in that context, endorses his offer to send to Yugoslavia a small group of personnel, including military personnel, as part of the continuing mission of his personal envoy, to carry forward preparations for possible deployment of a peace-keeping operation.

4 - Underlines the view that the purpose of the deployment of any United Nations peace-keeping operation in Yugoslavia would be to enable all parties to settle their disputes peacefully, including through the processes of the Conference on Yugoslavia.

5 - Acting under chapter VII of the Charter of the United Nations:
a) Requests all States to report to the Secretary-General within 20 days on the measures they have instituted for meeting the obligations set out in paragraph 6 of Resolution 713 (1991) to implement a general and complete embargo on all deliveries of weapons and military equipment to Yugoslavia;

b) Decides to establish, in accordance with rule 28 of its Provisional Rules of Procedure, a Committee of the Security Council consisting of all the members of the Council, to undertake the following tasks and to report on its work to the Council with its observations and recommendations:

i) To examine the reports submitted pursuant to subparagraph a) above;
ii) To seek from all States further information regarding the action taken by them concerning the effective implementation of the embargo imposed by paragraph 6 of Resolution 713 (1991);

iii) To consider any information brought to its attention by States concerning violations of the embargo, and in that context to make recommendations to the Council on ways of increasing the effectiveness of the embargo;

iv) To recommend appropriate measures in response to violations of the general and complete embargo on all deliveries of weapons and military equipment to Yugoslavia and provide information on a regular basis to the Secretary-General for general distribution to member States;

c) Calls upon all States to cooperate fully with the Committee in the fulfilment of its tasks concerning the effective implementation of the provisions of paragraph 6 of Resolution 713 (1991);

d) Requests the Secretary-General to provide all necessary assistance to the Committe and to make the necessary arrangements in the Secretariat for this purpose.

6 - Undertakes to consider ways by which compliance with the commitments entered into by the parties may be achieved.

7 - Strongly urges all States and parties to refrain from any action which might contribute to increasing tension, to inhibiting the establishment of an effective cease-fire and to impeding or delaying a peaceful and negociated outcome to the conflict in Yugoslavia, which would permit all the peoples of Yugoslavia to decide upon and to construct their future in peace.

8 - Encourages the Secretary-General to pursue his humanitarian efforts in Yugoslavia, in liaison with the International Committee of the Red Cross, the United Nations High Commissioner for Refugees, UNICEF and other appropriate humanitarian organizations, to take urgent practical steps to tackle the critical needs of the people of Yugoslavia, including displaced persons and the most vulnerable groups affected by the conflict, to assist in the voluntary return of displaced persons to their homes.

9 - Decides to remain actively seized of the matter until a peaceful solution is achieved.

RESOLUÇÃO 724 (1991)
O Conselho de Segurança:
Reafirmando as suas Resoluções n.os 713 (1991), de 25 de Setembro 1991, e 721 (1991), de 27 Novembro 1991;

Notando o relatório do Secretário-Geral de 11 de Dezembro 1991 (S/23280), submetido na sequência da Resolução 721 (1991);

Relembrando a responsabilidade essencial segundo a Carta das Nações Unidas para a manutenção da paz e segurança internacionais;

Determinado a assegurar o cumprimento efectivo do embargo geral imposto pela Resolução 713 (1991) a todos os fornecimentos de armas e equipamento militar à Jugoslávia;

Acolhendo as iniciativas tomadas pelo Secretário-Geral no campo humanitário:
1 - Aprova o relatório do Secretário-Geral de 11 de Dezembro de 1991 (S/23280) e expressa por isso o seu apreço ao Secretário-Geral;

2 - Secunda em particular os pontos de vista expressos no § 21 do relatório do Secretário-Geral de que as condições para levar a cabo uma operação de paz na Jugoslávia não existem ainda e no § 24 de que o total cumprimento do Acordo de Genebra de 23 de Novembro de 1991 acelerará a criação de uma tal operação de paz.

3 - Acolhe em particular a observação do Secretário-Geral de que a comunidade internacional está preparada para prestar assistência aos povos da Jugoslávia, se as condições descritas no relatório foram alcançadas, e, nesse contexto, secunda a sua oferta de enviar para a Jugoslávia um pequeno grupo de pessoas, incluindo militares, como parte de uma missão contínua de envio de pessoas com vista à preparação da possível operação de paz.

4 - Sublinha a ideia de que o objectivo de deslocação de qualquer missão de paz das Nações Unidas à Jugoslávia visaria habilitar todas as partes a resolver de modo pacífico as suas disputas, inclusive através dos mecanismos da Conferência sobre a Jugoslávia.

5 - Agindo de acordo com o capítulo VII da Carta da Nações Unidas:
a) Solicita a todos os Estados que comuniquem ao Secretário-Geral dentro de 20 dias todas as medidas instituídas para o cumprimento das obrigações prescritas no § 6 da Resolução 713 (1991) com vista a pôr em prática um embargo geral e completo a todos os fornecimentos de armas e equipamento militar à Jugoslávia;

b) Decide estabelecer, de acordo com o preceito 28 das Regras Provisórias de Procedimento, um Comité do Conselho de Segurança composto de todos os membros do Conselho para promover as seguintes tarefas e comunicar os resultados ao Conselho com as suas observações e recomendações:

i) Examinar as comunicações entretanto submetidas de acordo com o precedente subparágrafo a);

ii) Procurar obter de todos os Estados informação suplementar sobre as acções por eles desenvolvidas quanto à aplicação do embargo imposto pelo § 6 da Resolução 713 (1991);

iii) Analisar quaisquer informações submetidas pelos Estados à sua consideração relativas a violações ao embargo e, nesse contexto, fazer recomendações ao Conselho sobre modos de reforçar o cumprimento do embargo;

iv) Recomendar as medidas apropria das em resposta às violações ao embargo geral e completo de quaisquer remessas de armas e equipamento militar à Jugoslávia e fornecer informação ao Secretário-Geral com regularidade para posterior distribuição pelos Estados membros;

c) Exorta todos os Estados a que cooperem totalmente com o Comité no cumprimento das suas funções relativas à efectiva aplacação dos preceitos do § 6 da Resolução 713 (1991);

d) Solicita ao Secretário-Geral que providencie a necessária assistência ao Comité e que proceda às correspondentes alterações no Secretariado para tal fim.

6 - Promove os meios pelos quais os compromissos assumidos pelas partes possam ser alcançados.

7 - Exorta ainda os Estados e as partes a que se abstenham de qualquer acção susceptível de aumentar a tensão, prejudicar o estabelecimento de um efectivo cessar-fogo ou impedir ou atrasar uma solução pacífica e negociada do conflito na Jugoslávia que possa permitir aos povos da Jugoslávia decidir e construir o seu futuro em paz.

8 - Encoraja o Secretário-Geral a prosseguir os seus esforços humanitários na Jugoslávia, em ligação com o Comité Internacional da Cruz Vermelha, Alto-Comissário das Nações Unidas para os Refugiados, a UNICEF e demais organizações humanitárias apropriadas a tomar medidas urgentes e práticas para ultrapassar as necessidades críticas do povo da Jugoslávia, incluindo refugiados e os grupos mais vulneráveis afectados pelo conflito, e assistir, no seu regresso voluntário, os desalojados.

9 - Decide manter sob consideração o assunto até ser alcançada uma solução de paz.
