Aprova a Convenção sobre o Direito Relativo à Utilização dos Cursos de Água Internacionais para Fins Diversos dos de Navegação, adoptada pela Assembleia Geral das Nações Unidas em 21 de Maio de 1997.

A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do artigo 166.º da Constituição, aprovar a Convenção sobre o Direito Relativo à Utilização dos Cursos de Água Internacionais para Fins Diversos dos de Navegação, adoptada pela Assembleia Geral das Nações Unidas em 21 de Maio de 1997, cujo texto, na versão autenticada em língua inglesa e respectiva tradução em língua portuguesa, se publica em anexo.

CONVENTION ON THE LAW OF THE NON-NAVIGATIONAL USES OF INTERNATIONAL WATERCOURSES, 1997

The Parties to the present Convention:
Conscious of the importance of international watercourses and the non-navigational uses thereof in many regions of the world;

Having in mind article 13, paragraph 1 (a), of the Charter of the United Nations, which provides that the General Assembly shall initiate studies and make recommendations for the purpose of encouraging the progressive development of international law and its codification;

Considering that successful codification and progressive development of rules of international law regarding non-navigational uses of international watercourses would assist in promoting and implementing the purposes and principles set forth in articles 1 and 2 of the Charter of the United Nations;

Taking into account the problems affecting many international watercourses resulting from, among other things, increasing demands and pollution;

Expressing the conviction that a framework convention will ensure the utilization, development, conservation, management and protection of international watercourses and the promotion of the optimal and sustainable utilization thereof for present and future generations;

Affirming the importance of international cooperation and good-neighbourliness in this field;

Aware of the special situation and needs of developing countries, recalling the principles and recommendations adopted by the United Nations Conferente on Environment and Development of 1992 in the Rio Declaration and Agenda 21;

Recalling also the existing bilateral and multilateral agreements regarding the non-navigational uses of international watercourses;

Mindful of the valuable contribution of international organizations, both governmental and non-governmental, to the codification and progressive development of international law in this field;

Appreciative of the work carried out by the International Law Commission on the law of the no-navigational uses of international watercourses;

Bearing in mind United Nations General Assembly resolution 49/52 of 9 December 1994;

have agreed as follows:
PART I
Introduction
Article 1
Scope of the present Convention
1 - The present Convention applies to uses of international watercourses and of their waters for purposes other than navigation and to measures of protection, preservation and management related to the uses of those watercourses and their waters.

2 - The uses of international watercourses for navigation is not within the scope of the present Convention except insofar as other uses affect navigation or are affected by navigation.

Article 2
Use of terms
For the purposes of the present Convention:
a) "Watercourse» means a system of surface waters and ground waters constituting by virtue of their physical relationship a unitary whole and normally flowing into a common terminus;

b) "International watercourse» means a watercourse, parts of which are situated in different States;

c) "Watercourse State» means a State Party to the present Convention in whose territory part of an international watercourse is situated, or a Party that is a regional economic integration organization, in the territory of one or more of whose Member States part of an internacional watercourse is situated;

d) "Regional economic integration organization» means an organization constituted by sovereign States of a given region, to which its member States have transferred competence in respect of matters governed by this Convention and which has been duly authorized in accordance with its internal procedures, to sign, ratify, accept, approve or accede to it.

Article 3
Watercourse agreements
1 - In the absence of an agreement to the contrary, nothing in the present Convention shall affect the rights or obligations of a watercourse State arising from agreements in force for it on the date on which it became a party to the present Convention.

2 - Notwithstanding the provisions of paragraph 1, parties to agreements referred to in paragraph 1 may, where necessary, consider harmonizing such agreements with the basic principles of the present Convention.

3 - Watercourse States may enter into one or more agreements, hereinafter referred to as "watercourse agreements», which apply and adjust the provisions of the present Convention to the characteristics and uses of a particular international watercourse or part thereof.

4 - Where a watercourse agreement is concluded between two or more watercourse States, it shall define the waters to which it applies. Such an agreement may be entered into with respect to an entire international watercourse or any part thereof or a particular project, programme or use except insofar as the agreement adversely affects, to a significant extent, the use by one or more other watercourse States of the waters of the watercourse, without their express consent.

5 - Where a watercourse State considers that adjustment and application of the provisions of the present Convention is required because of the characteristics and uses of a particular international watercourse, watercourse States shall consult with a view to negotiating in good faith for the purpose of concluding a watercourse agreement or agreements.

6 - Where some but not all watercourse States to a particular international watercourse are parties to an agreement, nothing in such agreement shall affect the rights or obligations under the present Convention of watercourse States that are not parties to such an agreement.

Article 4
Parties to watercourse agreements
1 - Every watercourse State is entitled to participate in the negotiation of and to become a party to any watercourse agreement that applies to the entire international watercourse, as well as to participate in any relevant consultations.

2 - A watercourse State whose use of an international watercourse may be affected to a significant extent by the implementation of a proposed watercourse agreement that applies only to a part of the watercourse or to a particular project, programme or use is entitled to participate in consultations on such an agreement and, where appropriate, in the negotiation thereof in good faith with a view to becoming a party thereto, to the extent that its use is thereby affected.

PART II
General principles
Article 5
Equitable and reasonable utilization and participation
1 - Watercourse States shall in their respective territories utilize an international watercourse in an equitable and reasonable manner. In particular, an international watercourse shall be used and developed by watercourse States with a view to attaining optimal and sustainable utilization thereof and benefits there from, taking into account the interests of the watercourse States concerned, consistent with adequate protection of the watercourse.

2 - Watercourse States shall participate in the use, development and protection of an international watercourse in an equitable and reasonable manner. Such participation includes both the right to utilize the watercourse and the duty to cooperate in the protection and development thereof, as provided in the present Convention.

Article 6
Factors relevant to equitable and reasonable utilization
1 - Utilization of an international watercourse in an equitable and reasonable manner within the meaning of article 5 requires taking into account all relevant factors and circumstances, including:

a) Geographic, hydrographic, hydrological, climatic, ecological and other factors of a natural character;

b) The social and economic needs of the watercourse States concerned;
c) The population dependent on the watercourse in each watercourse State;
d) The effects of the use or uses of the watercourses in one watercourse State on other watercourse States;

e) Existing and potential uses of the watercourse;
f) Conservation, protection, development and economy of use of the water resources of the watercourse and the costs of measures taken to that effect;

g) The availability of alternatives, of comparable value, to a particular planned or existing use.

2 - In the application of article 5 or paragraph 1 of this article, watercourse States concerned shall, when the need arises, enter into consultations in a spirit of cooperation.

3 - The weight to be given to each factor is to be determined by its importance in comparison with that of other relevant factors. In determining what is a reasonable and equitable use, all relevant factors are to be considered together and a conclusion reached on the basis of the whole.

Article 7
Obligation not to cause significant harm
1 - Watercourse States shall, in utilizing an international watercourse in their territories, take all appropriate measures to prevent the causing of significant harm to other watercourse States.

2 - Where significant harm nevertheless is caused to another watercourse State, the States whole use causes such harm shall, in the absence of agreement to such use, take all appropriate measures, having due regard for the provisions of articles 5 and 6, in consultation with the affected State, to eliminate or mitigate such harm and, where appropriate, to discuss the question of compensation.

Article 8
General obligation to cooperate
1 - Watercourse States shall cooperate on the basis of sovereign equality, territorial integrity, mutual benefit and good faith in order to attain optimal utilization and adequate protection of an international watercourse.

2 - In determining the manner of such cooperation, watercourse States may consider the establishment of joint mechanisms or commissions, as deemed necessary by them, to facilitate cooperation on relevant measures and procedures in the light of experience gained through cooperation in existing joint mechanisms and commissions in various regions.

Article 9
Regular exchange of data and information
1 - Pursuant to article 8, watercourse States shall on a regular basis exchange readily available data and information on the condition of the watercourse, in particular that of a hydrological, meteorological, hydrogeological and ecological nature and related to the water quality as well as related forecasts.

2 - If a watercourse State is requested by another watercourse State to provide data or information that is not readily available, it shall employ its best efforts to comply with the request but may condition its compliance upon payment by the requesting State of the reasonable costs of collecting and where appropriate, processing such data or information.

3 - Watercourse States shall employ their best efforts to collect and, where appropriate, to process data and information in a manner which facilitates its utilization by the other watercourse States to which it is communicated.

Article 10
Relationship between different kinds of uses
1 - In the absence of agreement or custom to the contrary, no use of an international watercourse enjoys inherent priority over other uses.

2 - In the event of a conflict between uses of an international watercourse, it shall be resolved with reference to articles 5 to 7, with special regard being given to the requirements of vital human needs.

PART III
Planned measures
Article 11
Information concerning planned measures
Watercourse States shall exchange information and consult each other and, if necessary, negotiate on the possible effects of planned measures on the condition of an international watercourse.

Article 12
Notification concerning planned measures with possible adverse effects
Before a watercourse State implements or permits the implementation of planned measures which may have a significant adverse effect upon other watercourse States, it shall provide those States with timely notification thereof. Such notification shall be accompanied by available technical data and information, including the results of any environmental impact assessment, in order to enable the notified States to evaluate the possible effects of the planned measures.

Article 13
Period for reply to notification
Unless otherwise agreed:
a) A watercourse State providing a notification under article 12 shall allow the notified States a period of six months within which to study and evaluate the possible effects of the planned measures and to communicate the findings to it;

b) This period shall, at the request of a notified State for which the evaluation of the planned measures poses special difficulty, be extended for a period of six months.

Article 14
Obligations of the notifying State during the period for reply
During the period referred to in article 13, the notifying State:
a) Shall cooperate with the notified States by providing them, on request, with any additional data and information that is available and necessary for an accurate evaluation; and

b) Shall not implement or permit the implementation of the planned measures without the consent of the notified States.

Article 15
Reply to notification
The notified States shall communicate their findings to the notifying State as early as possible within the period applicable pursuant to article 13. If a notified State finds that implementation of the planned measures would be inconsistent with the provisions of articles 5 or 7, it shall attach to its finding a documented explanation setting forth the reasons for the finding.

Article 16
Absence of reply to notification
1 - If, within the period applicable pursuant to article 13, the notifying State receives no communication under article 15, it may, subject to its obligations under articles 5 and 7, proceed with the implementation of the planned measures, in accordance with the notification and any other data and information provided to the notified States.

2 - Any claim to compensation by a notified State which has failed to reply within the period applicable pursuant to article 13 may be offset by the costs incurred by the notifying State for action undertaken after the expiration of the time for a reply which would not have been undertaken if the notified State had objected within that period.

Article 17
Consultations and negotiations concerning planned measures
1 - If a communication is made under article 15 that implementation of the planned measures would be inconsistent with the provisions of articles 5 or 7, the notifying State and the State making the communication shall enter into consultations and, if necessary, negotiations with a view to arriving at an equitable resolution of the situation.

2 - The consultations and negotiations shall be conducted on the basis that each State must in good faith pay reasonable regard to the rights and legitimate interests of the other State.

3 - During the course of the consultations and negotiations, the notifying State shall, if so requested by the notified State at the time it makes the communication, refrain from implementing or permitting the implementation of the planned measures for a period of six months unless otherwise agreed.

Article 18
Procedures in the absence of notification
1 - If a watercourse State has reasonable grounds to believe that another watercourse State is planning measures that may have a significant adverse effect upon it, the former State may request the latter to apply the provisions of article 12. The request shall be accompanied by a documented explanation setting forth its grounds.

2 - In the event that the State planning the measures nevertheless finds that it is not under an obligation to provide a notification under article 12, it shall so inform the other State, providing a documented explanation setting forth the reasons for such finding. If this finding does not satisfy the other State, the two States shall, at the request of that other State, promptly enter into consultations and negotiations in the manner indicated in paragraphs 1 and 2 of article 17.

3 - During the course of the consultations and negotiations, the State planning the measures shall, if so requested by the other State at the time it requests the initiation of consultations and negotiations, refrain from implementing or permitting the implementation of those measures for a period of six months unless otherwise agreed.

Article 19
Urgent implementation of planned measures
1 - In the event that the implementation of planned measures is of the utmost urgency in order to protect public health, public safety or other equally important interests, the State planning the measures may, subject to articles 5 and 7, immediately proceed to implementation, notwithstanding the provisions of article 14 and paragraph 3 of article 17.

2 - In such case, a formal declaration of the urgency of the measures shall be communicated without delay to the other watercourse States referred to in article 12 together with the relevant data and information.

3 - The State planning the measures shall, at the request of any of the States referred to in paragraph 2, promptly enter into consultations and negotiations with it in the manner indicated in paragraphs 1 and 2 of article 17.

PART IV
Protection, preservation and management
Article 20
Protection and preservation of ecosystems
Watercourse States shall, individually and, where appropriate, jointly, protect and preserve the ecosystems of international watercourses.

Article 21
Prevention, reduction and control of pollution
1 - For the purpose of this article, "pollution of an international watercourse» means any detrimental alteration in the composition or quality of the waters of an international watercourse which results directly or indirectly from human conduct.

2 - Watercourse States shall, individually and, where appropriate, jointly, prevent, reduce and control the pollution of an international watercourse that may cause significant harm to other watercourse States or to their environment, including harm to human health or safety, to the use of the waters for any beneficial purpose or to the living resources of the watercourse. Watercourse States shall take steps to harmonize their policies in this connection.

3 - Watercourse States shall, at the request of any of them, consult with a view to arriving at mutually agreeable measures and methods to prevent, reduce and control pollution of an international watercourse, such as:

a) Setting joint water quality objectives and criteria;
b) Establishing techniques and practices to address pollution from point and non-point sources;

c) Establishing lists of substances the introduction of which into the waters of an international watercourse is to be prohibited, limited, investigated or monitored.

Article 22
Introduction of alien or new species
Watercourse States shall take all measures necessary to prevent the introduction of species, alien or new, into an international watercourse which may nave effects detrimental to the ecosystem of the watercourse resulting in significant harm to other watercourse States.

Article 23
Protection and preservation of the marine environment
Watercourse States shall, individually and, where appropriate, in cooperation with other States, take all measures with respect to an international watercourse that are necessary to protect and preserve the marine environment, including estuaries, taking into account generally accepted international rules and standards.

Article 24
Management
1 - Watercourse States shall, at the request of any of them, enter into consultations concerning the management of an international watercourse, which may include the establishment of a joint management mechanism.

2 - For the purposes of this article, "management» refers, in particular, to:
a) Planning the sustainable development of an international watercourse and providing for the implementation of any plans adopted; and

b) Otherwise promoting the rational and optimal utilization, protection and control of the watercourse.

Article 25
Regulation
1 - Watercourse States shall cooperate, where appropriate, to respond to needs or opportunities for regulation of the flow of the waters of an international watercourse.

2 - Unless otherwise agreed, watercourse States shall participate on an equitable basis in the construction and maintenance or defrayal of the costs of such regulation works as they may have agreed to undertake.

3 - For the purposes of this article, "regulation» means the use of hydraulic works or any other continuing measure to alter, vary or otherwise control the flow of the waters of an international watercourse.

Article 26
Installations
1 - Watercourse States shall, within their respective territories, employ their best efforts to maintain and protect installations, facilities and other works related to an international watercourse.

2 - Watercourse States shall, at the request of any of them which has reasonable grounds to believe that it may suffer significant adverse effects, enter into consultations with regard to:

a) The safe operation and maintenance of installations, facilities or other works related to an international watercourse; and

b) The protection of installations, facilities or other works from wilful or negligent acts or the forces of nature.

PARTE V
Harmful conditions and emergency situations
Article 27
Prevention and mitigation of harmful conditions
Watercourse States shall, individually and, where appropriate, jointly, take all appropriate measures to prevent or mitigate conditions related to an international watercourse that may be harmful to other watercourse States, whether resulting from natural causes or human conduct, such as flood or ice conditions, water-borne diseases, siltation, erosion, salt-water intrusion, drought or desertification.

Article 28
Emergency situations
1 - For the purposes of this article, "emergency» means a situation that causes, or poses an imminent threat of causing, serious harm to watercourse States or other States and that results suddenly from natural causes, such as floods, the breaking up of ice, landslides or earthquakes, or from human conduct, such as industrial accidents.

2 - A watercourse State shall, without delay and by the most expeditious means available, notify other potentially affected States and competent international organizations of any emergency originating within its territory.

3 - A watercourse State within whose territory an emergency originates shall, in cooperation with potentially affected States and, where appropriate, competent international organizations, immediately take all practicable measures necessitated by the circumstances to prevent, mitigate and eliminate harmful effects of the emergency.

4 - When necessary, watercourse States shall jointly develop contingency plans for responding to emergencies, in cooperation, where appropriate, with other potentially affected States and competent international organizations.

PART VI
Miscellaneous provisions
Article 29
International watercourses and installations in time of armed conflict
International watercourses and related installations, facilities and other works shall enjoy the protection accorded by the principles and rules of international law applicable in international and non-international armed conflict and shall not be used in violation of those principles and rules.

Article 30
Indirect procedures
In cases where there are serious obstacles to direct contacts between watercourse States, the States concerned shall fulfill their obligations of cooperation provided for in the present Convention, including exchange of data and information, notification, communication, consultations and negotiations, through any indirect procedure accepted by them.

Article 31
Data and information vital to national defence or security
Nothing in the present Convention obliges a watercourse State to provide data or information vital to its national defence or security. Nevertheless, that State shall cooperate in good faith with the other watercourse States with a view to providing as much information as possible under the circumstances.

Article 32
Non-discrimination
Unless the watercourse States concerned have agreed otherwise for the protection of the interests of persons, natural or juridical, who have suffered or are under a serious threat of suffering significant transboundary harm as a result of activities related to an international watercourse, a watercourse State shall not discriminate on the basis of nationality or residence or place where the injury occurred, in granting to such persons, in accordance with its legal system, access to judicial or other procedures, or a right to claim compensation or other relief in respect of significant harm caused by such activities carried on in its territory.

Article 33
Settlement of disputes
1 - In the event of a dispute between two or more Parties concerning the interpretation or application of the present Convention, the Parties concerned shall, in the absence of an applicable agreement between them, seek a settlement of the dispute by peaceful means in accordance with the following provisions.

2 - If the Parties concerned cannot reach agreement by negotiation requested by one of them, they may jointly seek the good offices of, or request mediation or conciliation by, a third party, or make use, as appropriate, of any joint watercourse institutions that may have been established by them or agree to submit the dispute to arbitration or to the International Court of Justice.

3 - Subject to the operation of paragraph 10, if after six months from the time of the request for negotiations referred to in paragraph 2, the Parties concerned have not been able to settle their dispute through negotiation or any other means referred to in paragraph 2, the dispute shall be submitted, at the request of any of the parties to the dispute, to impartial fact-finding in accordance with paragraphs 4 to 9, unless the Parties otherwise agree.

4 - A Fact-finding Commission shall be established, composed of one member nominated by each Party concerned and in addition a member not having the nationality of any of the Parties concerned chosen by the nominated members who shall serve as Chairman.

5 - If the members nominated by the Parties are unable to agree on a Chairman within three months of the request for the establishment of the Commission, any Party concerned may request the Secretary-General of the United Nations to appoint the Chairman who shall not have the nationality of any of the parties to the dispute or of any riparian State of the watercourse concerned if one of the Parties fails to nominate a member within three months of the initial request pursuant to paragraph 3, any other Party concerned may request the Secretary-General of the United Nations to appoint a person who shall not have the nationality of any of the parties to the dispute or of any riparian State of the watercourse concerned. The person so appointed shall constitute a single-member Commission.

6 - The Commission shall determine its own procedure.
7 - The Parties concerned have the obligation to provide the Commission with such information as it may require and, on request, to permit the Commission to have access to their respective territory and to inspect any facilities, plant, equipment, construction or natural feature relevant for the purpose of its inquiry.

8 - The Commission shall adopt its report by a majority vote, unless it is a single-member Commission, and shall submit that report to the Parties concerned setting forth its findings and the reasons there for and such recommendations as it deems appropriate for an equitable solution of the dispute, which the Parties concerned shall consider in good faith.

9 - The expenses of the Commission shall be borne equally by the Parties concerned.

10 - When ratifying, accepting, approving or acceding to the present Convention, or at any time thereafter, a Party which is not a regional economic integration organization may declare in a written instrument submitted to the Depositary that, in respect of any dispute not resolved in accordance with paragraph 2, it recognizes as compulsory ipso facto and without special agreement in relation to any Party accepting the same obligation:

a) Submission of the dispute to the International Court of Justice; and or
b) Arbitration by an arbitral tribunal established and operating, unless the parties to the dispute otherwise agreed, in accordance with the procedure laid down in the annex to the present Convention.

A Party which is a regional economic integration organization may make a declaration with like effect in relation to arbitration in accordance with subparagraph b).

PART VII
Final clauses
Article 34
Signature
The present Convention shall be open for signature by all States and by regional economic integration organizations from 21 May 1997 until 20 May 2000 at United Nations Headquarters in New York.

Article 35
Ratification, acceptance, approval or accession
1 - The present Convention is subject to ratification, acceptance, approval or accession by States and by regional economic integration organizations. The instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary-General of the United Nations.

2 - Any regional economic integration organization which becomes a Party to this Convention without any of its member States being a Party shall be bound by all the obligations under the Convention. In the case of such organizations, one or more of whose member States is a Party to this Convention, the organization and its member States shall decide on their respective responsibilities for the performance of their obligations under the Convention. In such cases, the organization and the member States shall not be entitled to exercise rights under the Convention concurrently.

3 - In their instruments of ratification, acceptance, approval or accession, the regional economic integration organizations shall declare the extent of their competence with respect to the matters governed by the Convention. These organizations shall also inform the Secretary-General of the United Nations of any substantial modification in the extent of their competence.

Article 36
Entry into force
1 - The present Convention shall enter into force on the ninetieth day following the date of deposit of the thirty-fifth instrument of ratification, acceptance, approval or accession with the Secretary-General of the United Nations.

2 - For each State or regional economic integration organization that ratifies, accepts or approves the Convention or accedes thereto after the deposit of the thirty-fifth instrument of ratification, acceptance, approval or accession, the Convention shall enter into force on the ninetieth day after the deposit by such State or regional economic integration organization of its instrument of ratification, acceptance, approval or accession.

3 - For the purposes of paragraphs 1 and 2, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by States.

Article 37
Authentic texts
The original of the present Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

ANNEX
Arbitration
Article 1
Unless the parties to the dispute otherwise agree, the arbitration pursuant to article 33 of the Convention shall take place in accordance with articles 2 to 14 of the present annex.

Article 2
The claimant party shall notify the respondent party that it is referring a dispute to arbitration pursuant to article 33 of the Convention. The notification shall state the subject matter of arbitration and include, in particular, the articles of the Convention, the interpretation or application of which are at issue. If the parties do not agree on the subject matter of the dispute, the arbitral tribunal shall determine the subject matter.

Article 3
1 - In disputes between two parties, the arbitral tribunal shall consist of three members. Each of the parties to the dispute shall appoint an arbitrator and the two arbitrators so appointed shall designate by common agreement the third arbitrator, who shall be the Chairman of the tribunal. The latter shall not be a national of one of the parties to the dispute or of any riparian State of the watercourse concerned, nor have his or her usual place of residence in the territory of one of these parties or such riparian State, nor have dealt with the case in any other capacity.

2 - In disputes between more than two parties, parties in the same interest shall appoint one arbitrator jointly by agreement.

3 - Any vacancy shall be filled in the manner prescribed for the initial appointment.

Article 4
1 - If the Chairman of the arbitral tribunal has not been designated within two months of the appointment of the second arbitrator, the President of the International Court of Justice shall, at the request of a party, designate the Chairman within a further two-month period.

2 - If one of the parties to the dispute does not appoint an arbitrator within two months of receipt of the request, the other party may inform the President of the International Court of Justice, who shall make the designation within a further two-month period.

Article 5
The arbitral tribunal shall render its decisions in accordance with the provisions of this Convention and international law.

Article 6
Unless the parties to the dispute otherwise agree, the arbitral tribunal shall determine its own rules of procedure.

Article 7
The arbitral tribunal may, at the request of one of the Parties, recommend essential interim measures of protection.

Article 8
1 - The parties to the dispute shall facilitate the work of the arbitral tribunal and, in particular, using all means at their disposal, shall:

a) Provide it with all relevant documents, information and facilities; and
b) Enable it, when necessary, to call witnesses or experts and receive their evidence.

2 - The parties and the arbitrators are under an obligation to protect the confidentiality of any information they receive in confidence during the proceedings of the arbitral tribunal.

Article 9
Unless the arbitral tribunal determines otherwise because of the particular circumstances of the case, the costs of the tribunal shall be borne by the parties to the dispute in equal shares. The tribunal shall keep a record of all its costs and shall furnish a final statement thereof to the parties.

Article 10
Any Party that has an interest of a legal nature in the subject matter of the dispute which may be affected by the decision in the case, may intervene in the proceedings with the consent of the tribunal.

Article 11
The tribunal may hear and determine counterclaims arising directly out of the subject matter of the dispute.

Article 12
Decisions both on procedure and substance of the arbitral tribunal shall be taken by a majority vote of its members.

Article 13
If one of the parties to the dispute does not appear before the arbitral tribunal or fails to defend its case, the other party may request the tribunal to continue the proceedings and to make its award. Absence of a party or a failure of a party to defend its case shall not constitute a bar to the proceedings. Before rendering its final decision, the arbitral tribunal must satisfy itself that the claim is well founded in fact and law.

Article 14
1 - The tribunal shall render its final decision within five months of the date on which it is fully constituted unless it finds it necessary to extend the time limit for a period which should not exceed five more months.

2 - The final decision of the arbitral tribunal shall be confined to the subject matter of the dispute and shall state the reasons on which it is based. It shall contain the names of the members who have participated and the date of the final decision. Any member of the tribunal may attach a separate or dissenting opinion to the final decision.

3 - The award shall be binding on the parties to the dispute. It shall be without appeal unless the parties to the dispute have agreed in advance to an appellate procedure.

4 - Any controversy which may arise between the parties to the dispute as regards the interpretation or manner of implementation of the final decision may be submitted by either party for decision to the arbitral tribunal which rendered it.


CONVENÇÃO SOBRE O DIREITO RELATIVO À UTILIZAÇÃO DOS CURSOS DE ÁGUA PARA FINS DIVERSOS DOS DE NAVEGAÇÃO

As Partes nesta Convenção:
Conscientes da importância dos cursos de água internacionais e da sua utilização, em várias regiões do mundo, para fins diversos dos de navegação;

Tendo em consideração o artigo 13.º, parágrafo 1, alínea a), da Carta das Nações Unidas que estipula que a Assembleia Geral deverá iniciar estudos e fazer recomendações com o fim de encorajar o desenvolvimento progressivo do direito internacional e a sua codificação;

Considerando que a codificação bem sucedida e o desenvolvimento progressivo das normas de direito internacional atinentes à utilização dos cursos de água para fins diversos dos de navegação auxiliaria a promoção e a aplicação dos objectivos e princípios consignados nos artigos 1.º e 2.º da Carta das Nações Unidas;

Tendo em conta os problemas que afectam muitos dos cursos de água internacionais e que resultam, para além de outras razões, de necessidades em aumento e da poluição;

Expressando a sua convicção de que uma convenção quadro irá garantir a utilização, o desenvolvimento, a conservação, a gestão e a protecção de cursos de água internacionais e a promoção de uma utilização optimizada e sustentável dos mesmos para as gerações presentes e futuras;

Afirmando a importância da cooperação internacional e da boa vizinhança neste domínio;

Cientes da situação especial e das necessidades dos países em desenvolvimento;
Invocando os princípios e as recomendações adoptados pela Conferência das Nações Unidas sobre o Ambiente e o Desenvolvimento, na Declaração do Rio e na Agenda 21, realizada em 1992;

Invocando ainda os acordos bilaterais e multilaterais existentes, atinentes à utilização de cursos de água para fins diversos dos de navegação;

Atentas à valiosa contribuição que organizações internacionais, quer governamentais quer não governamentais, prestam à codificação e ao desenvolvimento progressivo do direito internacional neste domínio;

Mostrando apreço pelo trabalho levado a cabo pela Comissão do Direito Internacional sobre direito relativo à utilização de cursos de água para fins diversos dos de navegação;

Tendo presente a resolução 49/52, da Assembleia das Nações Unidas, de 9 de Dezembro de 1994;

acordam no seguinte:
PARTE I
Introdução
Artigo 1.º
Âmbito da presente Convenção
1 - A presente Convenção aplica-se à utilização dos cursos de água internacionais e das suas águas para fins diversos dos de navegação e às medidas de protecção, preservação e gestão relativas à utilização desses cursos de água e das suas águas.

2 - As utilizações dos cursos de água para navegação não são abrangidas pela presente Convenção, excepto se outras utilizações afectarem ou forem afectadas pela navegação.

Artigo 2.º
Definições
Para os fins da presente Convenção:
a) "Curso de água» designa um sistema de águas superficiais e subterrâneas que constituem, em razão da sua relação física, um conjunto unitário e que normalmente fluem para um término comum;

b) "Curso de água internacional» designa um curso de água com parcelas situadas em Estados diferentes;

c) "Estado ribeirinho» designa um Estado Parte na presente Convenção, em cujo território se situa uma parcela de um curso de água internacional ou uma parte que constitua uma organização de integração económica regional, dando-se o caso de, no território de um ou mais dos seus Estados membros, se situar uma parcela de um curso de água internacional;

d) "Organização de integração económica regional» designa uma organização constituída por Estados soberanos de uma determinada região, para a qual os seus Estados membros tenham transferido competência em matérias regidas pela presente Convenção, e que foi devidamente autorizada, de acordo com os seus procedimentos internos, a assinar, ratificar, aceitar, aprovar ou aderir à Convenção.

Artigo 3.º
Acordos sobre cursos de água
1 - Salvo acordo em contrário, nada na presente Convenção afectará os direitos ou obrigações de um Estado ribeirinho resultantes de acordos em vigor relativamente a esse Estado, à data em que se tornou Parte na presente Convenção.

2 - Não obstante as disposições do parágrafo 1, as partes nos acordos referidos no parágrafo 1 podem, se necessário, considerar a possibilidade de harmonização entre tais acordos e os princípios básicos da presente Convenção.

3 - Os Estados ribeirinhos podem celebrar um ou mais acordos, adiante designados por acordos sobre cursos de água, que apliquem e ajustem as disposições da presente Convenção às características e utilizações de um determinado curso de água internacional ou de uma parcela do mesmo.

4 - Quando um acordo sobre cursos de água for celebrado entre dois ou mais Estados ribeirinhos, deverá designar as águas a que se aplica. Tal acordo pode ser celebrado relativamente a um curso de água internacional na sua totalidade, ou a uma parcela do mesmo, ou em relação a um determinado projecto, programa ou utilização, excepto se o acordo afectar, em grande medida, de modo adverso, a utilização das águas do curso de água por um ou mais Estados ribeirinhos, sem o seu expresso consentimento.

5 - Quando um Estado ribeirinho considerar que é necessário proceder ao ajustamento e à aplicação das disposições da presente Convenção, em virtude das características e das utilizações de um determinado curso de água, os Estados ribeirinhos devem consultar-se com vista a negociarem de boa fé, com o objectivo de celebrarem um acordo ou acordos sobre cursos de água.

6 - Quando alguns mas não todos os Estados ribeirinhos, em relação a um determinado curso de água internacional, forem partes num acordo, nada nesse acordo deve afectar os direitos ou obrigações, nos termos da presente Convenção, de Estados ribeirinhos que não sejam partes nesse acordo.

Artigo 4.º
As partes nos acordos sobre cursos de água
1 - Todo o Estado ribeirinho tem o direito de participar na negociação e de se tornar parte num acordo sobre cursos de água que se aplique à totalidade de um curso de água internacional bem como de participar em quaisquer consultas relevantes.

2 - Um Estado ribeirinho cuja utilização de um curso de água internacional possa ser, em grande medida, afectada pela aplicação de um acordo proposto sobre cursos de água que se aplique unicamente a uma parcela do curso de água ou a um determinado projecto, programa ou utilização, tem direito a participar nas consultas sobre tal acordo e, se adequado, na sua negociação, de boa fé, com vista a tornar-se parte no acordo, na medida em que a utilização do curso de água por parte daquele Estado ribeirinho possa ser afectada.

PARTE II
Princípios básicos
Artigo 5.º
Utilização e participação equitativa e razoável
1 - Os Estados ribeirinhos devem, nos seus respectivos territórios, utilizar um curso de água internacional de forma equitativa e razoável. Um curso de água será, em especial, utilizado e desenvolvido por Estados ribeirinhos com vista à obtenção da sua utilização optimizada e sustentável e dos benefícios daí resultantes, tendo em conta os interesses dos Estados ribeirinhos interessados, compatíveis com uma protecção adequada do curso de água.

2 - Os Estados ribeirinhos devem participar na utilização, desenvolvimento e protecção de um curso de água internacional de forma equitativa e razoável. Tal participação inclui tanto o direito de utilização do curso de água como o dever de cooperação na sua protecção e desenvolvimento, conforme previsto na presente Convenção.

Artigo 6.º
Factores relevantes para a utilização equitativa e razoável
1 - A utilização de um curso de água de uma forma equitativa e razoável, nos termos do artigo 5.º, requer que se tenham em conta todos os factores e circunstâncias relevantes, incluindo:

a) Factores geográficos, hidrográficos, hidráulicos, climáticos, ecológicos e outros factores de carácter natural;

b) As necessidades sociais e económicas dos Estados ribeirinhos interessados;
c) A população, em cada Estado ribeirinho, dependente do curso de água;
d) Os efeitos da utilização ou utilizações dos cursos de água num Estado ribeirinho sobre os demais Estados ribeirinhos;

e) Utilizações existentes e potenciais dos cursos de água;
f) Conservação, protecção, desenvolvimento e economia da utilização dos recursos hidráulicos do curso de água e os custos das medidas realizadas com esse fim;

g) A disponibilidade de alternativas de valor comparável para uma utilização concreta existente ou planeada.

2 - Na aplicação do artigo 5.º ou do parágrafo 1 do presente artigo, os Estados ribeirinhos interessados devem, quando necessário, encetar consultas num espírito de cooperação.

3 - O valor a ser atribuído a cada factor deve ser determinado pela sua importância, em comparação com a de outros factores relevantes. Ao determinar o que é uma utilização razoável e equitativa todos os factores relevantes devem ser apreciados em conjunto e, com base nessa apreciação, dever-se-á chegar a uma conclusão.

Artigo 7.º
Obrigação de não provocar dano significativo
1 - Ao utilizarem um curso de água internacional nos seus territórios, os Estados ribeirinhos devem adoptar as medidas necessárias para prevenir a realização de danos significativos que afectem os demais Estados ribeirinhos.

2 - Quando, apesar disso, forem provocados danos a um outro Estado ribeirinho, os Estados cuja utilização provoca tais danos devem, na ausência de um acordo que regule tal utilização, adoptar todas as medidas necessárias, tendo na devida conta o disposto nos artigos 5.º e 6.º, em consulta com o Estado afectado, com vista a eliminar ou minorar tais danos e, se adequado, a discutir a questão da indemnização.

Artigo 8.º
Obrigação geral de cooperação
1 - Os Estados ribeirinhos devem cooperar numa base de igualdade soberana, de integridade territorial, de benefício mútuo e de boa fé, de forma a obterem uma utilização optimizada e uma protecção adequada de um curso de água internacional.

2 - Os Estados ribeirinhos, ao determinarem a forma de tal cooperação, podem considerar a possibilidade de criação de mecanismos e comissões às quais fiquem associados, conforme forem consideradas necessárias por eles, de forma a facilitar a cooperação relativa a medidas e a procedimentos relevantes, à luz da experiência adquirida, através da cooperação em mecanismos e comissões de que fiquem associados, existentes em várias regiões.

Artigo 9.º
Troca regular de dados e informações
1 - Nos termos do artigo 8.º, os Estados ribeirinhos devem, frequentemente, trocar dados e informações tornados rapidamente disponíveis sobre o estado do curso de água, em especial, sobre a sua natureza hidráulica, meteorológica, hidrogeológica e ecológica e relacionados com a qualidade da água bem como com previsões conexas.

2 - Se a um Estado ribeirinho for pedido, por outro Estado ribeirinho, que faculte dados e informações que não se tornem rapidamente disponíveis, este deve diligenciar no sentido de satisfazer o pedido, mas poderá impor como condição a este cumprimento que o Estado requerente pague os custos razoáveis, necessários à recolha e, se adequado, ao tratamento de tais dados ou informações.

3 - Os Estados ribeirinhos devem diligenciar no sentido de recolherem e, se adequado, de tratarem dados e informações, de uma forma que facilite a sua utilização por parte dos demais Estados ribeirinhos aos quais foram transmitidos.

Artigo 10.º
Relação entre diversos tipos de utilização
1 - Na falta de acordo ou costume diverso, nenhuma utilização de um curso de água internacional beneficia de prioridade própria sobre outras utilizações.

2 - Na eventualidade de um conflito entre utilizações de um curso de água internacional, este será resolvido de acordo com os artigos 5.º a 7.º, dando-se especial atenção às exigências das necessidades humanas vitais.

PARTE III
Medidas projectadas
Artigo 11.º
Informações atinentes a medidas projectadas
Os Estados ribeirinhos devem trocar informações e consultar-se reciprocamente e, se necessário, negociar sobre os possíveis efeitos que as medidas projectadas podem ter sobre o estado de um curso de água internacional.

Artigo 12.º
Notificação relativa a medidas projectadas com possíveis efeitos adversos
Antes que um Estado ribeirinho aplique ou permita a aplicação de medidas projectadas que possam ter um efeito adverso significativo sobre outros Estados ribeirinhos, deve notificar atempadamente esses Estados quanto a estas medidas. Tal notificação será instruída de dados técnicos disponíveis e de informações, incluindo os resultados de qualquer avaliação de impacte ambiental, de forma a permitir que os Estados notificados avaliem os efeitos possíveis das medidas projectadas.

Artigo 13.º
Período para responder à notificação
Salvo acordo em contrário:
a) Um Estado ribeirinho que leve a cabo a notificação, nos termos do artigo 12.º, deve conceder aos Estados notificados um período de seis meses, no decurso do qual estes estudarão e avaliarão os possíveis efeitos das medidas projectadas e comunicar-lhe-ão as suas conclusões;

b) A pedido de um Estado notificado, para o qual a avaliação das medidas projectadas é particularmente difícil, este período será prolongado por mais seis meses.

Artigo 14.º
Obrigações do Estado que faz a notificação no decurso do período para a resposta

No decurso do período referido no artigo 13.º, o Estado que faz a notificação:
a) Deve cooperar com os Estados notificados fornecendo-lhes, a pedido, quaisquer dados ou informações suplementares que estejam disponíveis e que sejam necessários para uma avaliação mais precisa; e

b) Não aplicará nem permitirá a aplicação das medidas projectadas, sem o consentimento dos Estados notificados.

Artigo 15.º
Resposta à notificação
Nos termos do artigo 13.º, os Estados notificados deverão comunicar as suas conclusões o mais breve possível, dentro do período que tiver sido estabelecido. Caso um Estado notificado considere que a aplicação das medidas projectadas seria incompatível com o disposto nos artigos 5.º ou 7.º, deve anexar ao documento com as suas conclusões uma explicação documentada que fundamente as suas conclusões.

Artigo 16.º
Ausência de resposta à notificação
1 - Se, findo o período que tiver sido estabelecido nos termos do artigo 13.º, o Estado que procedeu à notificação não receber qualquer comunicação pode, nos termos do artigo 15.º, e sujeito às obrigações previstas pelos artigos 5.º e 7.º, dar seguimento à aplicação das medidas projectadas, em conformidade com a notificação e com quaisquer outros dados ou informações fornecidos aos Estados notificados.

2 - Qualquer pedido de indemnização formulado por um Estado notificado que não tenha observado o período que tenha sido estabelecido nos termos do artigo 13.º pode ficar contrabalançado pelas despesas incorridas pelo Estado que procedeu à notificação, por ter levado a cabo o projecto após a expiração do período para a resposta, projecto este que não teria sido levado a cabo caso o Estado notificado se tivesse oposto no decurso desse período.

Artigo 17.º
Consultas e negociações atinentes a medidas projectadas
1 - Se, nos termos do artigo 15.º, uma comunicação for transmitida, anunciando que a aplicação das medidas projectadas seria incompatível com o disposto nos artigos 5.º ou 7.º, o Estado que procedeu à notificação e o Estado autor da comunicação devem encetar consultas e, se necessário, negociações, com vista a chegarem a uma solução equitativa da situação.

2 - As consultas e negociações são realizadas com base na boa fé com que cada Estado deverá respeitar, de forma razoável, os direitos e interesses legítimos do outro Estado.

3 - No decurso das consultas e negociações, o Estado que procedeu à notificação deve, a pedido do Estado notificado aquando da formulação da comunicação, abster-se de aplicar ou de permitir a aplicação das medidas projectadas, durante um período de seis meses, salvo acordo em contrário.

Artigo 18.º
Procedimentos na ausência de notificação
1 - Se um Estado ribeirinho tiver motivos fundados para acreditar que um outro Estado ribeirinho está a planear medidas que possam ter um efeito adverso sobre ele, o primeiro Estado pode solicitar a este último a aplicação do disposto no artigo 12.º O pedido deve ser acompanhado de uma exposição documentada que fundamente os seus pontos de vista.

2 - Na eventualidade de o Estado responsável pelas medidas concluir, apesar disso, que não se encontra sujeito à obrigação de proceder à notificação nos termos do artigo 12.º, deve informar o outro Estado, dirigindo-lhe uma exposição documentada que fundamente os seus pontos de vista. Se esses pontos de vista não satisfizerem o Estado autor da solicitação, os dois Estados devem, a pedido deste, encetar prontamente consultas e negociações, conforme o disposto nos parágrafos 1 e 2 do artigo 17.º

3 - No decurso das consultas e negociações, o Estado responsável pelas medidas deve, se solicitado pelo outro Estado aquando do seu pedido para o início da fase de consultas e negociações, abster-se de aplicar ou de permitir a aplicação dessas medidas por um período de seis meses, salvo acordo em contrário.

Artigo 19.º
Aplicação urgente de medidas projectadas
1 - Na eventualidade da aplicação de medidas projectadas ser tida como da maior urgência para a protecção da saúde pública, da segurança pública ou de outros interesses igualmente importantes, o Estado responsável pelas medidas pode, nos termos dos artigos 5.º e 7.º, dar seguimento, de imediato, à aplicação, não obstante o disposto no artigo 14.º e no parágrafo 3 do artigo 17.º

2 - Nesse caso, deve ser transmitida, sem demora, aos demais Estados ribeirinhos referidos no artigo 12.º, uma declaração formal justificativa da urgência das medidas, instruída dos dados e informações relevantes.

3 - O Estado responsável pelas medidas deve, a pedido de qualquer um dos Estados referidos no parágrafo 2, encetar prontamente consultas e negociações com o mesmo, conforme o disposto nos parágrafos 1 e 2 do artigo 17.º

PARTE IV
Protecção, preservação e gestão
Artigo 20.º
Protecção e preservação de ecossistemas
Os Estados ribeirinhos devem, individual ou conjuntamente, se adequado, proteger e preservar os ecossistemas dos cursos de água internacionais.

Artigo 21.º
Prevenção, redução e controlo da poluição
1 - Para os fins do presente artigo "a poluição de um curso de água internacional» designa qualquer alteração nociva da composição ou da qualidade das águas de um curso de água internacional que resulte, directa ou indirectamente, da conduta humana.

2 - Os Estados ribeirinhos devem, individual ou conjuntamente, se necessário, prevenir, reduzir e controlar a poluição de um curso de água internacional que possa causar dano significativo a outros Estados ribeirinhos ou ao seu ambiente, inclusive danos à saúde ou segurança humana, ao uso das águas para qualquer propósito benéfico ou aos recursos vivos do curso de água. Os Estados ribeirinhos adoptarão as medidas necessárias à harmonização das suas políticas a este respeito.

3 - Os Estados ribeirinhos devem, a pedido de um deles, consultar-se com vista à obtenção de medidas e métodos, acordados mutuamente, para prevenir, reduzir e controlar a poluição de um curso de água internacional, tais como:

a) A definição, em conjunto, de objectivos e critérios atinentes à qualidade da água;

b) A elaboração de técnicas e práticas para combater a poluição de fonte localizada e difusa;

c) A elaboração de uma listagem de substâncias cuja introdução nas águas de um curso de água internacional será proibida, limitada, investigada ou fiscalizada.

Artigo 22.º
Introdução de espécies estranhas ao meio ou novas
Os Estados ribeirinhos devem adoptar as medidas necessárias à prevenção da introdução de espécies estranhas ao meio ou novas num curso de água internacional que possa ter efeitos nocivos para o ecossistema do curso de água, resultando em dano significativo para os demais Estados ribeirinhos.

Artigo 23.º
Protecção e preservação do meio marinho
Os Estados ribeirinhos devem adoptar, individual ou conjuntamente, se adequado, em cooperação com outros Estados, todas as medidas necessárias, relativas a um curso de água internacional, à protecção e preservação do meio marinho, incluindo estuários, tendo em conta regras e normas genericamente aceites.

Artigo 24.º
Gestão
1 - Os Estados ribeirinhos devem, a pedido de um deles, encetar consultas referentes à gestão de um curso de água internacional que pode incluir a criação de um mecanismo de gestão conjunta.

2 - Para os fins do presente artigo, "gestão» refere-se, em especial, ao:
a) Planeamento do desenvolvimento sustentável de um curso de água internacional e ao acto de providenciar pela aplicação de quaisquer planos adoptados; e

b) Promoção, por outros meios, da utilização, protecção e controlo racionais e optimizados do curso de água.

Artigo 25.º
Regularização
1 - Os Estados ribeirinhos devem, se adequado, cooperar no sentido de responderem às necessidades ou oportunidades para a regularização do fluxo das águas de um curso de água internacional.

2 - Salvo acordo em contrário, os Estados ribeirinhos devem participar, numa base equitativa, na construção e manutenção ou custeamento das despesas de tais trabalhos de regularização, conforme por eles acordado.

3 - Para os fins do presente artigo, "regularização» designa o emprego de trabalhos hidráulicos ou qualquer outra medida continuada para alterar, variar ou, doutro modo, controlar o fluxo das águas de um curso de água internacional.

Artigo 26.º
Instalações
1 - Os Estados ribeirinhos, dentro dos seus respectivos territórios, devem diligenciar no sentido de manter e proteger instalações, serviços ou outras obras atinentes a um curso de água internacional.

2 - Os Estados ribeirinhos, a pedido de qualquer um deles que tenha motivos fundados para acreditar que pode sofrer efeitos adversos significativos, deve encetar consultas relativas:

a) Ao funcionamento e manutenção seguros das instalações, serviços e outras obras atinentes a um curso de água internacional; e

b) À protecção das instalações, serviços ou outras obras, de actos de negligência intencional ou das forças da natureza.

PARTE V
Condições danosas e situações de emergência
Artigo 27.º
Prevenção e diminuição de condições danosas
Os Estados ribeirinhos devem individual ou conjuntamente, se adequado, adoptar todas as medidas necessárias à prevenção ou diminuição de condições, relativas a um curso de água internacional, potencialmente danosas para outros Estados ribeirinhos, derivadas quer de causas naturais quer da conduta humana, tais como inundações, condições provocadas por inundações ou pelo degelo, doenças propagadas através da água, sedimentação, erosões, intrusões salinas, seca ou desertificação.

Artigo 28.º
Situações de emergência
1 - Para os fins do presente artigo, "emergência» designa uma situação que causa ou coloca um perigo imediato de causar dano sério aos Estados ribeirinhos ou outros Estados e que resulte repentinamente de causas naturais tais como inundações, degelo, desmoronamentos ou terramotos ou da conduta humana, tais como acidentes industriais.

2 - Um Estado ribeirinho tem, de imediato, e através do meio mais rápido disponível, de notificar outros Estados potencialmente afectados e organizações internacionais competentes sobre qualquer emergência ocorrida no seu território.

3 - Um Estado ribeirinho em cujo território ocorreu uma emergência deve, em cooperação com Estados potencialmente afectados e, se adequado, com organizações internacionais competentes, adoptar, de imediato, todas as medidas exequíveis, impostas pelas circunstâncias, com vista a prevenir, minorar e eliminar os efeitos danosos provocados pela emergência.

4 - Quando necessário, os Estados ribeirinhos devem, conjuntamente, desenvolver planos de emergência para responder a emergências, em cooperação, se adequado, com outros Estados potencialmente afectados e com organizações internacionais competentes.

PARTE VI
Disposições diversas
Artigo 29.º
Cursos de água internacionais e instalações em tempo de conflito armado
Os cursos de água internacionais e as instalações, os serviços e outras obras com eles relacionadas, gozam da protecção acordada pelos princípios e normas do direito internacional aplicável em conflitos armados internacionais e não internacionais e não serão utilizados com violação desses princípios e normas.

Artigo 30.º
Procedimentos indirectos
Nos casos em que existam sérios obstáculos ao contacto directo entre os Estados ribeirinhos, os Estados interessados devem cumprir as suas obrigações de cooperação, previstas pela presente Convenção, incluindo a troca de dados e informações, a notificação, a comunicação, as consultas e negociações, através de qualquer procedimento indirecto por eles aceite.

Artigo 31.º
Dados e informações vitais para a defesa ou segurança nacional
Nada na presente Convenção obriga um Estado ribeirinho a facultar dados ou informações vitais para a sua defesa ou segurança nacional. Contudo, esse Estado deve cooperar, de boa fé, com os outros Estados ribeirinhos com vista a fornecer tanta informação quanto possível nestas circunstâncias.

Artigo 32.º
Não discriminação
Salvo acordo em contrário dos Estados ribeirinhos interessados, no que se refere à protecção dos interesses das pessoas, individuais ou colectivas, que tenham sofrido ou corram o risco de sofrer um dano transfronteiriço significativo, resultante de actividades relativas à utilização de um curso de água, um Estado ribeirinho não deverá discriminar, com base na nacionalidade, residência ou local de verificação do dano, o acesso por parte de tais pessoas, e em conformidade com o seu sistema jurídico, aos procedimentos judiciais ou outros, ou ao direito a pedir indemnização ou outra reparação sobre um dano significativo provocado por tais actividades empreendidas no seu território.

Artigo 33.º
Resolução de litígios
1 - Na eventualidade de um litígio entre duas ou mais Partes relativo à interpretação ou aplicação da presente Convenção, as partes interessadas devem, na ausência de acordo aplicável entre elas, procurar resolvê-lo por meios pacíficos, em conformidade com as seguintes disposições.

2 - Se as partes interessadas não resolverem o litígio por via de negociações, solicitado por uma delas, podem conjuntamente solicitar os bons ofícios ou pedir a mediação ou conciliação através de terceiro ou fazer uso, se adequado, de quaisquer instituições de que sejam associadas, relativas a cursos de água que possam ter sido por eles criadas ou acordar em submeter o litígio a arbitragem ou ao Tribunal Internacional de Justiça.

3 - Sujeito à operação prevista pelo parágrafo 10, se passado o período de seis meses referido no parágrafo 2, em que as negociações foram solicitadas, as partes interessadas não conseguirem resolver o litígio entre elas por intermédio de negociações ou por intermédio de quaisquer outros meios referidos no parágrafo 2, o litígio deve ser submetido, a pedido de qualquer uma das partes no litígio e em conformidade com os parágrafos 4 a 9, a um inquérito imparcial, salvo acordo em contrário das partes.

4 - Uma comissão de inquérito será criada, composta por um membro designado por cada parte interessada e, além disso, por um membro que não seja nacional de nenhuma das partes interessadas, escolhido pelos membros designados, que exercerá a função de presidente.

5 - Se os membros designados pelas partes não conseguirem chegar a acordo quanto ao presidente, no período de três meses a contar da data de pedido para a criação da comissão, qualquer uma das partes interessadas pode solicitar ao Secretário-Geral das Nações Unidas que nomeie o presidente, que não será nacional de nenhuma das partes no litígio ou de nenhum Estado ribeirinho do curso de água em causa. Se uma das partes não eleger um membro no período de três meses a contar do pedido inicial, nos termos do parágrafo 3, qualquer outra das partes interessadas pode solicitar ao Secretário-Geral das Nações Unidas que nomeie uma pessoa, que não será nacional de nenhuma das partes no litígio ou de nenhum Estado ribeirinho do curso de água em causa. A pessoa assim nomeada formará uma comissão de um único membro.

6 - A comissão deve adoptar o seu próprio procedimento.
7 - As partes interessadas são obrigadas a facultar à comissão as informações que esta solicitar e, a pedido, a permitir que a comissão tenha acesso aos seus respectivos territórios e a inspeccionar quaisquer serviços, fábricas, equipamentos, construções ou características naturais relevantes para os fins do seu inquérito.

8 - A comissão deve adoptar o seu relatório através do voto por maioria, a não ser que se trate de uma comissão de um único membro, e deve submeter esse relatório às partes interessadas, expondo as suas conclusões e as suas razões, bem como as recomendações que julgue necessárias para uma resolução equitativa do litígio que as partes interessadas devem considerar de boa fé.

9 - As despesas da comissão serão custeadas igualmente pelas partes interessadas.

10 - Ao ratificar, aceitar, aprovar ou aderir à presente Convenção, ou em qualquer altura posterior, uma parte que não for uma organização de integração económica regional pode declarar, através de um instrumento escrito submetido ao depositário que, sobre um qualquer litígio não resolvido em conformidade com o parágrafo 2, reconhece como compulsório ipso facto e sem um acordo especial em relação a qualquer parte que aceite a mesma obrigação:

a) A submissão do litígio ao Tribunal Internacional de Justiça; e ou
b) A arbitragem por parte de um tribunal arbitral criado e em funções, salvo acordo em contrário das partes no litígio, em conformidade com o procedimento consignado no anexo na presente Convenção.

Uma parte que seja uma organização de integração económica regional pode, em conformidade com a alínea b), fazer uma declaração com efeito similar em relação à arbitragem.

PARTE VII
Cláusulas finais
Artigo 34.º
Assinatura
A presente Convenção ficará aberta à assinatura de todos os Estados e das organizações de integração económica regional de 21 de Maio de 1997 até 20 de Maio de 2000 na sede da Organização das Nações Unidas, em Nova Iorque.

Artigo 35.º
Ratificação, aceitação, aprovação ou adesão
1 - A presente Convenção está sujeita a ratificação, aceitação, aprovação ou adesão por parte dos Estados e por parte das organizações de integração económica regional. Os instrumentos de ratificação, aceitação, aprovação ou adesão serão depositados junto do Secretário-Geral da Organização das Nações Unidas.

2 - Qualquer organização de integração económica regional que se torne Parte na presente Convenção, sem que nenhum dos seus Estados membros seja Parte, ficará vinculada por todas as obrigações nos termos da Convenção. No caso de tais organizações integrarem um ou mais Estados membros que sejam Partes da Convenção, a organização e os seus Estados membros devem decidir quanto às suas obrigações estabelecidas na Convenção. Em tais casos, a organização e os seus Estados membros não poderão, nos termos da Convenção, exercer direitos concorrentemente.

3 - Nos seus instrumentos de ratificação, aceitação, aprovação ou adesão, as organizações de integração económica regional devem declarar o âmbito da sua jurisdição, no que se refere às matérias regidas pela Convenção. Estas organizações devem igualmente informar o Secretário-Geral da Organização das Nações Unidas de qualquer modificação substancial do âmbito da sua jurisdição.

Artigo 36.º
Entrada em vigor
1 - A presente Convenção entrará em vigor no 19.º dia seguinte à data do depósito do 35.º instrumento de ratificação, aceitação, aprovação ou adesão junto do Secretário-Geral da Organização das Nações Unidas.

2 - Por cada Estado ou organização de integração económica regional que ratifique, aceite ou aprove a Convenção ou adira à mesma após o depósito do 35.º instrumento de ratificação, aceitação, aprovação ou adesão, a Convenção entrará em vigor no 19.º dia após o depósito por parte de tal Estado ou organização de integração económica regional do seu instrumento de ratificação, aceitação, aprovação ou adesão.

3 - Para os fins dos parágrafos 1 e 2, qualquer instrumento depositado por uma organização de integração económica regional não será entendido como adicional aos instrumentos depositados pelos Estados.

Artigo 37.º
Textos autênticos
O original da presente Convenção, cujos textos em árabe, chinês, inglês, francês, russo e espanhol fazem igualmente fé, ficará depositado junto do Secretário-Geral da Organização das Nações Unidas.

ANEXO
Arbitragem
Artigo 1.º
Salvo acordo em contrário das partes no litígio, a arbitragem, nos termos do artigo 33.º da Convenção, deve ocorrer em conformidade com os artigos 2.º a 14.º do presente anexo.

Artigo 2.º
A parte requerente deve notificar a parte requerida de que, nos termos do artigo 33.º da Convenção, está a submeter um litígio a arbitragem. A notificação deve anunciar a matéria a que se refere a arbitragem e incluir, em especial, os artigos da Convenção cuja interpretação ou aplicação está em causa. Se as partes estiverem em desacordo quanto à matéria a que se refere o litígio, o tribunal arbitral deve determiná-la.

Artigo 3.º
1 - O tribunal arbitral, em litígios entre partes, é composto por três membros. Cada uma das partes no litígio deve designar um árbitro, e os dois árbitros assim designados devem nomear, por acordo mútuo, o terceiro árbitro que será o presidente do tribunal. Este último não deve ser nacional de nenhuma das partes no litígio nem de nenhum Estado ribeirinho do curso de água em causa, nem residir habitualmente no território de uma dessas partes ou no território de um Estado ribeirinho nem deve ter intervindo no caso noutra qualidade que não a de presidente.

2 - Nos litígios em que estejam envolvidas mais de duas partes, as partes com interesse comum devem designar, conjuntamente e por acordo, um árbitro.

3 - Qualquer vaga deve ser preenchida da maneira estabelecida para a designação inicial.

Artigo 4.º
1 - Se, nos dois meses seguintes à data da designação do segundo árbitro, o presidente do tribunal arbitral não tiver sido nomeado, o Presidente do Tribunal Internacional de Justiça deve, a pedido de uma das partes, nomear o presidente nos dois meses seguintes.

2 - Se uma das partes no litígio não designar um árbitro nos dois meses seguintes à data de recepção do pedido, a outra parte deve informar o Presidente do Tribunal Internacional de Justiça, que deve proceder à nomeação nos dois meses seguintes.

Artigo 5.º
O tribunal arbitral deve proferir as suas decisões em conformidade com o disposto na presente Convenção e com o direito internacional.

Artigo 6.º
Salvo acordo em contrário das partes no litígio, o tribunal arbitral deve adoptar as suas próprias normas processuais.

Artigo 7.º
O tribunal arbitral deve, a pedido de uma das partes, recomendar medidas de protecção provisórias essenciais.

Artigo 8.º
1 - As partes em litígio devem facilitar o trabalho do tribunal arbitral e, utilizando todos os meios à sua disposição, devem, em especial:

a) Fornecer-lhe todos os documentos, informações e meios relevantes; e
b) Permitir-lhe, quando necessário, citar testemunhas ou peritos e receber as suas provas.

2 - As partes e os árbitros são obrigados a protegerem a confidencialidade de qualquer informação por eles recebida, de forma confidencial, durante o processo do tribunal arbitral.

Artigo 9.º
Salvo disposição em contrário do tribunal arbitral, devido às circunstâncias particulares da causa, as despesas do tribunal devem ser custeadas, em montantes iguais, pelas partes no litígio. O tribunal deve manter um registo de todas as suas despesas e deve fornecer às partes um relatório final sobre as mesmas.

Artigo 10.º
Qualquer parte que tenha um interesse de natureza jurídica na matéria a que se refere o litígio, que possa ser afectado pela decisão tomada sobre o caso, pode, mediante consentimento do tribunal, intervir no processo.

Artigo 11.º
O tribunal deve ouvir e resolver as reconvenções resultantes directamente da matéria a que se refere o litígio.

Artigo 12.º
As decisões do tribunal arbitral quer a nível processual quer a nível de conteúdo devem ser tomadas por maioria dos votos dos seus membros.

Artigo 13.º
Quando uma das partes no litígio não comparecer perante o tribunal arbitral ou não apresentar a sua defesa, a outra parte poderá pedir ao tribunal arbitral que continue os procedimentos e profira a sua decisão. A ausência de uma parte ou a não apresentação da sua causa não deve constituir impedimento aos procedimentos. Antes de proferir a sua decisão, o tribunal arbitral deve assegurar-se de que a pretensão está, de direito e de facto, bem fundamentada.

Artigo 14.º
1 - O tribunal deve proferir a sua decisão final nos cinco meses seguintes à data da sua completa constituição, a não ser que considere necessário prolongar o tempo limite por um período não superior a cinco meses.

2 - A decisão final do tribunal arbitral deve limitar-se à matéria a que se refere o litígio e ser fundamentada. Deve mencionar os nomes dos membros que tomaram parte da decisão e a data em que foi proferida. Qualquer membro do tribunal poderá juntar à decisão final a sua opinião individual ou dissidente.

3 - A decisão deve vincular as partes no litígio. Deve ser inapelável, a não ser que as partes no litígio tenham previamente acordado num procedimento de apelação.

4 - Qualquer desacordo que possa surgir entre as partes no litígio sobre a interpretação ou o modo de execução da decisão final pode ser submetido, por qualquer das partes, à decisão do tribunal arbitralque proferiu a decisão final.
